Chapter 1 of the Statutes of Nova Scotia 1994-95, the Environment Act - and - IN THE MATTER OF an Order issued pursuant to the provisions of the said Act to Twin Mountain Construction Limited a body corporate, located at or near Waterville, and Robie B. Carty of Woodville, in the County of Kings, Province of Nova Scotia MINISTERIAL ORDER I.

WHEREAS Robie B. Carty and Twin Mountain Construction Limited own, occupy, operate or are responsible for the operation of a plant, structure, facility, undertaking or thing, to wit: a sewage sludge composting facility which is located at or near Waterville, in the County of Kings, Province of Nova Scotia, hereafter called the "Site"; II. AND

WHEREAS the Minister of the Environment believes on reasonable and probable grounds that the persons named in this Ministerial Order have contravened the Environment Act, to wit; 158 A person who (

f) contravenes a term or condition of an approval, a certificate of variance or a certificate of qualification; is guilty of an offence. III. AND

WHEREAS the Minister is of the opinion that it is in the public interest to do all things and take all steps necessary to comply with the Environment Act or to repair any injury or damage, or to control, eliminate or manage an adverse effect; 365

Part II Regulations IT IS HEREBY ORDERED: That pursuant to subsection 125(1) of the Environment Act, the persons named in this Ministerial Order shall, at their own cost, comply with the terms and conditions, including compliance times, set forth in

Schedule "A" attached to and forming part of this Ministerial Order. AND TAKE NOTICE if the persons to whom this Ministerial Order is directed fail to comply with the Ministerial Order, or any part thereof, the Minister, pursuant to [sub]section 132(2) of the Environment Act, may take whatever action the Minister considers necessary to carry out the terms of the Ministerial Order and may recover any reasonable costs, expenses and charges incurred by the Minister pursuant to

Section 132 of the Environment Act. AND FURTHER TAKE NOTICE that the appeal provisions respecting the issuance of a Ministerial Order are more fully outlined in

Section 138 of the Environment Act, including a 30 day time period from the date of the issuance of the Ministerial Order to file an appeal. SCHEDULE "A" TERMS AND CONDITIONS 1. All sewage sludge and residual compost which exists on the site shall be removed and disposed of at a site approved by the Nova Scotia Department of the Environment. This shall be completed no later than June 30, 2000. 2.

a) A closure plan shall be submitted to the Nova Scotia Department of the Environment no later than June 30, 2000. The plan shall outline measures to be taken to rehabilitate the site including, but not limited to, soil and water sampling, and soil stabilization. This plan shall be reviewed and approved by the Nova Scotia Department of the Environment prior to implementation.

b) All work outlined in the closure plan shall be completed no later than 30 days following approval of the plan by the Nova Scotia Department of the Environment. Results of all sampling shall be forwarded to the Kentville Regional Office of the Nova Scotia Department of the Environment. 366

Following review of the results of sampling, any additional remedial work shall be completed as required by the Nova Scotia Department of the Environment in order to address any outstanding issues of non-compliance or exceedences of soil and/or water quality standards. The standard for soil remediation is the limits for Category A compost outlined in the Nova Scotia Composting Guidelines or existing background levels. The standard for groundwater remediation is the existing background levels for chemical elements in Column 2 of

Schedule 1 contained in the Nova Scotia Composting Guidelines. 4. The persons named in this Ministerial Order may submit a written request to the Nova Scotia Department of Environment for an extension of time, together with reasons for the extension and the Minister or the contact person may grant the request. 5. Reg. 99/2000 Made: June 1, 2000 Filed: June 5, 2000 Fish Buyers’ Licensing and Enforcement Regulations Order in Council 2000-286 made June 1, 2000 Regulations made by the Governor in Council pursuant to subsection 77(2) of the Fisheries and Coastal Resources Act The Governor in Council on the report and recommendation of the Minister of Fisheries and Aquaculture dated May 18, 2000, pursuant to subsection 77(2) of

Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, is pleased to repeal the Fish Buyers Regulations made by Order in Council 97-307 dated May 27, 1997, and make new regulations respecting fish buyers’ licensing and enforcement in the form set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on and after June 1, 2000.

Schedule “A” Regulations Respecting Fish Buyers’ Licensing and Enforcement made by the Governor in Council pursuant to

Section 77 of

Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act Citation 1 These regulations may be cited as the Fish Buyers’ Licensing and Enforcement Regulations.

