a) on December 31, 1995 the land described in Appendix A and shown on the sketch in Appendix B is separated from The County of Newell No. 4 and annexed to The Village of Rosemary,

b) any taxes owing to The County of Newell No. 4 on December 31, 1995 in respect of the annexed land are transferred to and become payable to The Village of Rosemary together with any lawful penalties and costs levied in respect to those taxes, and The Village of Rosemary upon collecting those taxes, penalties or costs shall pay them to The County of Newell No. 4, and

(

c) the assessor for The Village of Rosemary shall assess in 1995, for the purpose of taxation in 1996, the annexed land and the assessable improvements to it.

Section 235 of the School Act, and having considered that it will be necessary for The Board of Trustees of Peace Wapiti Regional Division No. 33 to amend By-law No. 95-02 dated February 9, 1995 made in accordance with

Section 235 of the School Act, and having considered that it may be necessary for The Board of Trustees of Northern Gateway Regional Division No. 10 to amend By-law No. 1-95 dated February 13, 1995 and By-law No. 2-95, dated February 13, 1995 made in accordance with Sections 208.3 and 208.4 of the School Act, I appoint August 15, 1995 as a time before which The Board ofTrustees of Northern Gateway Regional Division No. 10 may amend these by-laws.

5 Pursuant to

Section 212 of the School Act, and having considered that an adjustment of assets and liabilities is necessary, I direct that any school site or school building, together with any equipment therein, located in the lands transferred in accordance with this Order shall be in The Board of Trustees of Peace Wapiti Regional Division No. 33. These properties shall be included in the calculation for distribution of assets and liabilities provided in

Section 6.

6 I further direct that assets and liabilities The Board of Trustees of Northern Gateway Regional Division No. 10 be transferred to The Board of Trustees of Peace Wapiti Regional Division No. 33 in proportion that the number of resident students of The Board of Trustees of Northern Gateway Regional Division No. 10 transferred to The Board of Trustees of Peace Wapiti Regional Division No. 33 bears to the total number of resident students of The Board of Trustees of Northern Gateway Regional Division No. 10.
