Appendix 1

Appendix 2

Section 1 (1) of the Hunting Regulation, B.C. Reg. 190/84, is amended by adding

the following definition:

“brow palm” , in relation to an antler of a moose, means the lateral branch that is separated

from a main palm by the deepest antler bay, and for the purposes of this definition

the deepest antler bay is the antler bay whose vertex is the shortest distance from

the antler base when measured along the surface of the antler; .

Section 15 is amended

(

a) in subsection (1) by striking out “ subsection (2) ” and substituting “ subsection (2.1) ”,

(

b) in subsection (2) by striking out “ elk, moose or deer ” and substituting “ elk or moose ” , and

(

c) by adding the following subsection:

(2.1) For the purpose of

section 36 of the Act, a person who possesses the whole carcass or part of a carcass of a deer must leave naturally attached to the carcass or one part of the carcass in the person’s possession

(

a) if the animal was male, either

(

i) that portion of the head that bears the antlers, or

(ii) all of the following:

(

A) a testicle;

(

B) a part of the penis;

(

C) the animal’s unskinned tail, and

(

b) if the animal was female,

(

i) the animal’s unskinned tail, and

(ii) either that portion of the head that in males normally bears antlers, or

a portion of the udder or teats.

Section 16.1 (1) (

Section 18 (1) is amended by striking out “ or ” at the end of paragraph (

j) and by adding the following paragraphs:

(

l) hunts while accompanied by, or with the use or aid of, a goat or sheep, including

by using the goat or sheep as a pack animal, or

(

m) hunts in any M.U. in Region 6 or 7, except in M.U. 6-12 or 6-13, while accompanied

by, or with the use or aid of a camelid, including by using the camelid as a pack

animal.

Section 19 (3) is amended by striking out “ April 16 ” and substituting “ July 1 ”.

Section 1 (4) of

Part 3 of

Schedule 1 is repealed and the following substituted:

(4) Despite subsection (2), the bag limit for mule (black-tailed) deer, in those

portions of M.U. 1-1 consisting of that portion of Sidney Island above the mean high

water mark and outside the boundaries of the Gulf Islands National Park Reserve and

that portion of James Island above the mean high water mark, is 3, of which 3 may

be antlerless.

section 71 of the Wildlife Act , in addition to the requirements of subsection (1) of this section, a meatcutter

or an operator of a cold storage plant must, immediately upon receiving the wildlife

a) in an area described in items 37, 38 (except those areas highlighted in orange

Alexander Creek

elevation to the point of commencement.

Shulaps Mountain

105 Effective year round, in that portion of M.U. 3-32 above 1 920 m elevation, commencing

at a point due north of the apex of Shulaps Mountain at 1 920 m elevation; thence

in a general easterly, southerly, westerly, northerly and easterly direction at 1 920 m

elevation to the point of commencement.

Iron/Lime Creek and Big/Little Sand Creek

106 Effective year round, in that portion of M.U. 4-22 outlined in red on the attached

Map No. 1-94/16, except that, between June 16 and the first Tuesday after Labour Day,

motor vehicles are permitted on roads indicated in dashed black lines on that map.

Sanca Creek

107 Effective year round, in that portion of M.U. 4-06 outlined in red on the attached Map No. 1-95/16, except that, between June 16 and August 30, motor vehicles are permitted on roads indicated in dashed black lines on that map.

Leadville Creek

108 Effective year round, in that portion of M.U. 4-06 outlined in red on the attached Map No. 1-96/16, except that, between June 16 and August 30, motor vehicles are permitted on roads indicated in dashed black lines on that map.

Dutch Creek and Brewer Creek

109 Effective year round, in that portion of M.U. 4-26 outlined in red on the attached Map No. 1-97/16, except that

Oliver Mountain

110 Effective year round, in that portion of M.U. 8-01 outlined in red on the attached Map No. 1-98/16.

Section 9 of

Schedule 2 is amended

(

a) by repealing paragraphs (c), (l), (

m) and (v), and

(

b) in paragraph (

n) by adding “ , and all roads leading off the main Harrison Creek Forest Service Road west of the 67 km marker ” after “ Little Tower Creek ”.

Section 22 of

Schedule 2 is amended by striking out “ described as the Moffat Lake-Spokin Forest Service Road (FSR) (Project # 7968-05) and any side roads, ” and substituting “ being the #7968-6 Forest Service Road ”.

Section 37 (

f) of

Revelstoke/Shuswap

(1) Effective year round, in those portions of M.U.s 3-35, 3-36, 3-37, 3-42, 4-38 and 4-39 highlighted in hatched red lines on the attached Map No. 7-12/11, except that

(

a) at all times, snowmobiles are permitted in the 20-metre wide corridors shown in green on that map,

(

b) between December 1 and May 31, snowmobiles are permitted in the 20-metre wide corridors shown in pink on that map in M.U.s 3-41 and 7-2, and

(

c) between November 15 and April 15, snowmobiles are permitted in the 20-metre wide corridors shown in pink on that map in M.U. 3-44.

Section 10 of the Public Access Prohibition Regulation, B.C. Reg. 187/2003, is amended

(

a) in subsection (1) (

b) by striking out “ land or air during the period of April 15 to June 30 ” and substituting “ land, water or air during the period April 15 to July 15 ”,

(

b) in subsection (1) (

c) by striking out “ of April 1 to April 14 and from July 1 to August 1 ” and substituting “ April 1 to July 31 ”, and

(

c) by repealing subsection (2) and substituting the following:

(2) The prohibitions in subsection (1) do not apply to that unsurveyed portion of Parcel 1 of DL 132, Kootenay District, Explanatory Plan DD5116, containing 0.433 hectares, more or less, tenured under the Land Act to Castle Rock Enterprises Inc. File #44003970.

(3) Despite subsection (1) (a), a person does not commit an offence if he or she uses or operates a motor vehicle on the Waldo Cove Road.

(4) The prohibition in subsection (1) (

b) does not apply to the following portions of DL 132:

(

a) Beach Area #1, Explanatory Plan DD.R20629;

(

b) Beach Area #2, Explanatory Plan DD.R20628.

(5) Despite subsection (1) (b), a person does not commit an offence if he or she accesses the area referred to in that subsection by land or water solely for the purpose of using the boat launch.
