Lower East Chezzetcook Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-1318 (November 4, 1976), N.S. Reg. 155/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 14th day of October, A.D., 1976, pursuant to

Section 5(1) of

Chapter 6 of the

Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high watermark of Lower

East Chezzetcook Beach, in the County of Halifax, Province of Nova Scotia, as shown outlined

in red on the copy of Crown Land Records Office Plan No. E-7-73, marked

Schedule “B”, and

described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high watermark of Lower East

Chezzetcook Beach, in the County of Halifax, Province of Nova Scotia as shown outlined in

red on the copy of Crown Land Records Office Plan No. E-7-73, attached hereto and being

more particularly described as follows:

Beginning at an iron pin cemented in a large rock on the shore of the Atlantic Ocean at Lower

East Chezzetcook, said iron pin being south two degrees forty-six minutes twenty seconds west,

two hundred thirty-one decimal thirty-three feet from an iron pin situated at the southwesterly

angle of Grant No. 1697;

From thence (by astronomic bearings) north sixteen degrees fifteen minutes thirty-three

seconds west, six hundred forty-one decimal ninety-nine feet to an iron pin marked “1”

cemented in a rock, situated one hundred feet more or less from the mean high watermark of

the Atlantic Ocean;

Thence north sixty degrees one minute thirty-two seconds west, five hundred thirty-three

decimal eighty-two feet to an iron pin marked “2” cemented in a rock situated on the southerly

shore of Meisner Lake;

Thence south seventy-three degrees, fifty-four minutes twelve seconds west, one thousand

eleven decimal sixty-one feet to an iron pin marked “3” driven in the ground, situated ten feet

more or less from the mean high watermark of the southerly shore of Meisner Lake;

Thence south sixty-one degrees zero minutes twenty-six seconds west, two thousand five

hundred thirty-four decimal twelve feet to an iron pin marked “4” cemented in a rock, situated

at the mean high watermark on the southerly shore of a small island near the southerly shore of

Meisner Lake;

Thence south thirty-five degrees eight minutes thirty-six seconds west, nine hundred forty

decimal seventy-two feet to an iron pin marked “5” cemented in a rock, situated eighty feet

more or less from the mean high watermark of the Atlantic Ocean;

Thence south one degree forty-five minutes forty-nine seconds east, one thousand one hundred

fifty-one decimal seventy-five feet to an iron pin marked “6” cemented in a rock, situated

fifty-three feet more or less from the mean high watermark of the Atlantic Ocean;

Thence south zero degrees fifty-two minutes thirty-nine seconds east, six hundred seventy-five

decimal thirteen feet to an iron pin marked “7” cemented in a rock, situated forty-five feet more

or less from the mean high watermark of the Atlantic Ocean;

Thence south forty-one degrees forty-seven minutes nine seconds west, one hundred fifty-three

decimal forty feet to an iron pin marked “8” cemented in a rock, situated fifty feet more or less

from the mean high watermark of the Atlantic Ocean;

Thence north forty degrees fifteen minutes forty-five seconds west, seven hundred forty

decimal zero five feet to an iron pin marked “9” cemented in a rock, situated sixty-four feet

more or less from the mean high watermark of the Atlantic Ocean;

Thence north seventy-four degrees nine minutes thirty-four seconds west, four hundred

thirty-two decimal eighty-seven feet to an iron pin marked “10” cemented in a rock, situated

twenty-five feet more or less from the mean high watermark of the Atlantic Ocean;

Thence north twenty-nine degrees zero minutes three seconds east, four hundred sixteen

decimal zero feet to an iron pin marked “11” cemented in a rock, situated at the mean high

watermark of the Atlantic Ocean;

Thence north twenty-four degrees fifty-four minutes forty-two seconds west three hundred

eleven decimal fifty-one feet to an iron pin marked “12” cemented in a rock, situated at the

mean high watermark of the Atlantic Ocean;

Thence north twenty-four degrees fifty minutes fifty seconds west, eight hundred eighty-three

decimal thirty-seven feet to an iron pin marked “13” cemented in a large rock, situated at the

mean high watermark of the Atlantic Ocean;

Thence south seventy-five degrees three minutes forty-three seconds west, two hundred

thirty-four decimal zero seven feet to an iron pin marked “14” cemented in a rock, situated at

the mean high watermark of the Atlantic Ocean and fifty-seven feet more or less from the

centre line of a Government Road;

Thence south sixteen degrees thirty-one minutes fifty-six seconds west, crossing the said

Government Road, seven hundred seventy-nine decimal eighty-four feet to an iron pin marked

“15” driven in the ground, situated fifty-seven feet more or less from the centreline of the said

Government Road;

Thence south sixteen degrees zero minutes forty-nine seconds west, three hundred sixteen

decimal eighty-four feet to an iron pin marked “16” driven in the ground, situated five feet

more or less from the mean high watermark of the Atlantic Ocean and fifty-seven feet more or

less from the centreline of the said Government Road;

Thence north thirty-nine degrees twenty-eight minutes seven seconds west, three hundred

fifty-three decimal sixty feet to an iron pin marked “17” driven in the ground, situated at the

mean high watermark of the Atlantic Ocean;

Thence north twenty-nine degrees five minutes thirty-one seconds west, one thousand sixty-one

decimal ninety-one feet to an iron pin marked “18” driven in the ground, situated at the corner

of a lot of land and ten feet more or less from the mean high watermark of the Atlantic Ocean;

Thence north seven degrees two minutes twenty-one seconds west, four hundred decimal

seventy-seven feet to an iron pin marked “19” driven in the ground, situated twenty feet more or

less from the mean high watermark of the Atlantic Ocean;

Thence south eighty-two degrees forty-five minutes zero seconds west, three thousand two

hundred forty decimal zero feet to a point in the Atlantic Ocean, said point shown as Point “A”

on said plan;

Thence south seven degrees fifteen minutes zero seconds east, five thousand five hundred

seventy decimal zero feet to a point in the Atlantic Ocean, said point shown as Point “B” on

said plan;

Thence north eighty-two degrees forty-five minutes zero seconds east, six thousand one

hundred fifty decimal zero feet to a point in the Atlantic Ocean, said point shown as Point “C”

on said plan;

Thence on a calculated bearing and distance north twenty-nine degrees forty-five minutes

eighteen seconds east, six thousand seven hundred sixty-nine decimal seventy-six feet to the

place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high watermark.
