B.C. Reg. 262/2002, deposited September 27, 2002, pursuant to the BC BENEFITS (CHILD CARE SUBSIDY) ACT [section 13]. Order in Council 875/2002, approved and ordered September 26, 2002.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective on the date the

Employment and Assistance Act and the Employment and Assistance for

Persons with Disabilities Act come into force, the BC Benefits (Child Care) Regulation, B.C. Reg. 74/97, is amended as set out in the attached Schedule. — G. ABBOTT, Minister of Community, Aboriginal and Women's Services; G. CAMPBELL, Presiding Member of the Executive Council.

Schedule

1 The BC Benefits (Child Care) Regulation, B.C. Reg. 74/97, is amended by repealing the title and substituting "CHILD CARE SUBSIDY REGULATION".

section 1 is amended

(

a) by repealing the definition of "Act" and substituting the following:

"Act" means the Child Care Subsidy Act ; ,

(

b) by repealing the definition of "employability program",

(

c) by repealing the definition of "employment-related program" and substituting the following:

"employment-related program" has the same meaning as in

section

1 of the Employment and Assistance Regulation; ,

(

d) by repealing the definition of "person with disabilities" and substituting the following:

"person with disabilities" means a person who has been designated as a person with disabilities under the

Employment and Assistance for Persons with Disabilities Act ; , and

(

e) by repealing the definition of "self-employment program" and substituting the following:

"self-employment program" means a program, established or funded under the

Employment and Assistance Act , to assist a person to be self-employed as proprietor of, or partner in, a small business; .

section 3 is amended

(

a) in subsection (2) by striking out "subsection (1) (a) (i)" and substituting "subsection (1) (a)",

(

b) in subsection (2) (

a) by repealing subparagraph (iii) and substituting the following:

(iii) is seeking employment or participating in an employment-related program; , and

(

c) in subsection (2) (

b) by repealing subparagraph (

i) and substituting the following:

(

i) each parent is employed or self-employed, attends an educational institution or participates in an employment-related program, .

section 9 (2) (

c) is repealed and the following substituted:

(

c) income assistance under the Employment and Assistance Act or a disability assistance benefit under the

Employment and Assistance for Persons with Disabilities Act ; .

section 9.1 is amended

(

a) by repealing subsection (1) (b) (ii) and substituting the following:

(ii) the increase is not provided for in the calculation of the family's shelter allowance under the Employment and Assistance Regulation or the Employment and Assistance

for Persons with Disabilities Regulation. , and

(

b) in subsection (2) by striking out everything before paragraph (

a) and substituting the following:

(2) Income of a recipient of income assistance under the

Employment and Assistance Act or disability assistance under the Employment and Assistance

for Persons with Disabilities Act is exempted from the total income of the recipient's family if .

section 17 is amended

(

a) in subsection (6) by striking out "decision to discontinue or reduce" and substituting "decision that results in a discontinuation or reduction of", and

(

b) in subsection (7) by striking out "decision to refuse" and substituting "decision that results in a refusal of".

section 18 is amended

(

a) in subsection (1) by striking out "decision made under

section 17 of this regulation to discontinue or reduce" and substituting "decision that results in a discontinuation or reduction of", and

(

b) in subsection (2) by striking out "decision made under

section 17 of this regulation to refuse to pay" and substituting "decision that results in a refusal to pay".

section 19 is repealed and the following substituted:

Prescribed Acts

19 The following Acts are prescribed for the purposes of

section 7 (4) (

b) of the Act:

(

a) Employment and Assistance Act ;

(

b) Employment and Assistance for Persons with Disabilities

Act .