Definitions 2 In these regulations (a) "Act" means the Fisheries and Coastal Resources Act; (b) "fish" includes shellfish, crustaceans and marine animals and parts, products or by-products of them; (c) "fish products" includes fishery resources or any products derived from fishery resources; (d) “licence holder” means a person who holds a valid buyers licence pursuant to the Act and these regulations; (e) “non-profit organization” means an organization, the income and assets of which are not available for the personal benefit of any proprietor, member or shareholder; (f) “retail outlet” means an establishment where goods and services are sold or offered to a purchaser for the purpose of consumption or use and not for resale, and includes a restaurant. 368

Part II Regulations Exemption 3 For the purposes of

Section 73 of the Act, the following persons are exempt from the requirement to hold a buyers licence: (

a) a person buying fish or fish products (

i) in amounts of less than 25 kg per calendar day for personal consumption and not for resale, (ii) for resale by a non-profit organization; (

b) a person buying fish or fish products from a licence holder; (

c) a person buying fish or fish products other than lobster, for the purpose of resale in a retail outlet owned by that person. Appointment of Registrar 4

(1) The Minister may appoint a Registrar and such other employees of the Department as are necessary for the purpose of these regulations.

(2) The Registrar shall establish and maintain a Registry containing the names of all licence holders.

(3) The Minister may issue general directions to the Registrar regarding the issuance, amendment, renewal, suspension, termination and conditions of a buyers licence. Licence application 5 An application for a buyers licence shall be made to the Minister on a form supplied by the Department and shall be accompanied by a non-refundable application fee of $200. 6 The Minister may, by notice in writing, require an applicant to (

a) submit a detailed business plan to the Minister in a form satisfactory to the Minister; (

b) provide additional information about the proposed buying activity; (

c) submit a letter of commitment to bond to the Minister in a form satisfactory to the Minister, guaranteeing all amounts payable by the applicant for the purchase of fish or fish products. 7 The Minister shall advise the applicant of the outcome of the application, in writing, within 21 days of receiving all information in relation to the application. 369

Part II Regulations Licence form and fees 8( 1 ) A buyers licence shall be in a form prescribed by the Minister.

(2) The Minister shall specify on a buyers licence the species of fish or fish products that the licence holder is authorized to purchase pursuant to the licence.

(3) An applicant shall pay the licence fee set out in

Schedule "A" for each species of fish or fish products specified in the buyers licence. Licence issue 9 The issuance of a buyers licence to a person does not imply or confer any future right or privilege for that person to be issued a buyers licence of the same type or any other type. Licence transfer 10

(1) Subject to subsection (2), a buyers licence is not assignable or transferable.

(2) Where the Minister is satisfied that a buyers licence is being transferred to a corporation in which the current licence holder owns the majority of voting shares, the Minister may transfer the buyers licence.

(3) If a majority of voting shares of a corporation that is a licence holder are transferred, its buyers licence ceases to be in force. Licence expiry 11 Unless otherwise specified in the buyers licence, a buyers licence expires on December 31 of the calendar year for which it is issued. Licence conditions 12

(1) A buyers licence may be issued upon such terms and conditions as the Minister directs, and in particular, but not restricting the generality of the foregoing, may specify conditions respecting any of the following matters: (

a) the locations at which fish or fish products are permitted to be purchased and subsequently sold; (

b) the species of fish or fish products permitted to be purchased; (

c) the ultimate use of the fish or fish products that have been purchased; (

d) the content of records that must be kept of activity carried out under the licence including, but not limited to, (

i) the amounts, values and prices paid per kilogram for all fish or fish products purchased, (ii) the species of fish or fish products purchased, (iii) the names and addresses of the fishers from whom the fish or fish products were purchased, 370

Part II Regulations (iv) the location of purchase, (

v) the location of sale, (vi) the date and time at which fish or fish products were purchased, (vii) the destination of the fish or fish products; (

e) the manner and form in which records must be kept; (

f) the person to whom records are to be submitted; (

g) the time period for which records are to be retained.

