OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice and Attorney General dated March 18, 2009, and pursuant to Sections 3 and 4 of

Chapter 252 of the Revised Statutes of Nova Scotia, 1989, the Legal Aid Act, is pleased to: (

a) reappoint Christopher Manning of Kentville, Kings County, as a director of the Nova Scotia Legal Aid Commission for a term of office of three years commencing March 30, 2009; (

b) reappoint Frank DeMont of New Glasgow, Pictou County, as a director of the Nova Scotia Legal Aid Commission for a term of three years commencing March 30, 2009; (

c) reappoint Trinda Ernst, Q.C. of Kentville, Kings County, as a director of the Nova Scotia Legal Aid Commission for a term of office of three years commencing June 22, 2009; (

d) appoint Ronald R. Chisholm of Truro, Colchester County, as a director of the Nova Scotia Legal Aid Commission for a term of three years commencing March 30, 2009; (

e) provide that the remuneration of Christopher Manning, Frank DeMont, Ronald R. Chisholm and Trinda Ernst, Q.C. as directors shall be at the rate of $150 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (

f) direct that the reasonable expenses incurred by Christopher Manning, Frank DeMont, Trinda Ernst, Q.C. and Ronald R. Chisholm in performing their duties associated with the Nova Scotia Legal Aid Commission be paid in accordance with the established guidelines approved for civil servants; and (

g) order that the Province shall defend, negotiate or settle claims or charges made against Christopher Manning, Frank DeMont, Trinda Ernst, Q.C. and Ronald R. Chisholm and indemnify them from personal liability, provided that the Province is satisfied that the claim arises out of their activities in relation to their appointments and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
