OIC Text: The Governor in Council on the report and recommendation of the Minister responsible for the Elections Act and on the recommendation of the Chief Electoral Officer dated July 28, 2008, and pursuant to clause 6(

a) and

Section 7 of

Chapter 140 of the Revised Statutes of Nova Scotia, 1989, the Elections Act, pursuant to subsection 18(1) of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act, and pursuant to

Section 2 of

Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, is pleased to: (

a) revoke the appointment of Roderick MacArthur as Assistant Chief Electoral Officer made by Order in Council 93-147 dated February 16, 1993 and amended by Order in Council 93-244 dated March 9, 1993; (

b) appoint Richard Temporale as Assistant Chief Electoral Officer for the Province of Nova Scotia; (

c) fix the remuneration of Richard Temporale in accordance with a salary range equivalent to MCP 30(104%) (currently $102,011.37), subject to all applicable enactments, regulations and policies of the Public Service Commission with respect to the Management Compensation Plan; (

d) direct that Richard Temporale be eligible for consideration to receive annual amounts payable under the MCP Pay for Performance Policy and for any applicable economic adjustments provided to non bargaining unit civil servants; (

e) direct that Richard Temporale shall receive vacation entitlement at the rate of 6 weeks per fiscal year and all other customary benefits of a civil servant including participation in the Province of Nova Scotia Long Term Disability Plan; (

f) designate Richard Temporale to be and to have been an employee for the purposes of the Public Service Superannuation Act.
