B.C. Reg. 121/2005, deposited March 18, 2005, pursuant to the CHILD CARE SUBSIDY ACT [Section 13]. Order in Council 224/2005, approved and ordered March 17, 2005.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended as set out below.

Section 1 is amended by repealing the definition of "person with disabilities"

and substituting the following:

"person with disabilities" means a person who is 18 years of age or older and is approved for receipt of, or is receiving, benefits or services under a program of a provincial or the federal government to assist the person to perform daily living activities because that person's capacity to perform those activities is restricted by his or her physical or mental impairment; .

Section 3 (2) is amended in paragraph (

b) by striking out "or" at the end of subparagraph (ii), adding "or" at the end of subparagraph (iii), and adding the following subparagraph:

(

v) each parent has a medical condition that interferes with their ability to care for their child.

Section 9 (2) (

t) is repealed and the following substituted:

(

t) loans provided under the British Columbia Student Assistance Program or under a student loan program of the federal government, the government of a province or the government of a jurisdiction outside Canada.
