FAIR TRADING REGULATIONS (EXPIRY) AMENDMENT REGULATION

Made by the Minister of Government Services (M.O. C:006/2004) on March 29, 2004

pursuant to sections 1(2), 25(3), 36, 55(3), 101(1), 105, 118, 124, 136(1), 137(7), 139,

140(3), 143 and 162(2) of the Fair Trading Act.

1(1) The Automotive Business Regulation (AR 192/99) is

amended by this section.

(2) Section 37 is amended by striking out "September 1, 2004"

and substituting "September 1, 2013".

2(1) The Collection Practices Regulation (AR 194/99) is

amended by this section.

(2) Section 28 is amended by striking out "September 1, 2004"

and substituting "September 1, 2013".

3(1) The Cost of Credit Disclosure Regulation (AR 198/99) is

amended by this section.

(2) Section 32 is amended by striking out "August 31, 2004" and

HINTON TRAINING CENTRE RATES REGULATION

Definitions

1 In this Regulation,

(a) "Centre" means the Hinton Training Centre at Hinton,

Alberta;

(b) "Department" means the Department under the Minister

responsible for the Act;

(c) "Department employees" means the employees of the

Government employed in the Department;

(d) "guests" means people sponsored by the Department

attending a course or event at the Centre, guest lecturers at

the Centre and special guests of the Centre;

(e) "others" means people other than guests or students;

(f) "students" means students enrolled full time at an accredited

school, college or university;

(g) "working day" means a day other than Saturday or a day

defined as a holiday in the

Interpretation Act.

Rates for meals and accommodations

2 The rates, not including GST, for meals only and for

accommodation and meals at the Centre are as follows:

(

a) guests: no charge;

(

b) students: $550.00 per month for meals and accommodation;

meals are provided by the Centre only on working days;

(

c) students: room only rate - $20.00 for each day;

(

d) others:

(

i) room only: $20.00 a day for each person based on

double occupancy;

(ii) room only: $40.00 a day for each person based on

single occupancy;

(iii) breakfast: $4.00 a day for each person;

(iv) lunch: $7.00 a day for each person;

(

v) dinner: $9.00 a day for each person.

Registration fee and facility rental costs

3(1) The registration fee, not including GST, for courses provided by

the Department for each person is:

(

a) guests: nil;

(

b) students: nil;

(

c) others: $100.00/day.

(2) Subject to

section 4, facility rental costs, not including GST, at the

Centre are:

(

a) classroom 130 (fire simulator): $750.00/day with

one operator

$250.00/day without

an operator;

(

b) classroom 134: $100.00/day

$50.00/half day;

(

c) classrooms 130,200,205,206: $60.00/day

$30.00/half day;

(

d) classrooms 142,214: $75.00/day

$37.50/half day;

(

e) classrooms 204,207,210,222,141: $65.00/day

$32.50/half day;

(

f) classroom 208 (GIS lab): $500.00/day

$250.00/half day;

(

g) gymnasium: $250.00/day

$125.00/half day;

(

h) rappel tower: $100.00/day

$50.00/half day;

(

i) dining room - upper level: $60.00/evening;

(

j) office space: $60.00/day

$30.00/half day.

Rate reductions

4 There is

(

a) a 10% rate reduction under

section 3(2)(

a) to (

f) for

classroom rentals of 7 days or more;

(

b) a 20% rate reduction under

section 3(2)(

a) to (

f) for

classroom rentals of 30 days or more.

Audio-visual equipment

5 The rates for use of audio-visual equipment for courses or meetings

at the Centre, other than those conducted by the Department, are set

out in the Schedule.

Cancellation policy

6(1) The cancellation policy applies to others.

(2) If notice of cancellation for meals and accommodation is received

fewer than 5 working days but not fewer than 3 working days before

the booking date, the cancellation charge is the amount equal to 10%

of the rate for meals and accommodation for one full day for each

participant.

(3) If notice of cancellation for meals and accommodation is received

fewer than 3 working days before the booking date, the cancellation

charge is the amount equal to the rate for meals and accommodation

for one full day for each participant.

(4) If notice of cancellation for classroom or other facilities rentals is

received fewer than 5 working days but not fewer than 3 working days

before the booking date, the cancellation charge is 10% of the daily

rental rate for each full day booked, to a maximum of 5 days.

(5) If notice of cancellation for classroom or other facilities rentals is

received fewer than 3 working days before the booking date, the

cancellation charge is the daily rental rate for each full day booked, to

a maximum of 5 days.

(6) If notice of cancellation of course registration is received fewer

than 28 days before the course start date, the cancellation charge is the

course registration fee for each participant.

(7) All cancellations must be received in writing by mail, fax or email,

to the Centre's program and events coordinator.

Repeal

7 The Forest Technology School Rates Regulation (AR 252/94) is

repealed.

Expiry

8 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on March 31, 2014.

Coming into force

9 This Regulation comes into force on April 1, 2004.

EQUIPMENT) REGULATION

Definitions

1 In this Regulation,

(a) "Act" means the Forest and Prairie Protection Act;

(b) "Department" means the department under the Minister

determined under

section 16 of the Government Organization

Act as the Minister responsible for the Act.