(2) Compliance with the Act and these regulations is a condition of every buyers licence. Request for additional information 13

(1) A licence holder shall, at the request of the Minister or an inspector appointed by the Minister under the Act, submit to the Minister or inspector information including, but not limited to, the content of records specified in clause 12(1)(d)

(2) A person processing, buying, selling, packaging or possessing fish or fish products who does not hold a buyers licence shall, at the request of the Minister or an inspector appointed by the Minister under the Act, submit to the Minister or inspector information including, but not limited to, the following matters: (

a) the owner or other source of the fish or fish products; (

b) the location where the fish or fish products were obtained; (

c) the date and time at which the fish or fish products were obtained; (

d) the destination of the fish or fish products. Amendment, renewal or cancellation at licence holder’s request 14

(1) A request by a licence holder to amend, renew or cancel a buyers licence shall be made to the Minister in writing in the form and manner determined by the Department.

(2) A request to amend a buyers licence shall be accompanied by a fee of $25. Termination, amendment or suspension pursuant to subsection 76(2) or (3) of the Act 15

(1) Where the Minister has reason to believe that termination, amendment or suspension of a buyers licence is justified under subsection 76(2) or (3) of the Act, the Minister may require a licence holder to show cause why their licence should not be terminated, amended or suspended.

(2) The Minister shall determine the practice and procedure to be followed where a licence holder is required pursuant to subsection (1) to show cause why their buyers licence should not be terminated, amended or suspended. 371

Part II Regulations Requirements of licence holders 16 For the purposes of clause 76(3)(ba) of the Act, every licence holder is required to (

a) comply with Federal and Provincial legislation and regulations; (

b) comply with the terms and conditions of their licence; and (

c) comply with the terms and conditions of any other licence issued to the licence holder pursuant to the Act or regulations under the Act. Designated buyers 17

(1) For the purposes of this

Section and

Section 18, “designated buyer” means a buyer designated pursuant to subsection (2).

(2) A licence holder may, by notice in writing to the Minister, appoint one or more persons as designated buyers to engage in any activity authorized by their buyer's licence.

(3) A licence holder shall submit to the Minister the name, mailing address, telephone number and the proposed buying activity of each designated buyer.

(4) All activities requiring a buyers licence that are performed by a designated buyer shall be performed as agent and in the name of the licence holder.

(5) A licence holder shall provide each designated buyer with a certified copy of their buyers licence.

(6) A request for a certified copy of a buyers licence shall be made in writing to the Minister, and accompanied by a fee of $25 per copy. Carry and produce licence 18 Every licence holder or designated buyer shall carry the buyers licence or certified copy of it at all times while engaged in any activity to which it relates, and shall produce it on the demand of an inspector, an employee of the Department or a peace officer. Offences 19

(1) Every person is guilty of an offence who (

a) processes, buys, sells, packages or possesses fish or fish products that have been illegally caught, cultured, raised, harvested or processed; (

b) buys fish or fish products caught by a person who does not hold a valid commercial fishing licence issued by Fisheries and Oceans Canada; (

c) buys fish or fish products caught pursuant to an aboriginal communal fishing licence issued for food, social and ceremonial purposes pursuant to the Aboriginal Communal Fishing Licences Regulations made under the Fisheries Act (Canada); 372

d) sells fish or fish products to a person who is not a licence holder, unless that person is exempt pursuant to

Section 3; (

e) obstructs, impedes, or refuses to admit an inspector or any other person acting in the execution of the Act and these regulations, or aids or assists any person in obstructing, impeding or refusing to admit such an inspector or other person.

(2) For the purpose of clause (1)(a), “illegally” means (

a) without an appropriate licence issued either by Fisheries and Oceans Canada or the Department or without the appropriate authorization from the Canadian Food Inspection Agency; or (

b) in contravention of federal or Provincial legislation or regulations, including but not limited to legislation and regulations relating to size, season and quota.

Section 102 of the Environment Act The Governor in Council on the report and recommendation of the Minister of the Environment dated May 11, 2000, pursuant to

Section 102 of

Chapter 1 of the Acts of 1994-95, the Environment Act, is pleased to amend the Solid Waste-Resource Management Regulations, made by Order in Council 96-79 dated February 6, 1996, in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation.

