An Act to Amend

An Act to Amend the Human Rights Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

An Act to Amend the Human Rights Act, chap- ter 21 of the Acts of New Brunswick, 2004, is amended by adding after

section 1 the following: 1.1

Section 2 of the Act is amended by adding the following definition in alphabetical order: “social condition”, in respect of an individual, means the condition of inclusion of the individual in a socially identifiable group that suffers from social or economic disadvantage on the basis of his or her source of income, occupation or level of education; 2 The Act is amended by adding after

section 6 the following: 6.1 The Act is amended by adding after

section 7 the following: 7.01 Despite any provision of this Act, a limita- tion, specification, or preference on the basis of so- cial condition shall be permitted if it is included in a programme established by the Crown in right of the Province, or in

chapitre 21 des Lois du Nouveau- Brunswick de 2004, est modifiée par l’adjonction après l’article 1, de ce qui suit : 1.1 L’article 2 de la Loi est modifié par l’adjonc- tion de la définition suivante selon l’ordre alphabétique : « condition sociale » désigne la condition d’un individu résultant de son inclusion au sein d’un groupe social identifiable et socialement ou écono- miquement défavorisé fondée sur sa source de re- venu, sa profession ou son niveau d’instruction; 2 La Loi est modifiée par l’adjonction après l’ar- ticle 6 de ce qui suit : 6.1 La Loi est modifiée par l’adjonction après l’article 7 de ce qui suit : 7.01 Par dérogation à toute autre disposition de la présente loi, une restriction, une condition ou une préférence fondée sur la condition sociale est auto- risée si elle est prévue par un programme établi par la Couronne du chef de la province ou par une loi ou

Section 16 of the Act is repealed. 7.2 The Act is amended by adding after

section 27 the following: 28 The Lieutenant-Governor in Council may make regulations (

a) identifying the programmes, Acts and regu- lations falling within

section 7.01; (

An Act to Amend the Human Rights Act Bill 12 EXPLANATORY NOTES

Section 1 (adding

section 1.1) The effect of

section 1.1 is to add a definition of “social con- dition” to

section 2 of the Human Rights Act.

Section 2 (adding

section 6.1)

Section 6.1 adds a new provision after

section 7 of the Hu- man Rights Act.

Section 3 (adding sections 7.1 and 7.2)

Section 7.1 repeals

section 16 of the Human Rights Act.

Section 7.2 provides regulation-making authority in

section 28 of the Human Rights Act. NOTES EXPLICATIVES

Article 1 (ajoutant l’article 1.1) L’effet de l’article 1.1 est d’ajouter la définition de « condition sociale » à l’article 2 de la

Loi sur les droits de la personne.

Article 2 (ajoutant l’article 6.1) L’article 6.1 ajoute une nouvelle disposition après l’article 7 de la

Loi sur les droits de la personne .

Article 3 (ajoutant les articles 7.1 et 7.2) L’article 7.1 abroge l’article 16 de la

Loi sur les droits de la personne. L’article 7.2 prévoit un pouvoir de réglementation à l’article 28 de la

Loi sur les droits de la personne.
