APPENDIX C
ORDER
1 In this Order, 'annexed land' means the land described in Appendix A and shown
in Appendix B.
2 For taxation purposes in 2009 and subsequent years up to and including 2018, the
annexed land and assessable improvements to it
(
a) must be assessed by the Town of Carstairs on the same basis as if they had
remained in Mountain View County, and
(
b) must be taxed by the Town of Carstairs in respect of each assessment class
that applies to the annexed land and the assessable improvements to it using,
(
i) the municipal tax rate established by Mountain View County, or
(ii) the municipal tax rate established by the Town of Carstairs,
whichever is lower.
3(1) Where in any taxation year, up to and including 2018, a portion of the annexed
land
(
a) becomes a new parcel of land created as a result of subdivision or separation
of title by registered plan of subdivision or by instrument or any other
method that occurs at the request of, or on the behalf of the landowner,
except for the subdivision of an existing farmstead from a previously un-
subdivided quarter section,
(
b) becomes a residual portion of 16 hectares or less after a new parcel referred
to in clause (
a) has been created,
(
c) is redesignated at the request of or on behalf of the landowner under the
Town of Carstairs Land Use Bylaw to another designation,
(
d) is the subject of a local improvement project described in a local
improvement bylaw initiated by, or with the support of or on behalf of the
landowner pursuant to which the Town of Carstairs water and sewer
services are connected to the land, or
(
e) the portion is connected to the water or sanitary sewer services provided by
the Town of Carstairs,
section 2 ceases to apply at the end of that taxation year in respect of that portion of
the annexed land and the assessable improvements to it.
(2) Notwithstanding subsection 3(c),
section 2 continues to apply in respect of a
portion of the annexed land that is redesignated under the Town of Carstairs Land Use
Bylaw to the designation "Agricultural or Urban reserve".
4 After
section 2 ceases to apply to a portion of the annexed land in a taxation year,
that portion of the annexed land and the assessable improvements to it must be
assessed and taxed for the purposes of the property taxes in the following year in the
same manner as other property of the same assessment class in the Town of Carstairs
is assessed and taxed.
5 The Town of Carstairs shall pay to Mountain View County the sum of two
hundred and fifteen thousand dollars ($215,000.00) in Canadian dollars, as follows:
(
a) fifty thousand dollars ($50,000.00) is to be paid no later than thirty (30) days
after the date this Order in Council is made by the Lieutenant Governor in
Council;
(
b) one hundred and sixty-five thousand dollars ($165,000.00) is to be paid no
later than one (1) year after the date this Order in Council is made by the
Lieutenant Governor in Council.

Provincial Historic Resource under

The reasons for the designation are as follows: The heritage value of Calgary Fire
Hall No. 1 lies chiefly in its historical and architectural significance for its association
with the history of firefighting in Alberta, its connection to James "Cappy" Smart,
and its excellent representation of an early twentieth-century, urban fire station.
Built in 1911 to replace Calgary's first Fire Headquarters, which had been erected in
1887, Calgary Fire Hall No. 1 represented advances in fire-fighting characteristic of
the pre-war boom in Alberta. Emerging urban areas throughout the west had marked
their transition from early settlement communities to more densely populated towns
and cities by shifting from buildings constructed predominantly of wood to much
more fire retardant structures erected of brick and stone. In the cities, fire departments
were making the change from primarily volunteer bucket brigades to professionally
trained, paid, and mechanized forces. Important figures such as James "Cappy"
Smart, Calgary's first full-time fire chief, spanned the whole era of this historical
development. As such, Smart personally participated in the planning of Fire Hall No.
1, and led Calgary's fire fighters from their headquarters there until his retirement in
1933. The station was in continuous use as a fire hall until 1973.
Architecturally, Calgary's Fire Hall No. 1 embodies several elements desirable in
state-of-the-art urban fire halls of the period, and stands as one of the premier
examples of this building type in Alberta. Designed by architects Lang and Major, the
building was designed with a growing city in mind in terms of size and required
facilities. Significantly, the building is oriented diagonally towards the street corner,
enabling efficient access and ease of departure. Fire Hall No. 1 includes five wide
bay doors, and the necessary hose tower required to hang and dry the canvas hoses in
use throughout the early to mid-twentieth century. The large central garage area, built
with the ability to accommodate the horse-drawn fire carriages, was easily adapted to
house Calgary's first fire trucks. Additional spaces such as offices, bedrooms, and
lounges provided room to accommodate fire fighters in a state of readiness for their
tasks. With its highly identifiable facade, the building has become a well known city
landmark.
It is therefore considered that the preservation and protection of the resource is in the
public interest.

