B.C. Reg. 3/2007, deposited January 19, 2007, pursuant to the ENVIRONMENTAL MANAGEMENT ACT [Section 139 (5)]. Order in Council 10/2007, approved and ordered January 18, 2007.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Cleaner Gasoline Regulation, B.C. Reg. 498/95, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Cleaner Gasoline Regulation, B.C. Reg. 498/95, is amended

(

a) by repealing paragraph (

a) of the definition of "additive compliance record"

and substituting the following:

(

a) a written record, prepared in accordance with Note 12 of the Canadian General Standards Board Standard CAN/CGSB

— 3.5 — 2004 "Unleaded Automotive Gasoline", of deposit control additive, added to the gasoline to meet the requirements of

section 6.19 of that Standard, or ,

(

b) in the definition of "deposit control additive" by striking out "CAN/CGSB 3.5

— 94" and substituting "CAN/CGSB — 3.5 — 2004",

(

c) by repealing the

definitions of "gasoline" and "parameter"

and substituting the following:

"gasoline" means a petroleum distillate, or a mixture of petroleum distillates, oxygenates or additives, that is liquid at atmospheric pressure with a vapour pressure of at least 38 kiloPascals and which is suitable for use in a spark ignition engine, but does not include gasoline for use in

(

a) aircraft,

(

b) competition vehicles, if the gasoline has an antiknock index of 100 or greater, or

(

c) scientific research;

"parameter" means a measure of gasoline quality with respect to its vapour pressure or oxygen concentration;

, and

(

d) by repealing the following

definitions:

"alternative baseline gasoline" ;

"aromatics" ;

"baseline gasoline" ;

"emissions model" ;

"olefins" ;

"service station" ;

"summer" ;

"summer pool average" ;

"toxics" ;

"winter" ;

"winter pool average" ;

"yearly pool average" .

Section 3 (1) is amended by striking out "sections 2 (5) and 4 to 7, on and after January 1, 1996," and substituting "sections 2 (5) and 4,".

Section 4 is amended

(

a) in subsection (1) by striking out "On and after April 15, 1996, a primary distributor" and substituting "A primary distributor",

(

b) in subsection (2) by striking out "On and after June 1, 1996, a primary distributor" and substituting "A primary distributor", and

(

c) in subsection (3) by striking out "On and after July 16, 1996, a primary distributor" and substituting "A primary distributor".

4 Sections 5 to 8 and

Schedule 2 are repealed.

Section 9 (1) is repealed and the following substituted:

(1) To determine parameter values for the purposes of this regulation,

(

a) the analytical methods referred to in the Canadian General Standards Board Standard CAN/CGSB

—3.5 — 2004 "Unleaded Automotive Gasoline" must be used, and

(

b) if the gasoline contains ethanol, the analytical methods referred to in the Canadian General Standards Board Standard CAN/CGSB

— 3.511 — 2005 "Oxygenated Unleaded Automotive Gasoline Containing Ethanol" must also be used.

Section 10 is amended

(

a) by repealing subsections (1) (

b) and (9), and

(

b) in subsection (1) by adding the following paragraph:

(

d) maintain records of any data and information collected in the course of or for the purpose of complying with reporting requirements under the

(

i) Benzene in Gasoline Regulations (SOR/97-493), and

(ii) Sulphur in Gasoline Regulations (SOR/99-236),

as amended from time to time.

Section 1 of

Schedule 1 is amended by repealing paragraphs (

a) to (

e) and substituting the following:

(

a) the Canadian General Standards Board Standard CAN/CGSB

— 3.5 — 2004 "Standard for Unleaded Automotive Gasoline";

(

b) the Canadian General Standards Board Standard CAN/CGSB

— 3.511 — 2005 "Standard for Oxygenated Unleaded Automotive Gasoline Containing Ethanol".
