On the recommendation of the undersigned, the Lieutenant Governor, by and with
the advice and consent of the Executive Council, orders that, effective September
1, 2017,
(
a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as
set out in the attached Appendix 1, and
(
b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002,
is amended as set out in the attached Appendix 2.

Appendix 1
Section 62.1 of the Employment and Assistance Regulation, B.C. Reg. 263/2002,
is amended
(
a) in subsection (1) by striking out “ a dependent child ” and substituting “ a person under 19 years of age ”, and
(
b) in subsection (2) (
a) by striking out “ children ” and substituting “ persons ”.
2 Sections 67 (1) and 68 are amended by striking out “ a dependent child ” wherever it appears and substituting “ under 19 years of age ”.
Section 71 is amended
(
a) by repealing subsection (1) and substituting the following:
(1) The minister may provide orthodontic supplements to or for a family unit in receipt of income assistance if the orthodontic supplements are provided to or for a person in the family unit who meets the conditions under subsection (2) and who is under 19 years of age. , and
(
b) by repealing the portion of subsection (2) before paragraph (
a) and substituting
the following:
(2) For a person referred to in subsection (1) to be eligible for orthodontic
supplements, the person’s family unit must have no resources available to cover the
cost of the orthodontic supplements and the person must .
Section 72 is repealed and the following substituted:
Dental and optical supplements – healthy kids program
72 The minister may provide a health supplement in accordance with
section 7 [dental and optical services – healthy kids program] of
Schedule C to or for a family unit if the supplement is provided to or for a dependent
child in the family unit who is not eligible to receive the supplement under another
provision of this Division or under Division 4 [Health Supplements] of
Part 5 of the Employment and Assistance for Persons with Disabilities Regulation.
Hearing instrument supplement – healthy kids program
72.1 The minister may provide a health supplement in accordance with
section 7.1 [hearing instruments – healthy kids program] of
Schedule C to or for a family unit if the supplement is provided to or for a dependent
child in the family unit who is not eligible to receive the supplement under another
provision of this Division or under Division 4 [Health Supplements] of
Part 5 of the Employment and Assistance for Persons with Disabilities Regulation.
Section 77.02 is amended by striking out “ a dependent child ” wherever it appears and substituting “ under 19 years of age ”.
6 The following
section is added to Division 5:
Alternative hearing assistance supplement – healthy kids program
77.03 The minister may provide a health supplement set out in
section 11 of
Schedule C
to or for a family unit in receipt of premium assistance under the Medicare Protection Act if the supplement is provided to or for a dependent child in the family unit who
is not eligible to receive the supplement under another provision of this Division
or under Division 4 [Health Supplements] of
Part 5 of the Employment and Assistance for Persons with Disabilities Regulation.
Section 1 of
Schedule C is amended in the
definitions of “basic dental service” , “denture services” and “emergency dental service” by striking out “ April 1, 2010 and is on file with the office of the deputy minister ” wherever it appears and substituting “ September 1, 2017 and is published on the website of the ministry of the minister ”.
Section 1 of
Schedule C is amended in the definition of “basic dental service”
(
a) by striking out “ for the service in that
Schedule ” wherever it appears and substituting “ in that
Schedule for the service and the category of person receiving the service ”, and
(
b) in paragraph (
c) by striking out “ April 1, 2010, and is on file with the office of the deputy minister ”, and substituting “ September 1, 2017 and is published on the website of the ministry of the minister ”.
Section 1 of
Schedule C is amended in the definition of “denture services” by striking out “ for the service or item in that
Schedule ” wherever it appears and substituting “ in that
Schedule for the service or item and the category of person receiving the
service or item ”.
Section 1 of
Schedule C is amended in the definition of “emergency dental service” by striking out “ in that
Schedule ” wherever it appears and substituting “ in that
Schedule for the service and the category of the person receiving the service ”.
Section 3 (3) of
Schedule C is amended by adding “ or
section 7.1 of this
Schedule ” after “
section ”.
Section 3.11 (2) of
Schedule C is amended by adding “ or 77.03 ” after “
section 77.02 ”.
Section 4 (1) (
a) of
Schedule C is repealed and the following substituted:
(
a) in respect of a person under 19 years of age, including a child in a home
of a relative, a 2 year period beginning on January 1, 2017 and on each subsequent
January 1 in an odd numbered year, and .
Section 4 (1.1) (
a) of
Schedule C is repealed and the following substituted:
(a) $2 000 each period, if provided to a person under 19 years of age, and .
Section 4.1 (1) (
b) of
Schedule C is amended by striking out “ on file with the office of the deputy minister ” and substituting “ published on the website of the ministry of the minister ”.
Section 7 of
Schedule C is amended
(
a) in subsection (1) by striking out “ 2009 ” and substituting “ 2017 ”,
(
b) in subsection (2) by striking out “ services for a child ” and substituting “ services for a dependent child ”, and
(
c) in subsection (2) (
a) by striking out “ $1 400 ” and substituting “ $2 000 ” and by striking out “ year ” and substituting “ period ”.
17 The following
section is added to
Schedule C:
Hearing instruments – healthy kids program
7.1 The minister may pay under
section 72.1 [hearing instrument supplement – healthy kids program] of this regulation for the following health care services for a dependent child of
a person who, when the service was provided, was receiving premium assistance:
(
a) a hearing instrument in accordance with sections 3 (1) (
b) and 3.11 of this
Schedule;
(
b) replacement of a hearing instrument in accordance with
section 3 (3) and (6)
of this Schedule;
(
c) repair of a hearing instrument in accordance with
section 3 (4) to (6) of
this Schedule.
Section 11 of
Schedule C is amended
(
a) in subsection (2) by adding “ or 77.03 ” after “
section 77.02 ”, and
(
b) in subsection (4) by adding “ or 7.1 ” after “
section 3.11 ”.
Appendix 2
Section 60.1 of the Employment and Assistance for Persons with Disabilities Regulation,
B.C. Reg. 265/2002, is amended
(
a) in subsection (1) by striking out “ a dependent child ” and substituting “ a person under 19 years of age ”, and
(
b) in subsection (2) (
a) by striking out “ children ” and substituting “ persons ”.

b) are amended by striking out “ a dependent child ” wherever it appears and substituting “ under 19 years of age ”.
