EXPLANATORY NOTE NOTE EXPLICATIVE The Foreign Cultural Objects Immunity from Seizure Act provides that certain foreign works of art or cultu ral objects will be protected from seizure while in Man itoba. That protection is triggered by a determination tha t the work or object is culturally significant or that its temporary exhibit or display is of interest to Manitobans. Cu rrently, the determination must be made by Cabinet and set o ut in an Order in Council. This Bill allows the minister to make the determination rather than Cabinet. La

Loi sur l'insaisissabilité des biens culturels étra ngers prévoit que certaines œuvres d'art ou certains bien s culturels de pays étrangers seront protégés de tout e saisie pendant qu'ils sont au Manitoba. Cette protection d écoule d'une décision selon laquelle ils ont une importanc e culturelle ou leur exposition temporaire pourrait intéresser les Manitobains. En ce moment, cette décision doit être prise par le Conseil exécutif et faire l'objet d'un décret. Le présent projet de loi permettrait au ministre, plut ôt qu'au Conseil exécutif, de prendre cette décision.

Section 1 is amended (

a) in the part before clause (a), by striking out everything after " before the work or object is brought into Manitoba " and substituting " the minister who is charged with the administration of this Act determines "; and 2
