chapter 7 of the Acts of New Brunswick, 2013, is amended by adding the following definition before

section 117.1: 1 La

section 117.2: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 117.2 : Energy Efficiency Fund Fonds pour l’efficacité énergétique 117.21(1) There is established a fund called the En ‐ ergy Efficiency Fund. 117.21(1) Est institué le Fonds pour l’efficacité éner ‐ gétique. 117.21(2) The Minister shall be the custodian of the Fund and the Fund shall be held in trust by the Minister. 117.21(2) Le ministre est le dépositaire du Fonds, qu’il tient en fiducie. 117.21(3) The Fund shall be held for the purposes of

section 117.23 in a separate account in the Consolidated Fund. 117.21(3) Le Fonds est détenu, aux fins d’application de l’article 117.23, dans un compte distinct faisant

partie du Fonds consolidé. 117.21(4) Amounts transferred to the Fund in accord ‐ ance with

117.21(5) All payments out of the Fund made for the purposes of

Amounts transferred to the Fund Sommes virées au Fonds 117.22(1) During each fiscal year, the Minister of Fi ‐ nance and Treasury Board shall transfer, in accordance with the regulations, from the Consolidated Fund to the Fund, the minimum amount prescribed by regulation. 117.22(1) Au cours de chaque exercice financier, le ministre des Finances et du Conseil du Trésor vire, con ‐ formément aux règlements, des sommes du Fonds con ‐ solidé au Fonds lesquelles sont d’un montant minimal fixé par règlement. 117.22(2) Despite the Financial Administration Act , the Comptroller may for the purposes of this

section make payments out of the Consolidated Fund. 117.22(2) Par dérogation à la

Use of assets of the Fund Utilisation de l’actif du Fonds 117.23 The assets of the Fund shall be used by the Corporation for the purpose of funding the development and delivery of any of the following programs and initia ‐ tives in relation to energy efficiency and energy conser ‐ vation 117.23 L’actif du Fonds est utilisé par la Société pour financer la conception et la prestation de l’un ou plu ‐ sieurs des programmes et des initiatives relatifs à l’effi ‐ cacité énergétique et à la conservation énergétique qui suivent : (

a) for non-electric fuel types,

b) that are prescribed by regulation,

c) for persons, groups, organizations or classes of persons, groups or organizations prescribed by regula‐ tion, and

c) ceux qui s’appliquent à des personnes, à des groupes, à des organismes ou à des catégories de per ‐ sonnes, de groupes ou d’organismes qui sont prescrits par règlement; (

d) that are set out in a mandate letter provided to the Corporation by the Minister.

Section 142 of the Act is amended by adding before paragraph (
