An Act to Amend the Mortgage Brokers Act Loi modifiant la

Loi sur les courtiers en hypothèques Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1 Subsection 11(1) of the Mortgage Brokers Act ,

chapter 41 of the Acts of New Brunswick, 2014, is amended 1 Le paragraphe 11(1) de la

Loi sur les courtiers en hypothèques,

chapitre 41 des Lois du Nouveau- Brunswick de 2014, est modifié (

a) by repealing paragraph (

d) and substituting the following:

d) comply with any errors or omissions insurance requirements and any working capital requirements that are prescribed by regulation;

b) by adding after paragraph (

11.1(2) The Director may approve education programs and continuing education programs for the purposes of this Act and the regulations. 11.1(2)

d) of the Act is repealed and the following is substituted: 3 L’alinéa 18(3)

d) the mortgage broker or mortgage associate has failed to successfully complete any required continu- ing education programs approved by the Director un- der subsection 11.1(2).

Section 23 of the Act is amended by adding after subsection (1) the following: 4 L’article 23 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 23(1.1) A mortgage brokerage shall not make a desig- nation under section (1) unless, in the opinion of the Di- rector, 23(1.1) La maison de courtage d’hypothèques ne pro- cède à une désignation en vertu du paragraphe (1) que si le directeur est d’avis : (

a) the individual is suitable to perform the duties and responsibilities of a principal broker, and

a) d’une part, que le particulier est apte à exercer les attributions du courtier principal; (

b) the proposed designation is not objectionable.

Section 29 of the Act is amended 5 L’article 29 de la Loi est modifié (

a) in subsection (1)

i) by repealing paragraph (

a) and substituting the following: (

a) a copy of an investor disclosure form or an in- vestor renewal disclosure form provided by the Direc- tor containing the information prescribed by regula- tion, completed and signed by the mortgage brokerage;

a) une copie de la formule de renseignements ou de renouvellement de renseignements à l’intention de l’investisseur, fournie par le directeur, qu’elle a rem- plie puis signée et qui renferme les renseignements ré- glementaires; (ii) in paragraph (

b) by striking out the period at the end of the paragraph and substituting a semi-colon followed by “and”; (ii) à l’alinéa b ), par la suppression du point à la fin de l’alinéa et son remplacement par un point-virgule; (iii) by adding after paragraph (

b) the follow- ing: (iii) par l’adjonction de ce qui suit après l’ali- néa b) : (

c) any other information, in writing, that an in- vestor of ordinary prudence would consider to be ma- terial to a decision about whether to make the invest- ment in the mortgage.

39(3) The Director shall establish the method of calcu- lating the amount of working capital required to be held by a mortgage brokerage or mortgage administrator un- der subsection (1). 39(3)

Le directeur établit le mode de calcul du fonds de roulement que doit maintenir la maison de courtage d’hypothèques ou l’administrateur d’hypothèques en ap- plication du paragraphe (1). 7

Section 49 of the Act is repealed and the following is substituted: 7 L’article 49 de la Loi est abrogé et remplacé par ce qui suit : 49(1) Within the time prescribed by regulation, a li- cence holder shall provide the Director with an annual return that contains the information prescribed by regula- tion. 49(1) Le titulaire de permis remet au directeur dans le délai réglementaire un rapport annuel renfermant les ren- seignements réglementaires. 49(2) The Director may require a licence holder re- ferred to in subsection (1) to provide additional informa- tion or material that the Director considers necessary. 49(2)

g) by striking out “and training and educational requirements”;
