Order in Council 675/2015, approved and ordered November 23, 2015.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective November 28, 2016, the regulations set out in the attached

Schedule are amended as set out in that Schedule.

Schedule

Adoption Agency Regulation

Section 1 of the Adoption Agency Regulation, B.C. Reg. 292/96, is amended by repealing the definition of “society” and substituting the following:

“society” has the same meaning as in the Societies Act .

Adoption Regulation

Section 1 of the Adoption Regulation, B.C. Reg. 291/96, is amended in the definition of “aboriginal agency” by striking out “ a society registered under the Society Act that ” and substituting “ a society, as defined in

section 1 of the Societies Act , that ”.

Amalgamation of Regional Health Boards and Community Health Councils Regulation

Section 6 of the Amalgamation of Regional Health Boards and Community Health Councils Regulation, B.C. Reg. 338/96, is repealed and the following substituted:

Indemnification

(1) Subject to subsection (2), for the purposes of

section 16 of the Act, a regional health board or community health council may indemnify a former director of a designated corporation, on amalgamation of the designated corporation with the regional health board or community health council, on the same basis that applies to directors or former directors of a regional health board or community health council under sections 64 and 65 of the Societies Act .

(2) A regional health board or community health council must not indemnify a former director of a designated corporation under subsection (1) unless the court, as defined in

section 1 of the Societies Act , approves the indemnification.

BC Online Regulation

4 The

Schedule to the BC Online Regulation, B.C. Reg. 103/2014, is amended by striking out “ Society Act ” and substituting “ Societies Act ”.

British Columbia Broiler Hatching Egg Scheme

Section 5 (2) (

a) of the British Columbia Broiler Hatching Egg Scheme, B.C. Reg. 432/88, is amended by striking out “

section 42 of the Society Act , ” and substituting “

section 112 of the Societies Act , ”.

British Columbia Chicken Marketing Scheme, 1961

Section 3.17 (

a) of the British Columbia Chicken Marketing Scheme, 1961, B.C. Reg. 188/61, is amended by striking out “

section 42 of the Society Act , ” and substituting “

section 112 of the Societies Act , ”.

British Columbia Egg Marketing Scheme, 1967

Section 18.6 (2) of the British Columbia Egg Marketing Scheme, 1967, B.C. Reg. 173/67, is amended by striking out “

section 42 of the Society Act , ” and substituting “

section 112 of the Societies Act , ”.

British Columbia Milk Marketing Board Regulation

Section 4 (2) (

a) of the British Columbia Milk Marketing Board Regulation, B.C. Reg. 167/94, is amended by striking out “

section 42 of the Society Act , ” and substituting “

section 112 of the Societies Act , ”.

British Columbia Turkey Marketing Scheme

Section 20 (4) (

a) of the British Columbia Turkey Marketing Scheme, B.C. Reg. 174/66, is amended by striking out “

section 42 of the Society Act , ” and substituting “

section 112 of the Societies Act , ”.

Business Corporations Regulation

Section 7 (1) of the Business Corporations Regulation, B.C. Reg. 65/2004, is repealed and the following substituted:

(1) For the purposes of sections 22 (4), 26 (1), 28 (1) and (2) and 382 (1) (b) (ii) of the Act, a name or assumed name must not resemble any of the following to such an extent that, in the opinion of the registrar, the name or assumed name is likely to confuse or mislead:

(

a) the name of a company;

(

b) the name or assumed name under which an extraprovincial company is registered under the Act;

(

c) the name of another corporation incorporated, amalgamated, continued or otherwise formed in British Columbia;

(

d) the name or assumed name under which another corporation is registered

(

i) under the Cooperative Association Act as an extraprovincial association as defined in

section 1 (1) of that Act, or

(ii) under the Societies Act as an extraprovincial non-share corporation as defined in

section 1 of that Act;

(

e) a name or assumed name reserved under the Act, the Cooperative Association Act or the Societies Act .

Section 30 (2) is amended by adding the following paragraphs:

(e.1) a conversion application under

section 267.2 of the Act;

(

l) an application for extension under

section 422 (5.1) of the Act.

Section 31 is amended by adding the following paragraph:

(b.1) conversion applications under

section 267.2 of the Act; .

Business Number Regulation

Section 3 of the Business Number Regulation, B.C. Reg. 388/2003, is amended

(

a) in paragraph (

l) by striking out “ or Society Act , ” and substituting “ or Societies Act , ”, and

(

b) by repealing paragraph (l) (

i) and substituting the following:

(

i) has had published in respect of the entity a notice that the entity may be dissolved or have its registration cancelled, .

Section 4 is amended by striking out “ Society Act ” and substituting “ Societies Act ”.

Community Contribution Company Regulation

Section 2 of the Community Contribution Company Regulation, B.C. Reg. 63/2013, is repealed and the following substituted:

Qualified entity

2 For the purposes of paragraph (

c) of the definition of “qualified entity” in

section 51.91 (1) of the Act, a society as defined in the Societies Act , other than a member-funded society as defined in

section 190 of that Act, is prescribed.

Community Tenures Regulation

Section 2 (

a) of the Community Tenures Regulation, B.C. Reg. 352/2004, is repealed and the following substituted:

(

a) a society as defined in the Societies Act , if the society can demonstrate that it is not prohibited under

section 2 (2) of that Act from holding a community forest agreement; .

