Oil and Gas Conservation Act

OIL AND GAS CONSERVATION AMENDMENT REGULATION

Filed: February 3, 1998

Made by the Alberta Energy and Utilities Board pursuant to

section 10 of

the Oil and Gas Conservation Act.

1 The Oil and Gas Conservation Regulations (AR 151/71) are amended by

this Regulation.

Section 7.070(4) is repealed and the following is substituted:

(4) Gas burned or disposed of by a method approved under subsection

(3) shall be burned or disposed of so as to ensure that the concentrations

of hydrogen sulphide and sulphur dioxide do not exceed

(

a) the maximum permissible concentrations set out in

the Alberta Ambient Air Quality Guidelines as established and amended from

time to time by the Minister of Environmental Protection,

(

b) standards to which the battery is subject under the

Environmental Protection and Enhancement Act, and

(

c) standards specified by the Board.

Section 8.051(

a) is amended by striking out "Department of the

Environment" and substituting "Department of Environmental Protection".

Section 8.052 is amended

(

a) in subsection (4) by striking out ", the Department of the

Environment and the Department of Forestry, Lands and Wildlife" and

substituting "and the Department of Environmental Protection";

(

b) in subsection (7)(

f) by striking out "Department of Forestry,

Lands and Wildlife" and substituting "Department of Environmental

Protection".

5 Sections 9.030 and 9.040 are repealed and the following is substituted:

9.030(1) No person shall commence construction related to a new

scheme or a major modification to an existing scheme for the processing of

gas until the Board has approved the location, conservation levels and

pollution control features of the scheme.

(2) No person shall commence processing operations related to a new

scheme or a major modification to an existing scheme for the processing of

gas until the Board has approved the scheme.

9.040 The operator of a processing plant shall conduct operations

so as to ensure that the concentrations of any air contaminant do not

exceed

(

a) the maximum permissible concentrations set out in

the Alberta Ambient Air Quality Guidelines as established and amended from

time to time by the Minister of Environmental Protection,

(

b) standards to which the plant is subject under the

Environmental Protection and Enhancement Act, and

(

c) standards specified by the Board.

Section 9.050(1), (3), (4), (6) and (8) are amended by striking out

"Department of the Environment" wherever it occurs and substituting

"Department of Environmental Protection".

Section 9.060 is amended by striking out "Department of the

Environment" and substituting "Department of Environmental Protection".

Section 14.010(

c) is amended by striking out "and Natural Resources".

Section 16.040(

c) is amended by striking out "20 000 metres" and

substituting "20 000 cubic metres".

Definition

1 In the Act and this Regulation,

(a) "Act" means the Personal Directives Act;

(b) "health care practitioner" means a person, regulated by a

professional Act, who provides health care to any person;

(c) "husband" includes a common law husband;

(d) "physician" means a registered practitioner under the Medical

Profession Act;

(e) "professional Act" means

an Act that regulates a health care

profession;

(f) "psychologist" means a chartered psychologist under the

Psychology Profession Act;

(g) "spouse" includes a common law spouse;

(h) "wife" includes a common law wife.

Designation by name of office or position

2(1) For the purposes of

section 7(3) of the Act, persons who are service

providers to a maker may not be designated by the maker as agents by office

or position.

(2) Persons referred to in subsection (1) may only be designated as agents

by their name.

Persons to contact

3(1) For the purposes of sections 19(2) and 24(2) of the Act, if no

nearest relative can be contacted, then every reasonable effort must be

made to contact the maker's legal representative.

(2) If none of the maker's legal representatives can be contacted, the

Public Guardian must be contacted.

Service of originating notice

4 For the purposes of

section 26(1) of the Act, the originating notice

must be served on the following persons:

(

a) the maker's legal representatives;

(

b) the maker's nearest relative.

Forms

5 The forms for the purposes of

section 9 of the Act are set out in the

Schedule.

