B.C. Reg. 7/2022 , deposited January 17, 2022, under the COMMUNITY CARE AND ASSISTED LIVING ACT [section 34 (2)]. Order in Council 25/2022, approved and ordered January 17, 2022.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Residential Care Regulation, B.C. Reg. 96/2009, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Residential Care Regulation, B.C. Reg. 96/2009, is amended by adding the following definition:

"authorized health professional" means a person who is authorized under the Health Professions Act to prescribe a medication; .

Section 70 is amended

(

a) by repealing subsection (1) and substituting the following:

(1) In this section, "prescribe" means to authorize a pharmacy to dispense a specified medication, including a medication not listed in

Schedule I, IA or IV of the Drug Schedules Regulation, B.C. Reg. 9/98, for administration to or use by a designated individual.

(1.1) A licensee must ensure that only medications that have been prescribed by an authorized health professional are administered to a person in care. , and

(

b) in subsections (4) (

a) and (5) (

b) by striking out " the medical practitioner or nurse practitioner " and substituting " the authorized health professional " and by striking out " or ordered ".

Section 71 (

b) is amended by striking out " a medical practitioner or nurse practitioner " and substituting " an authorized health professional ".