Schedule "A" Amendments to the Solid Waste-Resource Management Regulations made by the Governor in Council pursuant to

Section 102 of

Chapter 1 of the Acts of 1994-95, the Environment Act 1 (1) Subsection 15(1) of the Solid Waste-Resource Management Regulations made by the Governor in Council by Order in Council 96-79 dated February 6, 1996, is repealed and the following subsection substituted:

(1) The minimum cash deposit on a redeemable beverage container is (

a) for a refillable or non-refillable beverage container other than a beverage container for liquor, an amount that, when added to any applicable federal and Provincial sales tax on that amount, equals $0.10; (

b) for a refillable liquor container of less than 1.0 L, an amount that, when added to any applicable federal and Provincial sales tax on that amount, equals $0.10; (

c) for a refillable liquor container greater than or equal to 1.0 L, an amount that, when added to any applicable federal and Provincial sales tax on that amount, equals $0.20 cents; (

d) for a non-refillable liquor container less than or equal to 500 ml, an amount that, when added to any applicable federal and Provincial sales tax on that amount, equals $0.10; (

e) for a non-refillable liquor container greater than 500 ml, an amount that, when added to any applicable federal and Provincial sales tax on that amount, equals $0.20. 375

Part II Regulations (2) Subsections 15(3) and (4) of the regulations are repealed and the following subsections substituted:

(3) Upon receipt of a beverage container, a depot operator shall immediately provide a minimum cash refund of, (

a) for a refillable beverage container, an amount, including the applicable federal and Provincial sales tax, that equals 100% of the full cash deposit; (

b) for a non-refillable beverage container, an amount, including federal and Provincial sales tax, that equals 50% of the full cash deposit.

(4) Where the amount of the cash deposit or cash refund is more than the minimum amount prescribed in subsection (1) or (3), the cash deposit or the cash refund shall be inclusive of any applicable federal and Provincial sales tax. 2 Subsection 16(5) of the regulations is repealed and the following subsections substituted:

(5) On or before the 20 th day of each month, a distributor shall file with the Board a return, in a form approved by the Board, reporting (

a) all units sold during the immediately preceding calendar month; and (

b) the remittance due by the distributor by type and tax status of beverage container as described in subsection (5B), and shall remit to the Board any cash deposits collected pursuant to these regulations during that immediately preceding calendar month. (5A) Despite subsection (5), at the request of the Board, a distributor shall file with the Board a return covering such period as the Board may determine, in a form approved by the Board, reporting (

a) all units sold; and (

b) the remittance due by the distributor by type and tax status of beverage container, as described in subsection (5B), and shall remit to the Board any cash deposits collected pursuant to these regulations during that period. (5B) Where reporting the tax status of beverage containers in a return required pursuant to subsection (5) or (5A), the distributor shall list taxable units sold and zero-rated units sold, as defined in the Excise Tax Act (Canada). 3

Reg. 101/2000 Made: June 1, 2000 Filed: June 5, 2000 Human Rights Commission Delegation of Powers Regulations Order in Council 2000-288 made June 1, 2000 Regulations made by the Governor in Council pursuant to subsection 42(2) of the Human Rights Act The Governor in Council on the report and recommendation of the Minister responsible for the administration of the Human Rights Act dated May 15, 2000, pursuant to subsection 42(2) of

Chapter 214 of the Revised Statutes, 1989, the Human Rights Act, is pleased to make regulations respecting the delegation of powers by the Human Rights Commission in the form set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on, from and after June 1, 2000.

SCHEDULE “A” Regulations Respecting the Delegation of Powers by the Human Rights Commission made by the Governor in Council pursuant to [sub]section 42(2) of

Chapter 214 of the Revised Statutes of Nova Scotia, 1989, the Human Rights Act Citation 1 These regulations may be cited as the Human Rights Commission Delegation of Powers Regulations.

Interpretation 2 In these regulations, (a) “Act” means the Human Rights Act; (b) “Commission” means the Nova Scotia Human Rights Commission established pursuant to the Act; (c) “Executive Director” means the Director of Human Rights appointed pursuant to subsection 26(1) of the Act; (d) “Ombudsman” means the Ombudsman appointed pursuant to subsection 3(2) of the Ombudsman Act; (e) “private organization” means a human rights agency or commission that is established other than by legislation and that the Commission considers to be qualified to conduct human rights investigations; 377

Part II Regulations (f) “statutory human rights agency” means a human rights agency or commission that is established under legislation of the Government of Canada or a province of Canada.