Expiry

6 For the purpose of ensuring that this Regulation is reviewed for ongoing

relevancy and necessity, with the option that it may be repassed in its

present or an amended form following a review, this Regulation expires on

June 30, 2002.

Repeal

7 The Personal Directives Regulation (AR 225/97) is repealed.

1 The

definitions in

section 1 of

Schedule 13 of the Government

Organization Act apply to this Regulation.

Restriction

2(1) If a person owes the Government money in respect of registry services

that have been provided, Alberta Registries may notify all registry agents

and statutory officers who provide registry services that

(

a) the person owes the Government an amount of money specified in

the notice, and

(

b) no registry services, other than those specified by Alberta

Registries, are to be provided to the person until the amounts referred to

section 4 have been received in accordance with that section.

(2) A registry agent or statutory officer who receives a notice under

subsection (1) must comply with it.

Notice

3 If Alberta Registries restricts a person's ability to obtain registry

services under

section 2, Alberta Registries must send a notice by regular

mail to the last known address of the person in the records of Alberta

Registries setting out

(

a) that the person will no longer receive some or all registry

services, as specified in the notice, because the person owes money to the

Government with respect to the payment of fees for registry services, and

(

b) that the provision of registry services will not be restored

until the amounts referred to in

section 4 have been received in accordance

with that section.

Payment

4 Before restoring the provision of registry services to a person

specified in a notice under

section 2,

(

a) the Government must receive in cash or by certified cheque or

money order the amount owing to the Government plus a government

administration fee of $25, and

(

b) if payment is made to a registry agent, the registry agent must

receive the agent's service charge as established by or under an enactment.

Restoring provision of registry services

5(1) If the amounts referred to in

section 4 in respect of a person

specified in a notice under

section 2 have been received in accordance with

section 4 or if Alberta Registries determines that the person's ability to

obtain registry services has been restricted in error, Alberta Registries

must direct all registry agents and statutory officers who provide registry

services to restore the provision of registry services to the person.

(2) A registry agent or statutory officer who receives a direction under

subsection (1) must comply with it.

Cancellation of motor vehicle registration

6(1) If the Government is owed money in respect of a certificate of

vehicle registration issued under the Motor Vehicle Administration Act, the

Registrar of Motor Vehicle Services may cancel the certificate.

(2) If the Registrar of Motor Vehicle Services cancels a certificate of

vehicle registration, the Registrar must send a notice by single registered

mail to the person in whose name the certificate was issued setting out

(

a) that the certificate has been cancelled, and

(

b) that a new certificate of registration for any motor vehicle

will not be issued to the person until the amounts referred to in

subsection (3) have been received in accordance with that subsection.

(3) The person whose certificate of vehicle registration was cancelled may

not be issued a certificate of registration under the Motor Vehicle

Administration Act for any motor vehicle unless

(

a) the Government receives payment for the new certificate of

vehicle registration,

(

b) the Government receives in cash or by certified cheque or money

order

(

i) a fee for the period that the cancelled certificate

was in force, which is calculated in the same manner as the fee for a

certificate of vehicle registration that is issued for the same period, and

(ii) a government administration fee of $25,

and

(

c) if payment is made to a registry agent, the registry agent

receives the agent's service charge as established by or under an

enactment.

(4) The cancellation of a certificate of vehicle registration is in

addition to the power to restrict the ability to obtain registry services

under

section 2.

(5) When a certificate of vehicle registration is cancelled under this

section and Alberta Registries restricts a person's ability to obtain

registry services as a result of the cancellation, the amount owing to the

Government referred to in

section 4(

a) is to be calculated in accordance

with subsection (3)(b)(

i) of this section.

(6) Despite subsection (3), if the Registrar of Motor Vehicle Services

determines that a certificate of vehicle registration has been cancelled

under subsection (1) in error, the Registrar must issue a certificate of

vehicle registration to replace the cancelled certificate.

Expiry

7 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

on November 30, 2002.

Alberta Regulation 30/98

Social Care Facilities Licensing Act

DAY CARE AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 52/98) pursuant to

section

11 of the Social Care Facilities Licensing Act.

