Section 1 of the Oil and Natural Gas Act,

chapter O-2.1 of the Acts of New Brunswick, 1976, is amended 1 L’article 1 de la

chapitre O-2.1 des Lois du Nouveau-Brunswick de 1976, est modifié (

a) by repealing the definition “allowable”;

a) par l’abrogation de la définition « batterie »; (

b) by repealing the definition “battery”;

c) by repealing the definition “paying quantity”;

c) par l’abrogation de la définition « quantité ren- table »; (

d) in the definition “natural gas” by striking out “and includes hydrogen sulphide”.

Section 16.4 of the Act is amended 3 L’article 16.4 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

16.4(1) A well licensee shall, in the following circum- stances, apply to the Minister for an amendment to the well licence: 16.4(1) Le titulaire d’un permis de forage, doit deman- der au Ministre une modification à son permis pour l’une des raisons suivantes : (

a) the name of the well licensee will change;

b) the name of the well will change; or

Section 20 of the Act is amended 4 L’article 20 de la Loi est modifié (

a) by repealing subsection (1.01);

c) by repealing subsection (1.1);

d) by adding before subsection (2) the following:

Section 30.1 of the Act is repealed and the follow- ing is substituted: 6 L’article 30.1 de la Loi est abrogé et remplacé par ce qui suit : 30.1(1) At any time during the term of a lease, a lessee may apply, on a form provided by the Minister, for an extension of the term of the lease. 30.1(1) Le concessionnaire peut, à tout moment pen- dant la durée de son bail, en demander la prolongation au Ministre au moyen du formulaire que ce dernier fournit. 30.1(2) The lessee shall set out in the application the reasons for the extension. 30.1(2) Le concessionnaire doit, dans sa demande, donner les raisons qui la motivent. 30.1(3) If the Minister is satisfied that the circum- stances justify the extension, the Minister may extend the lease for the period of time the Minister considers necessary. 30.1(3) Si le Ministre est convaincu que les circons- tances le justifient, il peut accorder une prolongation pour le laps de temps qu’il estime nécessaire. 7

v) regulating and restricting any combination of subparagraphs (

i) to (iv); (

i) à (iv); (oo.7) prescribing the maximum quantity or concen- tration of chemicals, additives or proppants allowed to appear in the fluids used for hydraulic fracturing; oo.7) prescrivant les quantités maximales ou les concentrations maximales permises des produits chi- miques, des additifs ou des agents de soutènement dans les fluides de fracturation hydraulique; (oo.8) respecting the measures to be taken before the commencement of a hydraulic fracturing program, including, but not limited to: oo.8) concernant les mesures à prendre avant de procéder à l’exécution du programme de fracturation hydraulique, notamment : (

i) conducting an assessment of inter-wellbore communication; (

i) faire l’évaluation de la communication entre les trous de forage, (ii) conducting an assessment of the geological containment; (ii) faire l’évaluation du confinement géologique, (iii) pressure testing; (iii) faire les essais de pression, (iv) reporting to the Minister the type of fluid to be used for hydraulic fracturing; (iv) informer le Ministre du type de fluide qui se- ra utilisé pour la fracturation hydraulique, (

v) reporting to the Minister the volume of fluid to be used for each fracture stage; and (

v) informer le Ministre du volume du fluide qui sera utilisé pour chaque étape de fracturation, (vi) completing and submitting a prehydraulic fracturing checklist, on a form provided by the Minister, to the Minister; (vi) remplir la liste de contrôle préfracturation établie au moyen du formulaire fourni par le Mi- nistre et la lui remettre; (oo.9) respecting the measures to be taken and the methods of operation to be observed during a hy- draulic fracturing program, including, but not limited to, monitoring, testing and recording surface injection pressure, fluid rate, slurry rate, annulus pressures and chemical, additives or proppant concentration; oo.9) concernant les mesures à prendre et les modes opératoires à observer pendant l’exécution du pro- gramme de fracturation hydraulique, notamment le suivi, les essais et la consignation de la pression d’in- jection en surface, du débit de coulis, du taux de fluides, de toutes les pressions dans les espaces annu- laires et des concentrations des produits chimiques, des additifs ou des agents de soutènement; (oo.10) respecting the measures to be taken after the completion of a hydraulic fracturing program, includ- ing, but not limited to: oo.10) concernant les mesures à prendre après l’exécution du programme de fracturation hydrau- lique, notamment : (

i) reporting to the Minister the type of fluid used for hydraulic fracturing; and (

i) le rapport qui doit être fait au Ministre quant aux types de fluides de fracturation qui ont été uti- lisés;
