Statute: Public Highways Act Expropriation Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Public Works dated November 8, 2022, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 80 of

Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , is pleased to: (

a) extinguish the right of the public to use that portion of the public highway, identified as Lot 2021-1, containing an area of 1,477.16 square metres (0.37 acres), more or less, located at or near Hillside Boularderie Road, Groves Point, Cape Breton County, more particularly described in

Schedule "A" and shown on

Schedule "B" attached to and forming part of the Report and Recommendation; (

b) authorize the conveyance of a parcel of surplus land, Lot 2021-1, to Robert and Judy Hardy of North Sydney, Cape Breton County, Nova Scotia for the consideration of $3,418.50 plus HST of $512.78 for a total purchase price of $3,931.28; (

c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the land herein above described; and (

d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purpose of this Order.