1 The Day Care Regulation (AR 333/90) is amended by this Regulation.

Section 5(1)(

d) is amended by striking out "local board of the health

unit" and substituting "regional health authority in the health region".

Section 9 is repealed.

Section 10 is repealed and the following is substituted:

Accommoda-tion

10 A licence holder shall ensure that,

(

a) in the case of a day care facility,

(

i) no room or space used for child care

purposes is located more than one storey below the ground,

(ii) washrooms and washroom fixtures are

conveniently located and easily accessible to children, and

(iii) each room used for child care purposes

has a layout that is conducive to effective supervision;

(

b) in the case of a day care centre or drop-in centre,

there is adequate space provided for administrative and staff needs.

Section 12 is amended

(

a) in clause (

e) by striking out ", mat or bed" and substituting

"or mat";

(

b) in clauses (

h) and (

i) by striking out ", mats and beds" and

substituting "and mats".

Section 15(

a) and (

b) are amended by striking out "disciplinary" and

substituting "child management".

Section 17 is repealed and the following is substituted:

Availability of telephone numbers and address

17(1) A licence holder shall ensure that the current telephone

numbers of the following are kept readily available in the day care

facility:

(

a) all staff members, including substitute staff

members;

(

b) the health unit or public health centre serving the

day care facility;

(

c) the nearest poison information centre;

(

d) the fire department;

(

e) the police service;

(

f) the ambulance service.

(2) A licence holder shall ensure that the current address and

telephone number of the nearest hospital emergency centre are kept readily

available in the day care facility.

Section 19 is repealed and the following is substituted:

Serious incident or illness

19 In the case of a serious incident, whether injury occurs or not,

or a serious illness to a child, the licence holder shall forthwith ensure

that

(

a) a parent is notified, and

(

b) the child receives medical attention when

necessary.

Section 21 is repealed and the following is substituted:

Supervised care for sick child

21 A licence holder shall ensure that a sick child is

(

a) kept as far away as is practicable from the other

children, and

(

b) directly supervised by a primary staff member

until the child can be removed from the day care facility.

Section 22(2) is repealed and the following is substituted:

(2) The licence holder shall ensure that

(

a) all medication, except medication prescribed by a

physician that may be needed in an emergency to save a child's life, is

stored in a locked container that is inaccessible to children, and

(

b) medication prescribed by a physician that may be

needed in an emergency to save a child's life is stored in a place that is

inaccessible to children.

Section 24 is amended by striking out "day care centre, nursery school

or drop-in centre" and substituting "day care facility".

Section 28(2) is amended

(

a) in clause (

d) by striking out "address and";

(

b) in clause (

e) by striking out ", address".

Section 29(2) is amended

(

a) by striking out "and" at the end of clause (a);

(

b) by repealing clause (

b) and substituting the following:

(

b) the current telephone number of

(

i) the health unit or public health centre

serving the day care facility, and

(ii) the nearest poison information centre,

and

(

Definitions

1 In this Regulation,

(a) "Committee" means the Advisory Committee established by the

Minister under

section 7 of the Government Organization Act for the

purposes of this Regulation;

(b) "Department" means the Department of Agriculture, Food and

Rural Development;

(c) "Director" means the Director of the Animal Industry Division

of the Department;

(d) "inspector" means an inspector appointed under

section 2 of the

Act;

(e) "licence" means a licence issued by the Director under this

Regulation to sell medicine to the public;

(f) "licensee" means a person who holds a licence issued under this

Regulation;

(g) "medicine" means drugs, vaccines and biological supplies for

the prevention, treatment, control or eradication of disease in production

animals;

(h) "permanent place of retail business" means a business operated

in a building or a part of a building that

(

i) is accessible to the public during regular business

hours of not less than 40 hours per week, and

(ii) has signs or other markings that identify the

building or a part of the building as a place of retail business,

but does not include a business operated in a private dwelling

or in a building that houses production animals;

(i) "production animal" means

(

i) a species of animal that may be used for human

consumption or whose products may be used for human consumption, or

(ii) a fur-bearing animal referred to in

section 1 of

the Fur Farms Regulation (AR 299/96);

(j) "sell" includes offer for sale or keep in stock for sale.