Remuneration and rates for services, vehicles and equipment

2(1) The remuneration to be paid for services provided in wildfire

presuppression or suppression operations is to be determined in

accordance with

Schedule 1.

(2) The rates to be paid for the use of vehicles and equipment in

wildfire presuppression or suppression operations are to be determined

in accordance with

Schedule 2.

(3) The remuneration and the rates referred to in subsections (1) and

(2) are to be calculated from the date this Regulation comes into force.

Repeal

3 The Forest Protection (Payment for Services, Vehicles and

Equipment) Regulation (AR 275/2003) is repealed.

Expiry

4 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on January 31, 2013.

Coming into force

5 This Regulation comes into force on April 1, 2004.

Schedule 1

Remuneration for Services

1 In this Schedule,

(a) "certified person" means a person who has the training and

experience necessary to be certified under the FPD Wildfire

Certification Program;

(b) "qualified person" means a person who meets the

requirements to be qualified under the FPD Wildfire

Certification Program;

(c) "trainee" means a person who does not meet the

requirements to be qualified under the FPD Wildfire

Certification Program but meets the minimum requirements

necessary to carry out a position until training or experience,

or both, have been acquired;

(d) "uncertified person" means a person who does not have the

training and experience necessary to be certified under the

FPD Wildfire Certification Program but meets the minimum

requirements to carry out a position until training or

experience, or both, have been acquired.

2 The remuneration payable to persons holding the positions set out

in Column 1 of the following table is to be determined in accordance

with the rates set out in Column 2 of the following table:

3 Remuneration for overtime hours is to be calculated in accordance

with the Employment Standards Code and the Employment Standards

Regulation (AR 14/97).

4 Holiday remuneration is to be calculated at the rate of 4% on all

regular hours worked, and is not calculated on overtime hours.

Schedule 2

Rates for the Use of Vehicles and Equipment

1 The rates prescribed in this

Schedule include amounts to be paid for

the provision of fuel and remuneration for the operator, unless

otherwise specified.

2(1) The rates to be paid for the hire of the following vehicles are to

be determined in accordance with the following:

(

a) passenger cars (all makes)

(does not include driver): $48/day

(

b) vans (all makes): $ per km $ per hr

(i) 6 to 8 passenger van $ 0.74 $ 37.00

(2) Notwithstanding subsection (1), if vehicles are hired from a

commercial rental business, the rental rate of that business is the rate to

be paid.

3(1) The base hourly rate to be paid in respect of skidders is to be

determined in accordance with the current Alberta Road Builders and

Heavy Construction Association Equipment Rental Rates Guide.

(2) The total hourly rate to be paid in respect of skidders is determined

in accordance with the following:

(

a) equipment servicing and the use of the service vehicle is to

be part of the base hourly rate identified in subsection (1);

(

b) if the skidder hired is requested to be equipped with a water

tank, pump or hose, the rate is to be increased in accordance

with this Regulation;

(

c) if the operator does not supply the fuel, the rate is to be

decreased by 10%.

4(1) The rates to be paid in respect of rubber tired or tracked

all-terrain vehicles are to be determined in accordance with the

following:

(2) The hourly rate is to be determined in accordance with the

following:

(

a) equipment servicing and the use of the service vehicle is to

be part of the hourly rate;

(

b) if the all-terrain vehicle hired is requested to be equipped

with a water tank, pump or hose, the rate is to be increased in

accordance with this Regulation;

(

c) if the operator does not supply the fuel, the rate is to be

decreased by 10%.

5 The rates to be paid in respect of miscellaneous firefighting

equipment are to be determined in accordance with the following:

(1) Portable Fire Pumps (all types)

(

a) pumps with 50 mm or larger discharge

ports, rate per hour $ 4.75

(

b) pumps with 38 mm discharge ports,

rate per hour $ 4.25

(

c) pumps with 25 mm or smaller discharge

ports, rate per hour $ 3.75

(

d) the rates in clauses (

a) to (

c) apply if the Department supplies

gasoline and oil only;

(

e) if the owner or operator supplies gasoline and oil, the rates in

clauses (

a) to (

c) are increased by $1.00 per hour.

(2) Power Saws (all types)

(

a) saws with engine size of 54 to 57 cc, rate per

hour $4.50

(

b) saws with engine size over 57 cc, rate per

hour $5.50

(

c) the rates in clauses (

a) and (

b) apply if the Department

supplies gasoline and oil only;

(

d) if the owner or operator supplies gasoline and oil, the rates in

clauses (

a) and (

b) are increased by $1.00 per hour.

(3) Fire Hose

For each 30-metre length of lined discharge fire hose supplied by the

owner or operator, the rate to be paid is $0.20 per length per hour.

(4) Skidder and All-terrain Vehicle Water Tanks

The rate to be paid in respect of requested water tanks for skidders and

all-terrain vehicles is to be calculated at a rate of $0.006 per litre per

hour.

(

a) Add applicable rate per day for portable fire pump if tank is

so equipped and pump is requested.

(

b) Add applicable rate per day for pump fuel and oil if supplied

by owner or operator.

(

c) Add applicable rate if the owner or operator is requested to

supply hose.

(5) Stationary Tanks (tanks only) without a truck or pump