Delegation of powers 3( 1 ) The Commission, may, by written agreement entered into with the Ombudsman, another statutory human rights agency or a private organization, delegate to the Ombudsman, other statutory human rights agency or private organization the authority to exercise or perform some or all of the Commission’s powers, duties and functions under the Act including endeavouring to effect a settlement, investigating and appointing boards of inquiry in relation to a complaint where in the opinion of the Commission, the Commission would be subject to a reasonable apprehension of bias or conflict of interest if it were to investigate the complaint. 378

Section 3 of the Alternative Penalty Act The Governor in Council on the report and recommendation of the Minister of Justice dated May 3, 2000, pursuant to

Section 3 of

Chapter 2 of the Acts of 1989, the Alternative Penalty Act, and

Section 736 of

Chapter C-46 of the Revised Statutes of Canada, 1985, the Criminal Code, is pleased, to: (

a) repeal Order in Council 90-183 dated February 13, 1990; and (

b) approve the Fine Option Program in the form set out in

Schedule "A" attached to and forming part of the report and recommendation effective on, from and after June 1, 2000.

Definitions 1 For the purposes of the Program, (a) "Community Corrections Office" means the office administered by Correctional Services that is responsible for matters pertaining to the supervision of offenders in the community; (b) "Correctional Services" means the Correctional Services Division of the Department of Justice; (c) "employed" means engaged in regularly scheduled weekly activity in exchange for financial compensation or as a student registered in an accredited education program on a full time basis; (d) "fine" means a monetary penalty imposed by a judge of the Provincial Court on an offender in respect of an offence; (e) "Fine Option Program" means the Fine Option Program established pursuant to

Section 2; (f) "fine option work" means an activity that (

i) is normally performed by volunteers without financial compensation, 379

Part II Regulations (ii) does not affect employment opportunities in the community, and (iii) benefits a not-for-profit organization, Crown Corporation, department or other agency of the Government of Canada or the Province, municipality or Indian band within the meaning of the Indian Act (Canada), but does not include participation by the offender in a treatment or counselling program; (g) "offence" means an offence under any (

i) federal enactment except the Young Offenders Act (Canada) and any offence relating to the operation or parking of a motor vehicle, or (ii) Provincial enactment except the Young Persons

Summary Proceedings Act, any municipal by-law, and any offence relating to the operation or parking of a motor vehicle under the Motor Vehicle Act; (h) "offender" means an adult person other than a company, corporation, society or association convicted and fined in respect of an offence; (i) "outstanding balance of a fine" means the balance of a fine owing after payment of the court costs and victim surcharge portion of the fine by the offender; (j) "Program" means the Fine Option Program; (k) "work placement" means a not-for-profit organization, municipality, Council of a band within the meaning of the Indian Act (Canada), Crown Corporation, or department or agency of the Government of Canada or the Province that provides supervised fine option work; (l) "Work Resource Centre" means an organization or agency contracted by the Province to develop and maintain a supply of work placements adequate for the purposes of the Fine Option Program; (m) "Work Resource Centre Supervisor" means a person employed by a Work Resource Centre to (

i) match offenders with work placements, and (ii) monitor offenders’ compliance with the requirements of the Fine Option Program. 380

Part II Regulations Operating principles of Program 2 A Fine Option Program is hereby established for the purposes of permitting an offender to discharge the outstanding balance of a fine by earning credits for fine option work performed in accordance with the requirements of the Program. 3 All fine option work shall be performed at work placements approved by Correctional Services. 4 Despite the tools, equipment and skills used to perform fine option work, all fine option work shall be of equal value. 5 All fine option work that is performed to discharge the outstanding balance of a fine shall be performed during a period not exceeding 2 years and commencing on the date the offender contacts the Community Corrections Office in accordance with subsection 10(1). 6 An offender shall pay the victim surcharge and court costs portion of the fine in full prior to registration with the Fine Option Program. 7( 1 ) The number of hours of fine option work required to discharge the outstanding balance of a fine shall be determined by dividing the amount of the outstanding balance of the fine by the hourly Provincial minimum wage.