Application of Regulation

2 This Regulation does not apply to

(

a) the sale of medicated feeds prepared either in accordance with

the Feeds Act (Canada) or pursuant to a prescription issued by a registered

veterinarian;

(

b) the sale of medicine by a manufacturer or wholesaler of

medicine

(

i) to a registered veterinarian or a pharmacist,

(ii) to another manufacturer or wholesaler of medicine,

(iii) to a licensee.

Prohibition

3 No person shall sell medicine to the public from any premises except

under the authority of a licence issued under this Regulation in respect of

each of those premises.

Application for licence

4(1) A person who wishes to apply for a licence must submit a completed

application form provided by the Director, accompanied with

(

a) a copy of the applicant's retail business licence acceptable to

the Director or, in a case where the local authority does not issue retail

business licences, a letter or a copy of a development permit from the

local authority indicating that the applicant has authority to operate a

retail business,

(

b) such other information as required by the Director, and

(

c) a fee for making the application in an amount set by the

Director.

(2) The Director may refer to the Committee, for its review and

recommendations, any application for a licence that, in the opinion of the

Director, is unusual.

Renewal of licence

5 A person who wishes to apply for a renewal of licence must submit a

completed application form provided by the Director, accompanied with a fee

for making the application in an amount set by the Director.

Refusal to issue or renew licence

6(1) The Director may refuse to issue or renew a licence if the Director

is of the opinion that the applicant

(

a) does not have a permanent place of retail business or otherwise

lacks the equipment and facilities required to properly sell medicine to

the public, or

(

b) has contravened

(

i) the Act or this Regulation,

(ii) the Pharmaceutical Profession Act,

(iii) the Veterinary Profession Act, or

(iv) any Act of the Parliament of Canada relating to the

sale or distribution of medicine.

(2) Where the Director refuses to issue or renew a licence, the Director

shall notify the applicant in writing of that fact.

Qualification certificate

7(1) A person may apply to the Director for a qualification certificate.

(2) The Director shall issue a qualification certificate to an applicant

who has

(

a) successfully completed any course of instruction or training

regarding the proper handling of medicine that is required by the Director,

(

b) passed an examination set by the Committee, and

(

c) paid a fee for making the application in an amount set by the

Director.

(3) No licensee shall sell medicine unless the licensee has on duty at all

times at least one staff member who holds a qualification certificate.

(4) A qualification certificate expires on October 31 of the 4th year

following the year in which the certificate was issued.

(5) A licensee shall notify the Director forthwith of

(

a) ceasing to have a staff member who holds a qualification

certificate as required by subsection (3), or

(

b) the name and qualification certificate number of any new staff

member on the applicant's premises who holds a qualification certificate.

Term of licence

8 A licence expires on October 31 of the year for which it is issued.

Licence non-transferable

9 A licence is not assignable or in any other manner transferable.

Change in ownership

10(1) On a change of ownership of the business of a licensee, the licensee

shall notify the Director forthwith and return the unexpired licence to the

Director.

(2) For purposes of subsection (1),

(

a) in the case of a licence issued to a partnership, a change in

ownership is deemed to have occurred if there is a change in the partners

of the partnership;

(

b) in the case of a licence issued to a corporation, a change in

ownership is deemed to have occurred if 50% or more of the beneficial

ownership if the corporation is sold, assigned or transferred.

Notices

11 Subject to

section 14(2), a notice to be given to a licensee by the

Minister or the Director under this Regulation may be given by sending the

notice by mail to the licensee's last known address for service.

