Loi sur le bien-être des enfants et des jeunes His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1 Subsection 47(3) of the Child and Youth Well- Being Act,

chapter of the Acts of New Brunswick, 2022, is amended Le paragraphe 47(3) de la

Loi sur le bien-être des enfants et des jeunes,

a) in paragraph (

b) of the English version by striking out “or” at the end of the paragraph;

a) à l’alinéa (

b) de la version anglaise, par la sup ‐ pression de « or » à la fin de l’alinéa; (

b) by adding after paragraph (

b) the following:

b) par l’adjonction de ce qui suit après l’alinéa b) : (b.1) enter into an agreement, including a custody agreement or a guardianship agreement, with the pa ‐ rent of the child or youth to ensure the well-being of the child or youth is protected without returning the child or youth to the care of the parent; or b.1) conclure avec le parent un accord, notamment un accord de garde ou un accord de tutelle, afin de veiller à ce que le bien-être de l’enfant ou du jeune soit protégé, et ce, sans remettre l’enfant ou le jeune à la charge du parent; 2(1) An agreement entered into from January 26, 2024, to the date of the commencement of this Act, both dates inclusive, by the Minister of Social Development within five days after providing protective care inter ‐ ventions, including a custody agreement or a guardian‐ ship agreement, with the parent of a child or youth without returning the child or youth to the care of the parent is deemed 2(1) Tout accord, notamment un accord de garde ou un accord de tutelle, qu’a conclu avec un parent d’un enfant ou d’un jeune le ministre du Développement so ‐ cial entre le janvier et la date d’entrée en vi ‐ gueur de la présente loi, inclusivement, dans les cinq jours suivant la prise de mesures d’interven ‐ tion protectrice, sans remettre l’enfant ou le jeune à la charge du parent, est réputé : (

a) to be an agreement entered into under para ‐ graph 47(3)(b.1) of the Child and Youth Well-Being Act; and

a) être un accord conclu en application de l’ali ‐ néa 47(3)b.1) de la

Loi sur le bien-être des enfants et des jeunes; 1 (

b) to have been validly entered into by the Minis ‐ ter of Social Development under that paragraph.

b) avoir été validement conclu par le ministre du Développement social en application de cet alinéa. 2(2) Any act or thing done from January 26, 2024, to the date of the commencement of this Act, both dates inclusive, by the Minister of Social Development in the exercise or performance or intended exercise or per ‐ formance of any power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister under paragraph 47(3)(b.1), is deemed to con‐ stitute a valid exercise or performance of the power, duty, function, responsibility or authority and is con ‐ firmed and ratified. 2(2) Tout acte qu’a accompli ou toute chose qu’a faite le ministre du Développement social entre le janvier et la date d’entrée en vigueur de la présente loi, inclusivement, dans l’exécution, l’exercice ou l’acquittement, selon le cas, effectif ou censé tel d’un pouvoir qui lui a été confié, d’une fonction, d’une responsabilité ou d’une autorité qui lui a été conférée ou d’une obligation qui lui a été imposée par l’ali ‐ néa 47(3)b.1) est réputé constituer l’exécution, l’exer ‐ cice ou l’acquittement valide de ce pouvoir, de cette fonction, de cette responsabilité, de cette autorité ou de cette obligation et est confirmé et ratifié. 2(3) Any agreement referred to in subsection (1) that at the time of the commencement of this

section had not expired or terminated is valid and effective. 2(3) Tout accord visé au paragraphe (1) qui, à l’en ‐ trée en vigueur du présent article, n’avait pas expiré ou pris fin est valide et produit ses effets. 2(4) No action, application or other proceeding to question or in which is questioned the validity of the authority of the Minister of Social Development to act under subsection (2) lies or shall be instituted against the Crown in right of the Province or the Minister of Social Development if the Minister acted in good faith in doing the act or thing. 2(4) La Couronne du chef de la province et le minis ‐ tre du Développement social bénéficient de l’immunité de poursuite engagée par voie d’action ou autre ins ‐ tance qui met en question ou dans laquelle est contes ‐ tée la validité de l’autorité du ministre d’agir en application du paragraphe (2), à la condition qu’il ait agi de bonne foi. 3
