B.C. Reg. 161/2007, deposited June 1, 2007, pursuant to the MOTOR VEHICLE ACT [Sections 50 and 210]. Order in Council 346/2007, approved and ordered May 30, 2007.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective June 1, 2007, the regulations listed in the attached

schedule are amended as set out in that schedule.

Schedule

Emission Inspection Exemption Regulation

1 The Emission Inspection Exemption Regulation, B.C. Reg. 320/92, is amended in

section 3 by striking out everything after "or Z" and substituting "as set out in the Basic Insurance Tariff as filed by the Insurance Corporation of British Columbia with the British Columbia Utilities Commission".

Section 4 is amended by striking out everything after "territory H" and substituting "as set out in the Basic Insurance Tariff as filed by the Insurance Corporation of British Columbia with the British Columbia Utilities Commission".

Ferry Terminal Facilities Trailer Licensing and

Registration Exemption Regulation

3 The Ferry Terminal Facilities Trailer Licensing and Registration Exemption Regulation, B.C. Reg. 493/94, is amended in

section 1 (2) (

a) by striking out everything after "minimum" and substituting "third party liability insurance coverage required under the Insurance (Vehicle) Act ".

Motor Vehicle Act Regulations

4 The Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended in sections 3.11, 14.02 (

b) and 14.03 (

b) by striking out " Insurance (Motor Vehicle) Act " and substituting " Insurance (Vehicle) Act ".

Section 40.01 is amended

(

a) in subsection (1) by adding the following

definitions:

"replicar" means a motor vehicle manufactured to resemble a previously known make and constructed entirely of new components;

"replikit" means a motor vehicle designed to resemble a previously known make and constructed of new or refurbished components;

"specialty vehicle" means a vehicle

(

a) built using new components that may or may not have been manufactured by the assembler, and

(

b) unique in appearance;

"ubilt" means a vehicle that does not resemble the vehicle from which its components were taken and that

(

a) was built, and may have been built at home for personal use, by an individual,

(

b) is used as a private passenger motor vehicle or a commercial motor vehicle, and

(

c) has a gross vehicle weight of not more than 5 000 kg. .

and

(

b) by repealing subsection (3).