Fee not refundable

12 Any fee paid under this Regulation is not refundable.

Permitted medicine

13(1) A licence issued under this Regulation authorizes the licensee to

sell any of the following medicine:

(

a) injectable biologicals for the prevention or treatment of

disease in production animals, including antiserums, bacterins, toxoids,

antitoxins, products containing concentrated or purified antibodies and

vaccines, except Brucella, Rabies, Anthrax, modified-live virus and live

virus vaccines for mammals;

(

b) antibiotics approved by the Bureau of Veterinary Drugs of the

Department of Health and Welfare (Canada) for oral, injectable, topical or

intramammary administration to production animals and sulfonamides and

their salts and derivatives, except a drug included in

Part I,

Schedule F

of the Food and Drug Regulations (C.R.C., 1978 c.870) made under the Food

and Drugs Act (Canada), and all concentrated drugs that are intended for

mixing into feed;

(

c) preparations for the control of external and internal parasites

and insect pests of production animals, including those registered under

the Pest Control Products Act (Canada);

(

d) oral preparations labelled by the manufacturer for the

prevention or treatment of diseases of the digestive system in production

animals, including bloat, colic, indigestion, diarrhea, constipation and

impaction;

(

e) preparations labelled by the manufacturer for the treatment of

surface wounds and lacerations, wire cuts and burns in production animals;

(

f) preparations labelled by the manufacturer for the treatment of

skin diseases in production animals;

(

g) vitamins for injection or oral administration to production

animals, injectable vitamin A not to exceed 500 000 I.U. per millilitre and

injectable vitamin D not to exceed 75 000 I.U. per millilitre;

(

h) preparations containing minerals for oral administration, and

selenium and iron for injection into production animals for the prevention

or treatment of deficiencies;

(

i) growth promotants and hormone preparations in the form of

implants and feed additives labelled by the manufacturer for use in

production animals;

(

j) injectable epinephrine for treatment of anaphylactic reactions

in production animals;

(

k) dextrose, calcium, phosphorus and magnesium preparations and

propylene glycol labelled by the manufacturer for treatment and prevention

of acetonemia and hypocalcemia in production animals;

(

l) anti-cannibalism compounds for poultry.

(2) No licensee shall purchase or sell a medicine not listed in subsection

(1) or permit a medicine not listed in subsection (1) to be stored on the

licensee's premises.

Suspension or cancellation of licence

14(1) Where a licensee

(

a) has made a false statement in the application for a licence or

renewal of licence, or

(

b) has contravened

(

i) the Act or this Regulation,

(ii) the Pharmaceutical Profession Act,

(iii) the Veterinary Profession Act, or

(iv) any Act of the Parliament of Canada relating to the

sale or distribution of medicine,

the Minister may

(

c) request the licensee to provide a written undertaking, in the

form that the Minister considers proper, that the licensee will refrain

from engaging in the act or practice that gave rise to the contravention,

(

d) suspend the licensee's licence for a period that the Minister

considers appropriate, or

(

e) cancel the licensee's licence.

(2) Where the Minister has suspended or cancelled a licensee's licence,

the Minister shall notify the licensee by registered mail to the licensee's

last known address for service.

(3) Where a licence has been suspended or cancelled, the licensee shall

return the licence to the Minister within 7 days of being notified.

Seal and placard

15(1) Where a licence has been suspended or cancelled, the Minister may

cause an inspector

(

a) to seal the cabinet or storage space where the licensee's

medicine is kept, and

(

b) to erect a placard within the licensee's business premises that

reads "Medicine for Diseases of Production Animals Not For Sale by order of

the Minister of Agriculture, Food and Rural Development".

(2) No person other than an inspector shall remove a seal or placard

pursuant to subsection (1).

Records

16(1) A licensee shall keep an accurate record for each medicine purchased

and sold by the licensee, including

(

a) the date, name and address of the purchaser, and

(

b) the type and quantity, and the lot number where applicable, of

the medicine purchased.

(2) A licensee shall keep copies of all purchase receipts and records of

sales for a period of 2 years.

