Loi sur le Musée du Nouveau-Brunswick His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 3 of the New Brunswick Museum Act,

chapter 193 of the Revised Statutes, 2011, is amended 1 L’article 3 de la

Loi sur le Musée du Nouveau- Brunswick,

chapitre 193 des Lois révisées de 2011, est modifié (

a) in subsection (4) of the English version by striking out “his or her term” and substituting “the member’s term”;

a) au paragraphe (4) de la version anglaise, par la suppression de « his or her term » et son remplace ‐ ment par « the member’s term »; (

b) by repealing subsection (5) and substituting the following:

Section 7 of the Act is amended by adding after paragraph (

a) the following: 2 L’article 7 de la Loi est modifié par l’adjonction de ce qui suit après l’alinéa a) : (a.1) to enlarge, repair, renovate or alter the build ‐ ings used for the purposes of the Museum and which were vested in the Board on April 17, 1943, and to plan and supervise the enlargement, reparation, reno ‐ vation or alteration of the buildings; a.1) d’agrandir, de réparer, de rénover ou de modi ‐ fier les édifices utilisés aux fins du Musée qui ont été dévolus au Conseil le 17 avril 1943 ainsi que de plani‐ fier et de superviser ces étapes; 1

(a.2) to design, erect, enlarge, repair, renovate or al ‐ ter a building to be used for the purposes of the Mu ‐ seum that is or will be, as the case may be, located on land acquired by the Board in accordance with sub ‐

section 12(2) and to plan and supervise the design, erection, enlargement, reparation, renovation or alter ‐ ation of the building; a.2) de concevoir, de construire, d’agrandir, de ré ‐ parer, de rénover ou de modifier un édifice destiné à être utilisé aux fins du Musée qui est ou qui sera, se ‐ lon le cas, situé sur tout terrain acquis par le Conseil conformément au paragraphe 12(2) ainsi que de plani‐ fier et superviser ces étapes; 3 Subsection 8(1) of the Act is amended 3 Le paragraphe 8(1) de la Loi est modifié (

Section 9 of the Act is amended 4 L’article 9 de la Loi est modifié (

a) by repealing paragraph (

d) for regulating the use of the buildings vested in the Board on April 17, 1943, and any other building used for the purposes of the Museum and of their con ‐ tents and for protecting the buildings and their fit ‐ tings, furniture and contents from injury, destruction or misuse;

e) by striking out “the building” and substituting “any of the buildings referred to in paragraph (d)”;

Non-application of the Crown Construction Contracts Act Non-applicabilité de la

Loi sur les contrats de construction de la Couronne 10.1 The Crown Construction Contracts Act and the regulations under that Act do not apply to any agreement made by the Board for the following purposes: 10.1 La

a) the enlargement, reparation, renovation or alter ‐ ation of the buildings used for the purposes of the Museum and which were vested in the Board on April 17, 1943; and

b) the planning, design, erection, enlargement, rep ‐ aration, renovation or alteration of a building to be used for the purposes of the Museum that is or will be, as the case may be, located on land acquired by the Board in accordance with subsection 12(2).

Immunity Immunité de poursuite 10.2 No action, application or other proceeding lies or shall be instituted against any of the following persons in relation to anything done or purported to be done in good faith, or in relation to anything omitted in good faith, under this Act by the person: 10.2 Bénéficient de l’immunité de poursuite engagée par voie d’action ou autre instance les personnes ci-après pour un acte accompli ou paraissant avoir été accompli de bonne foi ou pour une omission commise de bonne foi dans le cadre de la présente loi : (

Indemnity Indemnisation 10.3 The following persons shall be indemnified by the Crown in right of the Province against all costs, charges and expenses incurred by the person in relation to any action, application or other proceeding brought against the person in connection with the duties of the person and with respect to all other costs, charges and expenses that the person incurs in connection with those duties, except costs, charges and expenses that are occa ‐ sioned by that person’s wilful neglect or wilful default: 10.3 Sauf pour les coûts, les frais et les dépenses qui résultent de leur négligence ou de leur faute volontaires, les personnes ci-après sont indemnisées par la Couronne du chef de la province à l’égard tant de l’intégralité des coûts, des frais et des dépenses qu’elles engagent dans le cadre de toute action ou autre instance intentée contre elles en raison de leurs fonctions que de tous autres coûts, frais et dépenses qu’elles exposent à ce

section 10.1, as enacted by

section 5 of this Bill, is repealed. 8(1) Si l’article 36 de la Loi modifiant la

An Act to Amend the Procure ‐ ment Act,

chapter 38 of the Acts of New Brunswick, 2021, comes into force on or after the date this Bill re ‐ ceives Royal Assent,

section 10.1 of the New Brunswick Museum Act is repealed. 8(2) Si l’article 36 de la Loi modifiant la
