OIC Text: The Minister of Finance in his report dated May 12, 2009 states: That the expenditure in the amount set forth in

Schedule "A" hereto is urgently and immediately required for the public good pending the granting of the appropriations by the Legislature for the fiscal year ending March 31, 2010, to provide for defraying charges and expenses of the public service of the Province for the fiscal year ending March 31, 2010. That other than as contained in

Section 27 which provides the payments for any service shall not exceed one half of the sum appropriated for such service in the preceding fiscal year, there is no legislative provision for the payment of the said amounts. That the Legislature is not in session. The Minister of Finance therefore recommends that pursuant to

Section 29 of

Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, the Governor in Council be pleased to order a Special Warrant to be prepared, to be signed by the Lieutenant Governor, for the issue of the amount set forth in

Schedule "A" hereto for the fiscal year ending March 31, 2010. The said sum shall be paid by the Minister of Finance, subject to the provisions of the statutes in that behalf, out of the monies that are applicable to the purpose for which the said sum is granted.

That when the Legislature enacts legislation to provide for defraying certain charges and expenses of the public service for the Province, likely to be known as the Appropriations Act, 2009, such amount authorized to be spent pursuant to the Special Warrant issued hereto shall be included in, and not in addition to, the amounts authorized to be spent pursuant to that Act. The Governor in Council by and with the advice of the Executive Council is pleased to approve of the Report and Recommendation of the Minister of Finance, and to order in accordance therewith.