(2) An amount equivalent to the hourly Provincial minimum wage shall be credited to the outstanding balance of an offender’s fine for each hour of fine option work performed by the offender. 8 All requirements of the Fine Option Program shall be complied with and satisfactorily completed by the offender. 9 Where a judge of the Provincial Court imposes a fine on an offender in respect of an offence, the judge shall (

a) advise the offender of the payment due date for the fine and the Fine Option Program; and (

b) instruct the Clerk of the Court to (

i) issue a Fine Order indicating the total amount of the fine, the amount of the victim surcharge, the amount of the court costs and the payment due date, and (ii) provide the offender with information outlining the Program. Registration with Program 10

(1) An offender shall register with the Fine Option Program by contacting the Community Corrections Office prior to the date the fine becomes past due and providing all information required by the Community Corrections Office for registration with the Program. 381

(2) An offender shall meet with a representative of the Community Corrections Office prior to being assigned a work placement and, by signing a completed fine option registration, shall agree to (

a) personally perform the fine option work at the work placement identified and assigned to the offender by the Work Resource Centre Supervisor; (

b) ensure that the quality of the performance of the fine option work, punctuality and attendance at the identified work placement assigned to the offender are equivalent to the standard expected of a paid employee; (

c) be responsible for the offender’s meals, accommodation and transportation during the period of the fine option work at the work placement assigned to the offender; (

d) obey all lawful instructions of the Work Resource Centre Supervisor and the work placement while enrolled in the Program; (

e) while unemployed, be available to perform fine option work at least 35 hours per week; and (

f) while otherwise employed, be available to perform fine option work at least 10 hours per week unless otherwise approved by the Community Corrections Office.

(3) A representative of the Community Corrections Office shall advise an offender at the meeting referred to in subsection (2) that any misconduct, disregard for the work placement or other form of non-compliance by the offender with the requirements of the Fine Option Program shall result in removal from the Program.

(4) The Community Corrections Office shall immediately notify the Clerk of the Court in writing of an offender’s registration with the Fine Option Program. 11 An offender shall register with the Fine Option Program only once for each offence. Placement and supervision 12

(1) A Work Resource Centre Supervisor shall determine the placement of an offender at a specific work placement and contact the offender to arrange an initial appointment for the offender with the Work Resource Centre Supervisor and work placement.

(2) During the initial appointment arranged pursuant to subsection (1), the Work Resource Centre Supervisor shall 382

a) review the rules and regulations of the Work Resource Centre and the work placement with the offender; (

b) determine the type and hours of fine option work to be performed and the method of recording credits for the performance of the work; and (

c) establish a work

schedule for the offender.

(3) The Work Resource Centre Supervisor shall maintain, at a minimum, weekly contact with the work placement and the offender to ensure compliance with the requirements of the Fine Option Program.

(4) The Community Corrections Office shall maintain, at a minimum, weekly contact with the Work Resource Centre Supervisor and monthly contact with the offender to ensure the offender’s compliance with the requirements of the Fine Option Program. Non-compliance with Program 13 Where an offender fails to report for the initial appointment with the work placement and subsequently fails to contact the Community Corrections Office within 3 working days following the initial appointment, the Community Corrections Office may terminate the offender’s participation in the Fine Option Program. 14

(1) Where an offender fails to comply with the requirements of the Fine Option Program, the work placement may refuse the offender entry to the work placement.

(2) Where an offender is refused entry to the work placement pursuant to subsection (1), the work placement shall immediately notify the Work Resource Centre Supervisor of the refusal.

(3) Where a Work Resource Centre Supervisor has been notified of a refusal of entry to a work placement pursuant to subsection (2), the Work Resource Centre Supervisor shall immediately notify the Community Corrections Office of the refusal. 15

(1) Where an offender is refused entry to a work placement pursuant to subsection 14(1), the Community Corrections Office may, where it considers it appropriate, investigate alternate work placements.

(2) Where the Community Corrections Office determines that it is not appropriate to assign an offender to an alternative work placement, the Community Corrections Office shall terminate the offender’s involvement in the Fine Option Program and immediately notify the Clerk of the Court of the termination and provide supporting documentation, including a statement indicating the amount of the fine discharged through participation in the Program and the amount of the fine remaining outstanding. 383

(1) Where an offender does not complete the requirements of the Fine Option Program, the Work Resource Centre Supervisor shall immediately provide the Community Corrections Office with a written recommendation that the offender be removed from the Program for non-compliance with the requirements of the Program and a Work Performance Sheet indicating the number of hours of fine option work completed.

