OIC Text: The Governor in Council on the report and recommendation of the Attorney General and Minister of Justice dated December 19, 2017, and pursuant to Sections 3 and 4 of
Chapter 252 of the Revised Statutes of Nova Scotia, 1989, the Legal Aid Act , is pleased to: (
a) appoint Barry Bernard of Cape Breton Regional Municipality (Eskasoni), Kathryn Dumke, Q.C. of Lower Branch, Lunenburg County, and Lana Birch-Rideout of Kentville, Kings County, as part-time directors of the Nova Scotia Legal Aid Commission, each for a term of three years, commencing February 6, 2018; (
b) determine that the remuneration of Barry Bernard, Kathryn Dumke, Q.C., and Lana Birch-Rideout shall be at the rate of $150.00 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (
c) re-appoint Brian MacLellan, Q.C., of Halifax Regional Municipality (Halifax) as a part-time director of the Nova Scotia Legal Aid Commission for a term of three years, commencing February 6, 2018; (
d) determine that the remuneration of Brian MacLellan, Q.C., shall be at the rate of $150.00 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (
e) re-appoint Donald G. Harding, Q.C. of Shelburne, Shelburne County, as a part-time director of the Nova Scotia Legal Aid Commission for a term of three years and re-appoint him as Chairman for a term of one year, commencing March 30, 2018; (
f) determine that the remuneration of Donald G. Harding, Q.C. shall be at the rate of $150 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year, during the period he serves only as a part-time director, and $300.00 for each day of meetings of the Commission or a committee of it during the period he serves as a part-time director and Chairman; (
g) re-appoint Ronald Chisholm of Truro, Colchester County, as a part-time director of the Nova Scotia Legal Aid Commission nominated by the Nova Scotia Barristers’ Society for a term of three years, commencing March 30, 2018; (
h) re-appoint George Ash of Halifax Regional Municipality (Halifax), as a part-time director of the Nova Scotia Legal Aid Commission, nominated by the Nova Scotia Barristers’ Society for a term of three years, commencing May 1, 2018; (
i) re-appoint Trinda Ernst, Q.C., of Kentville, Kings County, as a part-time director of the Nova Scotia Legal Aid Commission, nominated by the Nova Scotia Barristers’ Society for a term of three years, commencing June 22, 2018; (
h) provide that the remuneration of Ronald Chisholm, George Ash, and Trinda Ernst, Q.C. shall be at the rate of $150.00 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (
i) direct that the reasonable expenses incurred by all aforementioned appointees in performing their duties associated with the Nova Scotia Legal Aid Commission be paid in accordance with the policies applicable to Nova Scotia civil servants; and (
j) order that the Province shall defend, negotiate or settle claims or charges made against Ronald Chisholm, George Ash, and Trinda Ernst Q.C., and indemnify them from personal liability, provided that the Province is satisfied that the claim arises out of their activities in relation to their appointments and is not based on fraud or criminal activity, and where the Province so defends them, the Province will be in control of the case.
