B.C. Reg. 126/2007, deposited May 22, 2007, pursuant to the MOTOR VEHICLE ACT [Section 216]. Order in Council 274/2007, approved and ordered May 18, 2007.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended as set out in the Schedule.

Schedule

Section 40A.01 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended by repealing the

definitions of "authorized inspector" , "inspection area highway" , "inspection facility" and "operator" and substituting the following:

"inspection facility" means a facility designated by the director as an inspection facility under

section 217 of the Act;.

Section 40A.02 is amended by striking out "an inspection area highway" and substituting "a highway".

Section 40A.03 is amended

(

a) in subsection (1) by striking out "an inspection area highway" and substituting "a highway", and

(

b) by repealing subsection (3) and substituting the following:

(3) The peace officer must, on completion of the diesel emission inspection, complete an inspection report and give a copy of that report to the driver of the vehicle inspected.

4 Sections 40A.04 to 40A.06 are repealed.

Section 40A.07 is amended by striking out "section 40A.02, 40A.03 (5) (

a) or 40A.06 (3)" and substituting "section 40A.02 or 40A.03 (5) (a)".