(2) Where the Community Corrections Office receives a written recommendation pursuant to subsection (1), the Community Corrections Office shall terminate the offender’s involvement in the Fine Option Program and immediately notify the Clerk of the Court of the termination and provide supporting documentation including a statement indicating the amount of the fine discharged through participation in the Fine Option Program and the amount of the fine remaining outstanding. Completion of Program 17

(1) Where an offender completes the requirements of the Fine Option Program, the Work Resource Centre Supervisor shall advise the Community Corrections Office that the offender has completed the fine option work required to discharge the outstanding balance of the offender’s fine, and complete and forward a Work Performance Sheet indicating the number of hours of fine option work completed to the Community Corrections Office.

(2) Where a Community Corrections Office receives a Work Performance Sheet pursuant to subsection (1), the Community Corrections Office shall advise the Clerk of the Court of the offender’s completion of all requirements of the Fine Option Program and verify the amount of the outstanding balance of the fine discharged through participation in the Fine Option Program. 384

Definitions 2( 1 ) In these regulations (a) "Act" means the Apprenticeship and Trades Qualifications Act; (b) "engaged" means employed or hired for remuneration; (c) "General Regulations" means regulations made by the Governor in Council under the authority of the Act that apply generally to all designated trades; (d) "journeyperson” means a person who has acquired the knowledge and skills in the trade as attested to by a provincial or territorial authority; (e) "lather (interior systems mechanic) trade” or “trade” means the work performed in the construction, repair or alteration of a building or part of a building and includes (

i) preparing wall and ceiling layouts, (ii) installing metal framing support for walls and ceilings, (iii) installing drywall, 386

v) finishing walls and ceilings, taping and filling, (vi) installing and applying insulation and vapour sealants, (vii) installing acoustical and thermal sealants, (viii) applying lath for plaster, (ix) installing raised access floors, (

x) installing exterior wall panels, (xi) erecting demountable partitions systems, (xii) fire proofing.

(2) Unless the context otherwise requires, words defined in the Act or General Regulations have the same meaning when used in these regulations. Contract of apprenticeship 3 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed (

a) is 16 years of age or older; (

b) has successfully completed grade 12 or its equivalent in the course skills required by the trade; and (

c) is in good physical condition as evidenced by a medical certificate issued by a duly qualified medical practitioner entitled to practice medicine in the Province. Ratio of apprentices to journeypersons 4( 1 ) Subject to subsection (2), an employer in the trade may employ 1 apprentice in the trade for each journeyperson who is employed by the employer.

(2) The ratio of apprentices to journeypersons employed by an employer in the trade may be varied with the prior written approval of the Director, where the Director has determined that the variation is required because of the employment situation and the availability of certified journeypersons in the trade. Terms of apprenticeship 5 The term of apprenticeship for the trade is 6000 hours (3 years) of technical and practical experience and shall include a maximum probationary period of 6 months. Wage

schedule 6( 1 ) The wage of an apprentice shall be no less than is prescribed in the following wage

schedule and shall include the increase to which the apprentice is entitled upon successful completion (both the technical and practical, as required) of each 6 month period: during the first 6 months at 50% of the journeyperson’s rate; during the second 6 months at 60% of the journeyperson’s rate; 387

Part II Regulations during the third 6 months at 65% of the journeyperson’s rate; during the fourth 6 months at 70% of the journeyperson’s rate; during the fifth 6 months at 80% of the journeyperson’s rate; during the sixth 6 months at 90% of the journeyperson’s rate.

(2) Where the term “6 months” is used in subsection (1), it means the period required to satisfactorily complete 1000 hours (6 months) of apprenticeship training. Examination for persons employed 7 A person other than a registered apprentice who (

a) satisfies the requirements of clauses 19(1)(

b) and (

c) of the General Regulations; and (

b) produces evidence to prove 5 years or 10 000 hours of practical experience engaged in the trade or 4 years or 8000 hours of practical experience including successful completion of a technical training course in the trade, approved by the Director, is eligible to be examined for a journeyperson’s certificate of qualification in the trade. 388

i) the handling or distribution of insulating materials on job premises, (ii) the operation of equipment and tools necessary for the trade, (iii) the application of pipe and boiler coverings, (iv) the insulation of hot and cold surfaces, ducts, flues, etc., 389

b) shall set out any restrictions or conditions to be placed on the licence; and (

c) shall not be renewable.

(3) A person issued a temporary licence pursuant to subsection (1) shall not hold membership in the Association. 394

Section 90: 90A

(1) There will be a Transition Support Program in effect from April 1, 2000, to March 31, 2002.