R.S.A. 2000 cH-9.
The reasons for the designation are as follows: The heritage value of the Bashaw Fire
Hall lies in its historical association with the provision of firefighting services and the
consolidation of other necessary municipal services in a multi-use civic building. The
structure is also characteristic of small town fire hall construction in Alberta.
The Town of Bashaw developed relatively late in Alberta's early twentieth century
settlement boom. Although settlers began arriving in the region during the 1890s, the
townsite itself did not develop until the arrival of the Grand Trunk Pacific Railway in
1910. Bashaw was incorporated as a village in 1911. With most buildings in new
communities constructed from wood, fire protection was of paramount importance for
most new communities. Communities that demonstrated an ability to offer fire
protection received discounted rates on insurance. The Bashaw Fire Hall was the first
public building authorized by the village council. Built between 1914 and 1915, it
was to serve the village's volunteer fire brigade, but has also served numerous other
purposes. It was used for many civic gatherings, such as public forums, meetings of
the village council, elections and tax-revision court sessions, well into the 1930s.
During the 1950s, a small library, maintained by the Women's Institute, was also
housed at the rear of the fire hall. The building also saw significant use as a police
station. Starting in the 1920s, the Alberta Provincial Police and/or the municipal
police had their detachment here. The Royal Canadian Mounted Police also used the
building from 1948 to 1968. The town's fire department remained in the building
until 1972. The Bashaw Fire Hall is an excellent example of the type of multi-use
civic buildings constructed by small communities throughout Alberta in the early
twentieth century.
The Bashaw Fire Hall is a fine example of a vernacular structure that was adapted to
meet the changing needs of a small community. In its modest size and simple wood-
frame construction, the building is typical of the kind of civic structures erected by
rural Alberta communities in the early twentieth century. Decorative elements like the
false front, red and white paint scheme, brackets and cornice, and diamond-shaped
window in the tower define the building's distinctive character and may reflect the
fire hall's civic importance as Bashaw's first public building. The numerous
alterations to the building speak to the fire hall's easy adaptability to changing
circumstances and needs. Its original identity as a fire hall is clearly evident in the
hose-drying tower and 37,000 gallon poured-in-place concrete water tank. The jail
cells on the main floor speak to its function as a police station and its versatile interior
configuration embodies its general civic use.
It is therefore considered that the preservation and protection of the resource is in the
public interest.

R.S.A. 2000 cH-9.
The reasons for the designation are as follows: The heritage value of the Battle River
Hospital building lies in its historical association with the Women's Missionary
Society and its role in the provision of medical services to the booming population in
rural, northern Alberta in the mid-twentieth century. The hospital building also has
architectural significance, being representative of the "cottage" hospitals that were an
essential part of rural medical service.
Following the First World War, Alberta's Peace Country became an attractive area
for settlement. This trend was enhanced during the 1930s as people migrated to
northern Alberta to escape drought conditions in the south. Seeing the need for a
hospital in the Battle River area, the Women's Missionary Society (WMS), a lay
organization affiliated with the United Church of Canada, raised funds and secured an
agreement with the provincial government to share healthcare costs in that region.
The WMS, formed in 1926, was committed to establishing hospitals in Western
Canada, on native reservations and in northern communities. The WMS would
operate these hospitals until the communities served grew large enough to support the
facilities themselves. In 1936, construction began on a hospital midway between the
communities of North Star and Notikewin. In August 1937, the eight-bed Battle River
Hospital opened. It had a few small wards, an operating room, a nursery and living
accommodations for three nurses. The hospital had running water and electricity,
which was provided by a gasoline-powered engine. The hospital grew over the
ensuing years. An x-ray machine was added in 1944 and a separate nurses' residence
was built in 1945 allowing the hospital's second floor to be converted into a nine-bed
maternity ward. The area's population continued to grow and the Battle River
Hospital soon became too small to effectively meet the region's medical needs. It was
replaced by a larger building in 1955, although it continued to be used as an auxiliary
hospital until 1959.
Designed by architect Gordon Wynn, the Battle River Hospital represents a particular
type of small rural hospital built in Alberta during the inter-war period. It is a one-
and-a-half storey, balloon frame building. Its key architectural details include a
jerkinhead roof with shed-roofed dormer windows on each slope and imitation half-
timbering in the gables inspired by the Tudor style. The exterior walls are buff-
coloured stucco with red-brown window frames, door frames, stairs and other trim,
replicating the buildings original colours. The first storey has a unique fenestration
pattern. The operating room, located on the northwest corner, has five windows
giving plenty of light with minimal glare. There is a replica of the late 1940s sign
over the front door with the words "BATTLE RIVER HOSPITAL W.M.S. United
Church of Canada." The building's interior features an overly wide hall and doorways
on the first floor, reflecting its role as a hospital. The hall and doorways on the second
floor are of regular dimensions, reflecting its original domestic purpose. Interior walls
are painted light green with white trim. Built to serve a sparsely populated but
growing rural region with limited financial means, the hospital is quite simple in
design. However, while the building's architecture is not outstanding or unique, it
does represent trends in non-governmental hospital construction in its period of
significance. Even though the Battle River Hospital was built for the sole purpose of
providing medical care and was not a converted residence, the residential look of the
building places it in the cottage hospital model. In this regard, the building is similar
to an extant facility at Beaverlodge, and three demolished buildings at Bentley,
Fairview and Morley.
It is therefore considered that the preservation and protection of the resource is in the
public interest.

