B.C. Reg. 294/2009 , deposited December 11, 2009, pursuant to the CARBON TAX ACT [Sections 21, 39 and 84]. Order in Council 696/2009, approved and ordered December 10, 2009.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective January 1, 2010, the Carbon Tax Regulation, B.C. Reg. 125/2008, is amended as set out in the attached Appendix.

Appendix

Section 1 (2) of the Carbon Tax Regulation, B.C. Reg. 125/2008, is amended by adding the following definition:

"industrial oil" means a light fuel oil but does not include diesel fuel, heating oil and locomotive diesel fuel; .

Section 7 is amended by adding the following paragraph:

(

d) industrial oil.

3 Sections 10, 17, 26 and 35 are amended by striking out " marketable " wherever it appears.

Section 44 (1) is amended

(

a) in paragraph (

c) by striking out " raw ",

(

b) by deleting paragraph (e), and

(

c) by adding the following paragraphs:

(

f) gas liquids;

(

g) pentanes plus;

(

h) gasoline;

(

i) light fuel oil.