(2) An employee who receives a layoff notice dated between April 1, 2000, and March 31, 2002, both dates inclusive, issued in the course of government restructuring shall be eligible to elect to participate in the Transition Support Program within 5 days of the receipt of the layoff notice.

(3) Despite subsection (2), a person deemed to be laid off pursuant to

Section 16 of the regulations respecting disability income protection approved by Order in Council 85-1054 dated September 26, 1985, shall not be eligible to elect to participate in the Transition Support Program. 396

(4) An employee who elects to participate in the Transition Support Program shall no longer be entitled to receive a Public Service Award pursuant to

Section 84 and shall specifically release any such right.

(5) Upon election to participate in the Transition Support Program, an employee shall resign from the civil service.

(6) An employee whose resignation pursuant to subsection (5) is accepted shall be entitled to Transition Support Program benefits during the severance payment period.

(7) The severance payment period shall be equivalent to 4 weeks per each full year of service and pro-rated on the basis of months of service for a partial year, but in no case shall the severance payment period be greater than 52 weeks nor less than 8 weeks.

(8) During the severance payment period, Transition Support Program benefits shall include (

a) the severance allowance payable pursuant to subsection 90(7) plus an additional amount of severance equal to the remainder of the severance payment period; (

b) appropriate re-training and Employee Assistance Program services, as determined by the Department; and (

c) continued group life and health insurance benefits, in accordance with the Province of Nova Scotia Civil Service Group Life and Consolidated Group Health Plans.

(9) The sum payable pursuant to subsection (8) shall be based on the regular rate of pay applicable on the effective date of resignation.

(10) The sum payable pursuant to subsection (8) may be paid in either a lump sum or bi-weekly payments at the election of the individual.

(11) No person shall be re-employed as a civil servant or member of a Government bargaining unit during the severance payment period.

(12) Despite subsection (11), a person may be re-employed as a civil servant or member of a Government bargaining unit during the severance payment period if the portion of severance allowance that corresponds to the unexpired portion of the severance payment period is either withheld or recovered by the employer. 397

Schedule "A" Amendments to the Criminal Injuries Compensation Regulations made by the Governor in Council pursuant to

Section 2 of the Criminal Injuries Compensation Regulations made by the Governor in Council by Order in Council 94-119 dated February 15, 1994, is amended by (

a) striking out “Section 11A(1) of the Act shall be made in Form 1 of these regulations or any other form as may be” in subsection (1) and substituting “subsection 11A(1) of the Act shall be in a form”; (

b) striking out “Form 2 of these regulations or any other form as may be” in subsection (2) and substituting “a form”; and (

c) adding the following subsection immediately after subsection (3):

(4) An application for compensation is deemed to be filed on the date the completed application is received in the office of the Criminal Injuries Compensation Program. 398

Section 4 of the regulations is amended by adding "including but not limited to statements and Confidential Instructions for Crown," immediately after "which is the subject of an application to the Director,". 3

(1) Section 5 of the regulations is amended by repealing subsection (1) and substituting the following subsection:

(1) Compensation may be awarded by the Director as follows: (

a) individual counselling - by a counsellor approved by the Director; (

b) group counselling - as approved by the Director, when recommended by an approved counsellor as a component of the approved counsellor's treatment plan, to a maximum of $65.00 per hour to a maximum of $2000.00 over a maximum period of 2 years from the date of award;

(2) Section 5 of the regulations is further amended by (

a) striking out "Section": in subsection (2) and substituting "subsection"; and (

b) adding the following subsection immediately after subsection (3):

(4) Where an applicant is in actual financial need and it appears to the Director that the Director will probably award compensation to the applicant, the Director may direct that interim payments be made in respect of counselling and, if compensation is not awarded, the amount so paid shall not, in the absence of fraud or misrepresentation, be recoverable from the applicant or counsellor. 4 The regulations are further amended by adding the following

Section 5: 5A An applicant for compensation may appeal a decision of the Director to the person or tribunal hearing the appeal on any question as to law or the jurisdiction of the Director but no other question. 5 Subsection 6(2) of the regulations is amended by striking out “in Form 3 of these regulations” and substituting “, in a form prescribed by the Director,”. 6 The regulations are further amended by repealing

Section 9 and substituting the following Section: 9 These regulations apply to any application made pursuant to

Section 11A of the Victims' Rights and Services Act on and after the date the Financial Measures
