An Act to amend The Alberta Pharmaceutical Association Act (Assented to , 1970) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts a sfollows: :1. The Alberta Pharmaceutical Association Act is hereby amended.

Section 14, clause (

a) is amended by striking out the words "nine o'clock in the evening" and by substituting the words "12 o'clock noon".

Section 18 is amended by adding after subsection (2) the following subsection: (2a) The council may appoint a deputy registrar who need not be a member of the council, at such salary or other remuneration and for such term of office as the council may decide and who shall assist the registrar and in his absence has the powers and duties of the registrar.

Section 21c is amended by adding after subsection (1) the following subsection: (1a) The president, the vice-president and acting presi dent, the chairman and any member of an investigating committee may participate in or vote at any proceedings of the council under this

section and the registrar and the Association's solicitor may participate in those proceedings.

Section 21d is amended by striking out subsection (4) and by substituting the following subsections:

(4) The judge upon hearing the appeal may (

a) make any other finding that in his opinion ought to have been made, or (

b) quash or confirm the council's declaration that the matter of complaint was well founded, or

Explanatory Notes I. This Bill amends

chapter 232 of the Revised Statutes.

Section 14, clause (

a) presently reads: 14. The registrar of the Association (

a) shall open the baNot papers in the presence of at least two other membrs of the Association at the hour of nine o'clock in the evening of the day of election, and 3. Self-explanatory.

Section 21c deals with discipline proceedings before the Council of the Association. s.

Section 21d, subsection (4) presently reads:

(4) Upon hearing the appeal, the judge may make an order either confirming or reversing the order appealed from or directing a further inquiry by the council into the facts of the case, as he considers just.

(

c) confirm or vary the punishment imposed or order a different punishment, or (

d) confirm or vary any order of the council as to costs or make a new order as to costs, or (

e) refer the matter to the council for further con sideration by it.

(5) The judge shall make no award as to costs of the appeal.

Section 30 is amended by striking out subsections (3) to (7).

Section 31c, subsection (2) is amended by striking out the words "a licence fee not exceeding twenty-five dollars" and by substituting the words "the licence fee fixed by the council".

Section 31/ is amended by adding the following sub

section after subsection (2):

(3) A person who (

a) is registered under this Act, (

b) is employed by the operator or owner of a drug store, and (

c) ceases to be employed by that operator or owner shall within five days after such cessation, notify the registrar of the Association in writing of such cessation, to gether with the place of new employment, if any. 9. This Act comes into force on July 1, 1970. 2

Section 30 presently reads: 30.

(1) The council shall from time to time formulate rules and reg ultions not inconsistent with this Act with respect tOo the qualifications, training and discipline of pharmaceutical internes.

(2) The registrar of the A8'sociation shall maintain a register of pharmaceutical internes, which register shall contain rull details re quired by this Act and by the rules and regulations formulated from time to time by the council.

(3) Before any candida-te is entitled to be registered as a pharma ceutical interne he shall produce to the registrar of the Association satisfactory evidence (

a) that he has attained the age of sixteen years and is of good character, (

b) that he has such educational quaJifica-tions as the University of Alberta may from time to time require as the minimum standard for admission to the study of pharmacy at the Uni versity of Alberta, and (

c) that he has entered into an agreement with a registered pharma <leu tical chemist actively engaged in the practice of his profes sion, in such form a,s may be required by the rules and regula tions formulated from time to time by the council.

(4) A registered pharmaceutical chemist (

a) is only enUtled to an agreement with one pharmaceutical interne at a time, and (

b) shall not enter into an interne agreement with any person While any previous interne agreement to which he is a party is still in force and effect and binding upon him.

(5) A ,pharmaceuti<Jal interne shall not continue as such if (

a) he fails to enrol in the course in pharmacy at the University of Mberta or other accredited university within three years from the date of registratIon as a pharmaceutical interne, or (

b) he fails to aMain the degree of Bachelor of Science in Pharm acy at the University of Alberta or other accredited university within seven years from the date of registration as a pharma ceutical interne.

(6) Any person who fails tOo comply with this

section may apply to the council who may make such investigations of the circumstances as it may deem necessary and may (

a) order that -the name of the pharmaceutical interne be erased from the register, or (

b) order that the pharmaceutical interne be permitted to remain as a pharmaceuUcal interne upon such conditions as may be con sidered proper.

(7) A person who has faBed to comply with subsection (5) shall not be permitted to remain as a pharmaceutical interne except under authority of a resolution of the council. , ,All matters pertaining to pharmaceutical internes will be dealt WIth by the regulations of the Council of the Association