Section 8 (

a) is repealed and the following substituted:

(

a) a society as defined in the Societies Act , if the society can demonstrate that it is not prohibited under

section 2 (2) of that Act from holding a community salvage licence; .

Compensation and Disaster Financial Assistance Regulation

Section 8 (1) of the Compensation and Disaster Financial Assistance Regulation, B.C. Reg. 124/95, is amended by repealing paragraph (

c) of the definition of “charitable or volunteer organization” and substituting the following:

(

c) is a society as defined in

section 1 of the Societies Act or a registered extraprovincial non-share corporation as defined in

section 167 of that Act; .

Consumer Contracts Regulation

Section 5 (4) (

b) of the Consumer Contracts Regulation, B.C. Reg. 272/2004, is amended by striking out “ as defined in the Society Act ; ” and substituting “ as defined in the Societies Act ; ”.

Employment Standards Regulation

Section 1 (1) of the Employment Standards Regulation, B.C. Reg. 396/95, is amended by repealing paragraph (

b) of the definition of “charity” and substituting the following:

(

b) a society as defined in the Societies Act ; .

First Nation Tenures Regulation

Section 1 of the First Nation Tenures Regulation, B.C. Reg. 104/2011, is amended by repealing the definition of “society” and substituting the following:

“society” means a society as defined in the Societies Act .

22 Sections 2 (3) (b), 3 (3) (

b) and 4 (4) (

b) are amended by striking out “ the Society Act ” and substituting “ the Societies Act ”.

Hospital Transfer Regulation

Section 1 (

a) of the Hospital Transfer Regulation, B.C. Reg. 359/94, is amended by striking out “ the Society Act , ” and substituting “ the Societies Act , ”.

Motor Vehicle Act Regulations

Section 19.13 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is repealed and the following substituted:

Registered extraprovincial non-share corporation

19.13 A registered extraprovincial non-share corporation, as defined in

section 167 of the Societies Act , is prescribed for the purposes of

section 4 (2) (

c) of the Act.

Organic Agricultural Products Certification Regulation

Section 2 of the Organic Agricultural Products Certification Regulation, B.C. Reg. 200/93, is amended

(

a) in the definition of “producer certifying agency” by striking out “ a society, incorporated under the Society Act , ” and substituting “ a society, as defined in

section 1 of the Societies Act , ”, and

(

b) in the definition of “trade certifying agency” by striking out “ a society incorporated under the Society Act ” and substituting “ a society, as defined in

section 1 of the Societies Act , ”.

Section 7 (

b) is amended by striking out “ a society incorporated under the Society Act , ” and substituting “ a society as defined in

section 1 of the Societies Act , ”.

Park, Conservancy and Recreation Area Regulation

Schedule K of the Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90, is amended in

section 1 (2) of

Part 5 in the definition of “non-profit organization” by striking out “ a club or association incorporated pursuant to the Society Act ” and substituting “ a club or association that is a society as defined in the Societies Act ”.

Passenger Transportation Regulation

Section 1 (1) of the Passenger Transportation Regulation, B.C. Reg. 266/2004, is amended in the definition of “society” by striking out “ the Society Act ; ” and substituting “ the Societies Act ; ”.

Provider Regulation

Section 1 of the Provider Regulation, B.C. Reg. 222/2014, is amended by repealing the definition of “First Nations Health Authority” and substituting the following:

“First Nations Health Authority” means the First Nations Health Authority, a society under the Societies Act ; .

Provincial Sales Tax Exemption and Refund Regulation

Section 9 (1) of the Provincial Sales Tax Exemption and Refund Regulation, B.C. Reg. 97/2013, is amended by repealing paragraph (

a) of the definition of “youth organization” and substituting the following:

(

a) a society as defined in the Societies Act , .

Section 121 (1) is amended in the definition of “PHSA” by striking out “ a society incorporated under the Society Act . ” and substituting “ a society under the Societies Act . ”

Range Regulation

Section 6 of the Range Regulation, B.C. Reg. 116/2005, is amended

(

a) in subsection (1) by repealing the definition of “society” and substituting the following:

“society” has the same meaning as in the Societies Act . , and

(

b) in subsection (4) (

b) by striking out “ the Society Act ” and substituting “ the Societies Act ”.

School Site Acquisition Charge Regulation

Section 2 (1) (g) (

i) of the School Site Acquisition Charge Regulation, B.C. Reg. 17/2000, is repealed and the following substituted:

(

i) a society under the Societies Act , other than a member-funded society as defined in

section 190 of that Act, .

Social Workers Regulation

Section 4 (2) (

a) of the Social Workers Regulation, B.C. Reg. 323/2008, is amended

(

a) in subparagraph (iv) by adding “ or ” after “ Village, ”, and

(

b) by repealing subparagraph (vi).

Transfer Regulation

Section 4 (1) of the Transfer Regulation, B.C. Reg. 351/2004, is amended by repealing the definition of “society” and substituting the following:

“society” means a society as defined in the Societies Act .

36 Sections 5 (3) (b), 6 (4) (

b) and 7 (3) (

b) are amended by striking out “ the Society Act ” and substituting “ the Societies Act ”.

Wines of Marked Quality Regulation

Section 8 (1.1) of the Wines of Marked Quality Regulation, B.C. Reg. 79/2005, is amended by striking out “

section 3 (1) of the Society Act . ” and substituting “

section 42 (1) of the Societies Act . ”