(3) At the end of each licensing year, the Director may require a written

report from each licensee setting forth such information as the Director

considers necessary.

Inspection permitted

17(1) A licensee shall permit an inspector to inspect during ordinary

business hours

(

a) the medicine the licensee has in stock,

(

b) the premises where the medicine is stored and sold, and

(

c) the licensee's records of the medicine purchased, sold and in

stock.

(2) If an inspector during an inspection finds any medicine that is not

listed in

section 13(1), the inspector shall

(

a) direct the licensee to forthwith return the medicine to the

supplier of the medicine, or

(

b) with the consent of the licensee take possession of the

medicine and dispose of it on the direction of the Director.

Manner of sale

18(1) No licensee shall sell medicine in any manner other than over the

counter at the licensee's place of business.

(2) Without restricting the generality of subsection (1), no licensee

shall sell medicine door to door or by mail order.

Advertising

19 A licensee, when advertising the sale of medicine, may only

(

a) use the words "Medicine for Diseases of Production Animals",

(

b) list the licensee's licence number, and

(

c) refer to the factual information from the drug label or package

insert of the drug.

Storage of medicine

20(1) A licensee shall store or display medicine for sale that does not

require refrigeration in a place that

(

a) prevents the medicine from coming in contact with any food or

other medicine designated for human use, and

(

b) is clean and sanitary at all times.

(2) A licensee shall

(

a) keep medicine for sale that requires refrigeration in a

refrigerator at the temperature recommended by the manufacturer of the

medicine, and

(

b) ensure that the refrigerator

(

i) does not contain any food or other medicine

designated for human use, and

(ii) is clean and sanitary at all times.

Duties of licensee

21(1) A licensee shall

(

a) only sell medicine in containers labelled by the manufacturer,

(

b) draw to the attention of a purchaser of medicine any

precautions to be taken with respect to the minimum amount of time that

must elapse

(

i) between the administration of the medicine to a

production animal and the slaughter of the animal, and

(ii) between the administration of the medicine to a

production animal and the time at which the products from the animal may be

used for human consumption,

(

c) draw to the attention of a purchaser of medicine any toxicity

warnings or other precautions on the label,

(

d) display a sign, in a form determined by the Director, in a

prominent location within the licensee's business premises that

(

i) emphasizes the importance of proper use of

medicine, and

(ii) refers customers to a staff person who holds a

qualification certificate for clarification of any questions regarding the

safe and proper use of medicine,

and

(

e) immediately after the expiration date of any medicine, remove

the medicine and keep it separate from other stock until it is destroyed or

returned to the manufacturer.

(2) No licensee shall

(

a) repackage or alter the contents of any medicine,

(

b) give away, barter or sell any medicine as an inducement to

purchase other merchandise,

(

c) sell medicine after the expiry date of the medicine,

(

d) refuse a request to provide a receipt to any person who

purchases medicine from the licensee, or

(

e) diagnose, prescribe or otherwise contravene the Veterinary

Profession Act.

Form of notice of appeal

22 The form of the notice of appeal required for the purposes of

section

9.1(1) of the Act is as set out in the Schedule.

Repeal

23 The Production Animal Medicine Regulation (AR 300/64) is repealed.

Expiry

24 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

on October 31, 2003.

Coming into force

25 This Regulation comes into force on November 1, 1998.

1 In this Regulation,

(a) "federal laws" means the Canada Agricultural Products Act

(Canada) and the regulations made under that Act;

(b) "grader" means a person appointed or designated as a grader

pursuant to the federal laws.

Prohibitions

2 No person shall

(

a) brand or mark a beef, bison, veal, lamb or mutton carcass or

any portion of it with a continuous ribbon-like mark that is not in

accordance with the federal laws,

(

b) sell, offer or advertise for sale or have in possession for

sale a beef, bison, veal, lamb or mutton carcass or any portion of it that

is branded or marked with a continuous ribbon-like mark that is not in

accordance with the federal laws, or

(

c) sell, offer or advertise for sale or have in possession for

sale a beef, bison, veal, lamb or mutton carcass or any portion of it under

any grade name or designation in the form of a stamp, brand, advertisement

or placard that resembles or might be mistaken for a grade name established

under the federal laws, unless the carcass or portion of it to which the

grade name or designation relates has been graded and marked in accordance

with the federal laws.