The reasons for the designation are as follows: The heritage value of Bad Heart
Straw Church lies in its status as a pioneering Alberta example of the use of straw as a
construction material.
From its formation in the 1920s until the mid-1950s, the community of Bad Heart was
without a local church. Surrounded by marginal farmland and cut off from the more
heavily settled areas of the Grande Prairie, Bad Heart remained during these decades
a small settlement with few amenities. Local residents who wished to attend a church
service were compelled to travel to the Teepee Creek district. Father Francis Dales, a
Redemptorist priest stationed over 50 kilometres away at Sexsmith, was determined
to change that for Bad Heart's Roman Catholic community. A vigorous and highly
creative man, Fr. Dales was an experienced architect and beloved pastor. He
recognized that the people of Bad Heart possessed only modest resources and seized
upon straw bale construction as a practical, economical way to construct a church.
First a cement slab was lain down. Salvaged pipes with points welded on the tops
were inserted into the slab at three foot intervals. The bales of straw were then
pressed down onto the pipes and crowned with metal plates. To simplify the church's
design and ensure the stability of the walls and the truss roof, no window openings
were included on the sides of the building. Fr. Dales found ways to economize on all
aspects of the church's construction. All labour was entirely voluntary. Much of the
fabric of the church was or salvaged or donated: smashed 7-Up bottles were added to
the exterior stucco to provide texture and colour and many of the fixtures and
furnishings came from area churches. The Bad Heart Straw Church was completed in
1954 and stands as a remarkable example of ingenuity and civic spirit. It is also a
pioneering example of straw bale construction in the province and possibly the only
church so constructed in all of Canada.
It is therefore considered that the preservation and protection of the resource is in the
public interest.

RESCISSION OF PURCHASE OF MUTUAL FUND SECURITIES
(Securities Act)
Made as a rule by the Alberta Securities Commission on December 10, 2008 pursuant
to sections 223 and 224 of the Securities Act.
1. Rescission of purchase of mutual fund security -
(1) Every purchaser of a security of a mutual fund may, if the amount of the
purchase does not exceed the sum of $50,000, rescind the purchase.
(2) A purchaser may rescind a purchase under subsection (1) by sending written
notice of the rescission to the registered dealer from whom the purchase was
made within
(a) 48 hours from the time the purchaser received the confirmation for a
lump sum purchase, or
(b) 60 days from the day the purchaser received the confirmation for the
initial payment under a contractual plan.
(3) Subject to subsection (5), the amount the purchaser is entitled to recover on
exercise of the right to rescind under this rule shall not exceed the net asset
value of the securities purchased at the time the right to rescind is exercised.
(4) The right to rescind a purchase made under a contractual plan may be
exercised only with respect to payments scheduled to be made within the
time specified in subsection (2) for rescinding a purchase made under a
contractual plan.
(5) Every registered dealer from whom the purchase was made shall reimburse
the purchaser who has exercised the purchaser's right of rescission in
accordance with this rule for the amount of sales charges and fees relevant
to the investment of the purchaser in the mutual fund in respect of the shares
or units of which the notice of rescission was given.
2. Effective Date - This rule comes into force on December 31, 2008.

The Condominium Property Regulation requires a notice summarizing the terms and
conditions of the program and a notice of the approval of the program by the Minister
before the program is applied in respect of any property.
The programs protect against loss by a purchaser because a developer fails to
complete construction of the units or common property. Where a developer is covered
by a purchaser's protection program, the developer must provide a certificate to the
purchaser containing information specified in the Regulation about the program and
its effective dates and coverage.
The Purchaser's Protection Program requires sufficient money to be held in trust, or
alternatively provide an indemnity sufficient to complete that owner's unit and
portion of the common property which is related to the enjoyment of the unit - for
example, ensuring access to the unit.
The Minister of Service Alberta, Heather Klimchuk, approved the Purchaser's
Protection Program for Aviva Insurance Company of Canada on December 1, 2008.
