General information about corrections and minor changes

The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors.

Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of

an Act or regulation without changing its legal effect.

Notice of the following types of minor changes must be given:

replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]

replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a

chapter number; [s. 25(2)(g)]

removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]

updating a reference to a person, office, organization, place or thing if

an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]

updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than

a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and

a change in the title of a minister or the name of a department; [s. 25(2)(j)]

updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act , the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]

correcting an error in the numbering of a provision or other portion of

an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]

correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]

if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]

removing a provision that is deemed by The

Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions

1 In this regulation,

"Act" means The Public Schools Act ; (« Loi »)

"division" means the Division scolaire franco-manitobaine established in

section 3; (« division »)

"election" means the election of a person to serve as a trustee of the division; (« élection »)

"electoral division" means an electoral division established by a by-law of the division made in accordance with

section 21.36.1 of the Act; (« circonscription électorale »)

"eligible voter" means a person who, under

section 11, is entitled to vote in an election; (« électeur admissible »)

"region" means a region established under

section 4; (« région »)

"school" means a school in which a francophone program is provided by the francophone school board. (« école »)

Entitlement to vote

11 A person may vote in an election if he or she is a Canadian citizen who

(

a) will be at least 18 years old on election day;

(

b) has resided in Manitoba for at least six months immediately before election day;

(

c) is a resident of the electoral division in which the election is being held;

(

d) is

(

i) entitled to vote under

section 21.37 of the Act,

(ii) an entitled person under

section 21.1 of the Act, or

(iii) an entitled person under the extended meaning of "entitled person" in subsection 21.37(1) of the Act; and

(

e) is not disqualified under the Act or any other Act, and is not otherwise prohibited by law, from voting in school division or school district elections.

Preparation of list — information from division

12(1) To assist in the preparation of the voters list for the division, the senior election official must request the following information from the division:

(

a) at least 42 days before election day,

(

i) a list of the names and addresses of each parent or legal guardian of a child enrolled in the francophone program in the electoral division in which the election is being held,

(ii) a list of persons who in the preceding 12-month period have completed the form set out in

Schedule E requesting the francophone school board to provide instruction for their school-age children, but whose children are not yet enrolled in a program, and

(iii) a list of persons who are parents or legal guardians of children who are enrolled in nursery programming conducted by the francophone school board or entities which have entered into an affiliation arrangement with the francophone school board;

(

b) at least annually, a list of the names and addresses of each person who has received a provincial high school diploma or a provincial certificate of completion for an Individualized Senior Years Program from a school.

12(2) The division must provide the requested information to the senior election official in the form and manner, and within the time, specified by the senior election official.

12(3) For certainty, the senior election official is not required to maintain an up-to-date voters list between elections.

Adding or correcting information on voters list

12(4) A qualified voter may apply to the senior election official to have his or her name added to the voters list or to correct any information about the voter on the voters list. To do so, the person must complete and sign the form set out in

Schedule F and establish his or her identity to the senior election official in accordance with

section 17.

Public notice — voters list and personal security

13(1) The senior election official must give public notice of the following, in the year of a general election at the time the senior election official considers appropriate:

(

a) that a person who wishes to have his or her name added to the voters list, or have any information about the voter on the voters list corrected, may do so by contacting the senior election official: and

(

b) that the personal security protection provisions of The Municipal Councils and School Boards Elections Act apply in respect of the voters list of the division.

17(1) Before being given a ballot, each eligible voter must establish his or her identity by providing

(

a) an official document issued by a federal, provincial or municipal government that contains the person's name, address and photograph; or

(

b) at least two other documents that provide evidence of the person's identity satisfactory to the election official who asked the person for identification.

(

a) with subsection (2); and

b) if his or her right to vote is challenged, with subsection 79(5) (what challenged person must do to vote) of The Municipal Councils and School Boards Elections Act .

b) takes an oath that he or she is an eligible voter; and

(

c) establishes his or her identity in accordance with

section 17.

19(1) Where public notice is required to be given, the notice must be given

(

a) by posting it

(

i) in each applicable school, and

(ii) in any other conspicuous places in each electoral division affected by the subject matter of the notice, as the senior election official considers reasonable; and

(

b) by publishing a copy of it in La Liberté or in a newspaper having general circulation throughout the electoral division affected by the subject matter of the notice.

Form of request for instruction

41 A person who wishes to have instruction provided to his or her child by the francophone school board must complete the form set out in

Schedule E and submit it to the board at a time determined by the board.

Guidelines for board of reference

42(1) To determine the wishes of entitled persons whose children are enrolled in a francophone program for which a request for transfer is made under

section 21.25 of the Act, the board of reference shall survey the parents of each child attending the program and ask whether or not they wish their child's education to be provided by the francophone school board.
