EXPLANATORY NOTE NOTE EXPLICATIVE This Bill contains a number of changes to The Civil Service Superannuation Act (the "Act"). Le présent projet de loi a pour objet de modifier l a

Loi sur la pension de la fonction publique (la Loi ). OLD AGE SECURITY INTEGRATION The Act allows a member who retires before becoming entitled to the Canada Pension Plan (CPP) or Old Ag e Security (OAS) to elect to integrate his or her superannuation allowance with CPP or OAS benefits.

In light of recent federal changes providing for OAS benefits to commence at age 67, integration with OAS benefits will not be allowed for pensions commencing on or after January 1, 2016. (section 20) INTÉGRATION À L 'ALLOCATION DE SÉCURITÉ DE LA VIEILLESSE La Loi permet au participant qui prend sa retraite avant d'être admissible au Régime de pensions du Canada (RPC) ou à la Sécurité de la vieillesse (SV) de faire int égrer son allocation de retraite à sa pension RPC ou à son allocation SV.

CLARIFYING DISABILITY ENTITLEMENT The Act contemplates that the board may provide additional pensions to persons who have received lo ng term disability benefits under an employer's progra m.

Amendments are made to ensure that the additional pension provisions apply to employees of a service provider, such as Teranet. (section 31) PRÉCISIONS CONCERNANT LE DROIT AUX PRESTATIONS D'INVALIDITÉ La Loi habilite la Régie à accorder des prestations supplémentaires aux personnes qui ont touché des prestations d'invalidité à long terme en vertu d'un programme établi par leur employeur. APPLICATION FOR A PENSION Under current law, the time within which a member m ust apply for an allowance differs depending on which s et of qualifying criteria the member meets. This Bill res olves that inconsistency by specifying that an applicatio n for a pension, other than a disability allowance, must be made within 185 days prior to the date on which the memb er wants the pension to commence. Members may select the basic superannuation allowan ce (payable for the life of the member) or one of a nu mber of optional annuities. This Bill requires the member t o specify a choice before the commencement date of th e pension.

If the member does not specify a choice, t he member is deemed to have selected a pension which provides survivorship benefits for his or her spous e or common-law partner (as required under The Pension Benefits Act ) or a minimum ten-year annuity if the member does not have a spouse or common-law partner. (subsection 17(1) and

MISCELLANEOUS AMENDMENTS The employee contributions to be made by judges and masters while on parental and maternity leave is cl arified. (subsections 10(2) and (3)) MODIFICATIONS DIVERSES Les cotisations que doit verser l'employé qui occup e un poste de juge ou de conseiller-maître et qui prend un congé parental ou un congé de maternité sont précisées [paragraphes 10(2) et (3)]. When a member dies, a spouse or other person may become entitled to receive annuity payments to whic h the member was entitled.

Under current law, when the sp ouse or other person dies the remaining annuity could be come payable to the member's estate, which might have be en wound up some time earlier. This Bill provides grea ter planning certainty by specifying that on the death of the spouse or other person, the annuity becomes payable to the recipient's estate rather than to the member's esta te. (subsections 17(3) and (4))

En cas de décès du participant, son conjoint ou une autre personne peut devenir bénéficiaire de versements au

titre de la rente à laquelle le participant avait droit. This Bill repeals an obsolete provision that permit s the board to pay a small portion of a death benefit to the deceased's spouse or common-law partner rather than to the member's estate. (sections 24 and 27) Le projet de loi entraînerait l'abrogation d'une di sposition désuète qui permet à la Régie de verser une petite

A member who has contributed more than 50% of the commuted value of the pension may be entitled to re ceive the excess either by way of refund or transfer to a money purchase account.

This Bill clarifies that an amoun t refunded to the person or withdrawn from the money purchase account may not subsequently be repaid by the member. There are a variety of circumstances in which an employee may "purchase service" to increase the value of the employee's pension. Payment for such service may be made in whole or by instalment. This Bill clarifies that it is only while the employee is employed that he or she can purchase or pay for such service.

If the person ret ires or dies before making full payment in respect of the s ervice being purchased, only that portion of the service t hat has been paid for is taken into account for the purpose of the pension. (section 12 and subsections 29(1) and (8)) Les employés peuvent, dans diverses situations, « ac heter des années de service » afin d'accroître la valeur d e leur pension. section 29 or to receive the allowance calculated in accordance with

section 26. A) the CPP pension were commenced when the member reached the age of 60, (

B) the CPP pension were based only on the member's service under this Act, and (

(« programme ») "service provider" means a service provider as defined in The Real Property Act whose employees are deemed to be in the civil service for the purpose of this Act.
