Reg. 208/2022 , deposited October 24, 2022, under the EVIDENCE ACT [section 51], the EMPLOYMENT AND ASSISTANCE ACT [section 35 (2)], the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [section 26 (2)], the EMPLOYMENT STANDARDS ACT [section 127 (2)], the HOSPITAL ACT [section 56 (3)], the PUBLIC HEALTH ACT [section 121], the LABORATORY SERVICES ACT [section 71], the LIQUOR CONTROL AND LICENSING ACT [section 11], the COMMUNITY CARE AND ASSISTED LIVING ACT [section 34] and the WORKERS COMPENSATION ACT [section 315]. Order in Council 536/2022, approved and ordered October 24, 2022.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders the following:

(

a) the Designation Regulation No. 2, B.C. Reg. 125/99, is amended as set out in the attached

Schedule 1,

(

b) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in the attached

Schedule 2,

(

c) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in the attached

Schedule 3,

(

d) the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in the attached

Schedule 4,

(

e) the Hospital Act Regulation, B.C. Reg. 121/97, is amended as set out in the attached

Schedule 5,

(

f) the Information Regulation, B.C. Reg. 208/2010, is amended as set out in the attached

Schedule 6,

(

g) the Laboratory Services Regulation, B.C. Reg. 52/2015, is amended as set out in the attached

Schedule 7,

(

h) the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended as set out in the attached

Schedule 8,

(

i) the Residential Care Regulation, B.C. Reg. 96/2009, is amended as set out in the attached

Schedule 9, and

(

j) the Workers Compensation Act Appeal Regulation, B.C. Reg. 321/2002, is amended as set out in the attached

Schedule 1

Section 1 (

c) of the Designation Regulation No. 2, B.C. Reg. 125/99, is repealed and the following substituted:

(

c) the British Columbia College of Oral Health Professionals, but only with respect to health care professionals who are authorized to use the title "dentist"; .

Schedule 2

Section 1 of

Schedule C of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(

a) in the definition of "dental hygienist" by striking out " College of Dental Hygienists established under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ",

(

b) in the definition of "dentist" by striking out " College of Dental Surgeons of British Columbia continued under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ", and

(

c) in the definition of "denturist" by striking out " College of Denturists of British Columbia established under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ".

Schedule 3

Section 1 of

Schedule C of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(

a) in the definition of "dental hygienist" by striking out " College of Dental Hygienists established under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ",

(

b) in the definition of "dentist" by striking out " College of Dental Surgeons of British Columbia continued under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ", and

(

c) in the definition of "denturist" by striking out " College of Denturists of British Columbia established under the Health Professions Act " and substituting " British Columbia College of Oral Health Professionals ".

Schedule 4

Section 31 (

e) of the Employment Standards Regulation, B.C. Reg. 396/95, is repealed and the following substituted:

(

e) a registrant of the British Columbia College of Oral Health Professionals who is authorized to use the title "dentist", "dental surgeon", "surgeon" or "doctor", .

Schedule 5

Section 7 of the Hospital Act Regulation, B.C. Reg. 121/97, is amended

(

a) by repealing subsection (1) (a) (i.1) and substituting the following:

(i.1) practise a profession regulated by the British Columbia College of Oral Health Professionals and to use the title "dentist", "dental surgeon", "surgeon", "doctor" or "dental therapist", or ,

(

b) by repealing subsection (4) (a.1) and substituting the following:

(a.1) the British Columbia College of Oral Health Professionals, or , and

(

c) in subsection (6) (

b) by striking out " College of Dental Surgeons of British Columbia " in both places and substituting " British Columbia College of Oral Health Professionals ".

Section 15 (2) is amended by striking out " College of Dental Surgeons of British Columbia " and substituting " British Columbia College of Oral Health Professionals ".

Schedule 6

Section 3 (2) (h) (

v) of the Information Regulation, B.C. Reg. 208/2010, is repealed and the following substituted:

(

v) the British Columbia College of Oral Health Professionals, if the registrant is, or the former registrant was, authorized to use the title "dentist", "dental surgeon", "surgeon", "doctor" or "dental therapist"; .

Schedule 7

Section 3 (1) (

a) of the Laboratory Services Regulation, B.C. Reg. 52/2015, is amended by striking out " College of Dental Surgeons of British Columbia " and substituting " British Columbia College of Oral Health Professionals ".

Schedule 8

Section 192 (1) of the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended in the definition of "dentist" by striking out " College of Dental Surgeons of British Columbia continued under " and substituting " British Columbia College of Oral Health Professionals established under ".

Schedule 9

Section 54 (4) of the Residential Care Regulation, B.C. Reg. 96/2009, is repealed and the following substituted:

(4) For the purposes of subsection (3), "dental health care professional" means a person who is a registrant of the British Columbia College of Oral Health Professionals and is authorized to use any of the following titles:

(

a) dentist;

(

b) dental surgeon;

(

c) surgeon;

(

d) doctor;

(

e) dental therapist;

(

f) dental hygienist;

(

g) denturist.

Schedule 10

Section 5 (

a) of the Workers Compensation Act Appeal Regulation, B.C. Reg. 321/2002, is repealed and the following substituted:

(

a) registration as a registrant of the British Columbia College of Oral Health Professionals and authorization to use the title "dentist", "dental surgeon", "surgeon", "doctor" or "dental therapist"; .