Exceptions

3 Notwithstanding

section 2, a buyer, on behalf of a retailer or a

wholesaler, may place an identification brand or mark on a beef, bison,

veal, lamb or mutton carcass, if the brand or mark

(

a) is in brown ink or in a colour of ink corresponding to the

colour of ink on the brand that has been applied to the carcass under the

supervision of a grader,

(

b) does not exceed 7.6 centimetres in height or width,

(

c) in the case of a beef, bison or veal carcass, is located in not

more than one place on each primal cut,

(

d) in the case of a lamb or mutton carcass, is located in not more

than one place, and

(

e) is not in contact with the grader's stamp.

Repeal

4 The Ribbon Branding of Carcasses Regulation (AR 253/90) is repealed.

Expiry

5 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

1 In this Regulation,

(a) "Act" means the Livestock and Livestock Products Act;

(b) "beef carcass" means an entire carcass of one head of cattle

except for

(

i) the hide;

(ii) the portion of the head and neck forward of the

first cervical joint;

(iii) the portion of the foreshank below the knee joint;

(iv) the portion of the hindshank below the hock joint;

(

v) the alimentary canal, liver, kidneys, spleen,

genital tract and genitalia, mammary system, heart and lungs;

(vi) the membranous portion of the diaphragm and pillar

of the diaphragm;

(vii) the spinal cord;

(viii) internal fats that have been removed in

accordance with good commercial practice, including channel fat, kidney

fat, pelvic fat, heart fat, external cod fat and udder fat;

(ix) the tail posterior to the first coccygeal

vertebrae;

(

x) the portion of the carcass that is required

to be removed under the Meat Inspection Act or the Meat Inspection Act

(Canada) or under regulations made under either of those Acts;

(c) "federal laws" means the Canada Agricultural Products Act

(Canada) and the regulations made under that Act;

(d) "grade" means the carcass grade determined under the federal

laws;

(e) "grader" means a person appointed or designated as a grader

pursuant to the federal laws;

(f) "Livestock Marketing Services Branch" means the Livestock

Marketing Services Branch of the Department of Agriculture, Food and Rural

Development;

(g) "operator" means a person who operates a packing plant or an

abattoir;

(h) "sale weight" means the weight of a beef carcass less any tare

in respect of it;

(i) "tare" means an allowance for the weight of materials and

equipment that are weighed with a beef carcass but which do not form part

of the carcass;

(j) "weight supervisor" means a person appointed as a weight

supervisor by the Minister in accordance with

section 16 of the Act.

Sale weight of carcass

2 Where a beef carcass is weighed to determine its sale weight, the

operator shall

(

a) weigh the beef carcass

(

i) without removing any portion of it, and

(ii) before placing it in a cooler,

and

(

b) record the weight on a standard weight sheet in the form

approved by the weight supervisor.

Deduction for tare allowance

3(1) No operator shall deduct an allowance for shrinkage or tare in

calculating the sale weight of a beef carcass other than a tare respecting

equipment used for carrying, forming or supporting the beef carcass while

it is being weighed.

(2) Where a tare is deducted from the weight of the beef carcass, the tare

must not exceed the average weight of tare items declared by the operator

under

section 6(e).

Weight and grade information

4(1) Subject to subsection (5), for each beef carcass that is weighed and

graded, the operator shall provide to the person from whom the operator

purchased the animal the following information:

(

a) the weight of the beef carcass, and

(

b) the grade and descriptive symbol assigned to the beef carcass

as determined in accordance with the federal laws.

(2) The weights and grades required under subsection (1) must be certified

by a grader and listed on a grading certificate issued pursuant to the

federal laws or on a form prescribed by the Minister.

