AMENDMENT REGULATION

Health Act.

1 The Reportable and Notifiable Diseases Regulation

(AR 129/2014) is amended by this Regulation.

Schedule 1 is amended

(

a) in Column 2 of Row 2 by adding the following under

"Transmissible gastroenteritis":

Porcine epidemic diarrhea;

Swine delta coronavirus;

(

b) by adding the following after Row 8:

all domestic animals

Rabies

Schedule 2 is amended by adding the following after Row

12:

all wild animals

Rabies

FIREFIGHTERS' PRIMARY SITE CANCER

AMENDMENT REGULATION

1 The Firefighters' Primary Site Cancer Regulation

(AR 102/2003) is amended by this Regulation.

Section 2 is amended

(

a) by adding

Primary site cervical cancer 10 years

after

Primary site bladder cancer 15 years

(

b) by adding

Primary site ovarian cancer 10 years

after

Primary site lung cancer in non-smokers 15 years

(

c) by striking out

Primary site testicular cancer 20 years

and substituting

Primary site testicular cancer 10 years

Section 3 is repealed.

Alberta Regulation 3/2018

Marketing of Agricultural Products Act

SUGAR BEET PRODUCTION AND MARKETING

AMENDMENT REGULATION

and approved by the Alberta Agricultural Products Marketing Council on October 31,

2017 pursuant to sections 26 and 27 of the Marketing of Agricultural Products Act.

1 The Sugar Beet Production and Marketing Regulation

(AR 287/97) is amended by this Regulation.

Section 1 is amended

(

a) in subsection (1)

(

i) by repealing clause (b);

(ii) by repealing (g)(ii);

(

b) by adding the following after subsection (1):

(1.1) For the purposes of this regulation, a person is actively

engaged in the production and marketing of the regulated

product if the individual or the controlling person, as the case

may be, participates on a regular, continuous and substantial

basis to a farming operation situated in Alberta through a

combination of contributions related to capital, land and

equipment, but does include direct and regular personal labour

and direct and regular personal management but does not

include an individual or controlling person whose farming

operation is that of a landlord.

Section 22 is amended by adding "leased," after

"transferred,".

Section 32(

b) is amended by adding "or the leasing of" after

"transfer of".

5 The following is added after

section 35:

Transfer to actively engaged producer

35.1 A licensed producer who has been allotted quota may apply to

the Board to have all or a portion of the quota allotted to another

licensed producer under the following conditions:

(

a) the producer that quota is allocated to must be actively

engaged;

(

b) the quota must stay in the same growing area;

(

c) the quota can only be transferred every 3 years unless the

Board is of the opinion that extenuating circumstances exist

that warrant the transfer.

Leasing quota

35.2(1) The Board may authorize a licensed producer to lease up to

25 per cent of the licensed producer's quota in accordance with this

appropriate.

(2) The Board may refuse to authorize the lease of quota by a licensed

producer if

(

a) the proposed lessor has failed to pay outstanding service

charges owing to the Board,

(

b) the proposed lessee does not qualify for a licence to operate

as a licensed producer,

(

c) the proposed lease does not comply with the quota leasing

policies of the Board, or

(

d) the proposed lessor or lessee has contravened the Act, the

Plan, any regulation made under the Act or an order or

direction of Council or the Board.

Section 38 is repealed.

Section 51 is amended by striking out "November 30, 2018"

and substituting "November 30, 2023".

Forests Act

FOREST RESOURCES IMPROVEMENT AMENDMENT REGULATION

section 37 of the Environmental Protection and

Enhancement Act and sections 4 and 30 of the Forests Act.

1 The Forest Resources Improvement Regulation (AR

152/97) is amended by this Regulation.

Section 1(

e) is repealed and the following is substituted:

(e) "Minister" means the Minister of Agriculture and Forestry

except in

section 3, where "Minister" means the Minister of

Environment and Parks";

Section 3(2) is amended by striking out "of Environment

and Sustainable Resource Development".

Section 13 is amended by striking out "February 28, 2018"

and substituting "February 28, 2021".

Definitions

1 In this Regulation,

(a) "Act" means the Reform of Agencies, Boards and

Commissions Compensation Act;

(b) "base salary" means the base amount of remuneration paid in

a year to an employee in relation to the employee's

performance of duties, but does not include a bonus or other

incentive pay;

(c) "designated executive" means a person whose position is

designated as an executive position under

section 3;

(d) "public agency" means a public agency listed in the

Schedule

to the Act;

(e) "restraint period" means the period April 1, 2018 to

September 30, 2019;

(f) "salary compression" means a situation in which the

difference in base salary between employees is considered

too small to be equitable;

(g) "salary inversion" means a situation in which the base salary

of an employee is greater than the base salary of that

employee's supervisor.

Application

2 This Regulation applies

(

a) to designated executives who are designated executives when

this Regulation comes into force, and

(

b) to those persons who become or are reappointed as

designated executives after this Regulation comes into force.

Designation of executive positions

3 The positions of all employees of public agencies, other than the

positions of employees referred to in

section 1(2) of the Act, are

designated as executive positions for the purposes of this Regulation.

Establishment of compensation framework

4(1) A compensation framework is established by this Regulation.

(2) The effective date of the compensation framework is April 1,

(3) The terms of the compensation framework are set out in sections 5

to 7.

Salary restraint

5(1) No public agency shall increase the base salary of a designated

executive during the restraint period.

(2) Nothing in subsection (1) affects the operation of

section 6 of the

Reform of Agencies, Boards and Commissions Compensation

Regulation (AR 31/2017) with respect to those designated executives

to whom that

section applies.

Permitted adjustments

6 Notwithstanding

section 5(1), a public agency may, in accordance

with the public agency's existing policies, increase the base salary of a

designated executive during the restraint period to address one or more

of the following circumstances:

(

a) promotion of the designated executive;

(

b) to correct salary inversion;

(

c) to correct salary compression.

Exemption or modification

7(1) The Minister may by order

(

a) exempt a designated executive or a class of designated

executives from the application of one or more provisions of

the compensation framework, or

(

b) modify one or more provisions of the compensation

framework in respect of a designated executive or a class of

designated executives.

(2) An exemption or modification under subsection (1) may be for any

period specified by the Minister.

(3) Where the Minister makes an order under subsection (1), the

Minister must make the order public in any manner the Minister

considers appropriate.

Repeal

8 This Regulation is repealed on September 30, 2019.

Coming into force

9 This Regulation comes into force on April 1, 2018.

amended in

section 13 by striking out "April 30, 2019" and

substituting "April 30, 2024".

2 The Transmission Regulation (AR 86/2007) is amended in

section 54 by striking out "December 31, 2018" and

substituting "December 31, 2021".