(3) An operator shall designate one or more persons, who are satisfactory

to the weight supervisor, to be scale operators for the packing plant or

abattoir.

(4) Following the weighing of each lot of beef carcasses, the scale

operator shall at the next interruption of the kill provide the weight

supervisor with a signed copy of the weight sheet on which the weight of

each carcass is recorded.

(5) This

section does not apply with respect to the beef carcass of an

animal that is sold to an operator on the basis of its live weight.

Duties of weight supervisor

5(1) A weight supervisor shall

(

a) check the accuracy of the weighing mechanism at least twice

each day on days when beef carcasses are weighed for payment on the basis

of carcass weight;

(

b) check the weight of the items constituting the tare on a random

basis to ensure

(

i) that the tare is uniform for all beef carcasses,

and

(ii) that the average weight of tare items established

pursuant to

section 6(

e) is adhered to within plus or minus 225 grams per

carcass;

(

c) mark and set aside any tare items that fail to comply with

section 6(e);

(

d) post on the scale a notice signed by the weight supervisor

indicating the tare weight to be used in weighing beef carcasses;

(

e) report any serious malfunction of scales or any other

irregularity to the Livestock Marketing Services Branch within 24 hours of

the time that the weight supervisor discovers the malfunction or

irregularity;

(

f) submit to the Livestock Marketing Services Branch every month

tare weight reports and a log of scale inspection reports in the form

prescribed by the Minister;

(

g) order the operator to re-weigh any beef carcasses that, in the

weight supervisor's opinion, may not have been weighed or recorded

properly;

(

h) promptly advise the operator of any action necessary to achieve

compliance with the Act or this Regulation;

(

i) advise the grader of any cattle purchased as beef carcasses

prior to the cattle being slaughtered and give the grader a copy of the

weight sheet signed by the operator.

(2) A weight supervisor shall conduct checks under subsection (1)(

a) during a time that does not interfere with the operation of the packing

plant or abattoir, as the case may be, unless the weight supervisor has

reason to believe that the weighing mechanism is faulty.

Duties of operator

6 An operator shall

(

a) supply for the use by a weight supervisor adequate test weights

for checking scales and arrange for annual certification of the test

weights under the Weights and Measures Act (Canada);

(

b) supply for the use by a weight supervisor in weighing tare

items, a suitable small scale, certified under the Weights and Measures Act

(Canada);

(

c) provide all necessary assistance to a weight supervisor who is

performing any of the weight supervisor's duties under

section 5;

(

d) provide adequate storage for weights supplied under clause (

a) and maintain the weights in a clean condition;

(

e) establish and declare to the weight supervisor the average

weight of tare items;

(

f) for animals purchased by carcass weight or by carcass weight

and grade, prepare a manifest that indicates

(

i) the number and sex of animals purchased from each

person, and

(ii) the method used to identify the lot of animals and

beef carcasses,

and provide a copy of the manifest to the weight supervisor

before the animals are slaughtered.

Weight sheet

7 A grader shall retain the copy of the weight sheet received by the

grader pursuant to

section 5(1)(

i) for 90 days.

Repeal

8 The Weighing of Beef Carcasses Regulations (AR 12/77) are repealed.

Expiry

9 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

on November 30, 2002.

SOCIAL HOUSING ACCOMMODATION AMENDMENT REGULATION

Filed: February 11, 1998

Made by the Minister of Municipal Affairs (M.O. H:003/98) pursuant to

section 34(1) of the Alberta Housing Act.

1 The Social Housing Accommodation Regulation (AR 244/94) is amended by

this Regulation.

Section 1(3) is amended by adding the following after clause (p):

(

q) the amount of $5 per month, representing the increase to the

handicap benefit under the Assured Income for the Severely Handicapped

Regulation (AR 331/79) that was received by virtue of the Assured Income

for the Severely Handicapped Amendment Regulation (AR 207/97).
