An Act to Amend the Clean Water Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 1 of the Clean Water Act,

chapter C-6.1 of the Acts of New Brunswick, 1989, is amended (

a) by repealing the definition “alteration” and substituting the following: “alteration”, when it refers to a watercourse or a wetland, means a temporary or permanent change made at, near or to a watercourse or wetland or to the water flow in a watercourse or wetland and in- cludes (

a) any change made to existing structures in the watercourse or wetland including repairs, modifications or removal, whether the water flow in the watercourse or wetland is altered or not, (

b) the operation of machinery on the bed of a watercourse other than at a recognized fording place, PROJET DE LOI 18 Loi modifiant la

Loi sur l’assainissement de l’eau,

chapitre C-6.1 des Lois du Nouveau- Brunswick de 1989, est modifié

a) par l’abrogation de la définition « modification » et son remplacement par ce qui suit : « modification » désigne, dans le cas d’un cours d’eau ou d’une terre humide, tout changement de nature provisoire ou définitive, apporté à ce cours d’eau ou à cette terre humide ou à son débit ou à proximité de ce cours d’eau ou cette terre humide et comprend

a) un changement apporté aux constructions existant sur le cours d’eau ou sur la terre humide, y compris les réparations, modifications ou sup- pressions de constructions, que l’écoulement des eaux du cours d’eau ou de la terre humide soit modifié ou non,

b) le fonctionnement de machines sur le lit d’un cours d’eau ailleurs qu’à un endroit reconnu comme passage à gué,

c) the operation of machinery in or on a wet- land, (

d) any deposit or removal of sand, gravel, rock, topsoil, organic matter or other material into or from a watercourse or wetland or within thirty meters of a wetland or the bank of a water- course, (

e) any disturbance of the ground within thirty metres of a wetland or the bank of a watercourse, except grazing by animals, the tilling, plowing, seeding and harrowing of land, the harvesting of vegetables, flowers, grains and ornamental shrubs and any other agricultural activity pre- scribed by regulation for the purposes of this paragraph, that occur more than five metres from a wetland or the bank of a watercourse, (

f) any removal of vegetation from the bed or bank of a watercourse, (

g) any removal of trees from within thirty me- tres of the bank of a watercourse, and (

h) any removal of vegetation from a wetland or from within thirty metres of a wetland except the harvesting of vegetables, flowers, grains and ornamental shrubs and any other agricultural ac- tivity prescribed by regulation for the purposes of this paragraph, that occur more than five metres from a wetland; (

b) in the definition « bassin hydro- graphique » in the French version by striking out “tout autre cours d’eau” and substituting “toute autre eau réceptrice”;

d) le dépôt ou l’enlèvement de sable, de gra- vier, de roches, de terre arable, de matière orga- nique ou de toute autre matière dans un cours d’eau ou dans une terre humide ou dans les trente mètres d’une terre humide ou de la rive d’un cours d’eau,

e) toute perturbation du sol dans les trente mè- tres d’une terre humide ou de la rive d’un cours d’eau, à l’exception du pâturage des animaux, du labourage, de l’ensemencement et du hersage de la terre, de la récolte de légumes, de fleurs, de graines et d’arbustes décoratifs et de toute autre activité agricole prescrite par règlement aux fins du présent alinéa, qui survient à plus de cinq mè- tres d’une terre humide ou de la rive d’un cours d’eau,

f) l’enlèvement de la végétation sur le lit ou la rive d’un cours d’eau,

g) l’enlèvement d’arbres dans les trente mètres de la rive d’un cours d’eau, et

h) l’enlèvement de la végétation d’une terre humide ou dans les trente mètres d’une terre hu- mide à l’exception de la récolte de légumes, de fleurs, de graines et d’arbustes décoratifs et de toute autre activité agricole prescrite par règle- ment aux fins du présent alinéa, qui survient à plus de cinq mètres d’une terre humide;

b) à la définition « bassin hydrographique » de la version française, par la suppression de « tout autre cours d’eau » et son remplacement par « toute autre eau réceptrice »;

c) by adding the following definition in al- phabetical order: “wetland” means land that (

a) either periodically or permanently, has a water table at, near or above the land’s surface or that is saturated with water, and (

b) sustains aquatic processes as indicated by the presence of hydric soils, hydrophytic vegeta- tion and biological activities adapted to wet con- ditions. 2 Subparagraph 14(5)(b)(

i) of the Act is amended by striking out “Property Identifier Numbers” and substituting “parcel identifier num- bers”. 3 Subsection 14.1(4) of the Act is amended by striking out “Property Identifier Number or Num- bers” and substituting “parcel identifier number or numbers”. 4

Section 15 of the Act is amended (

a) in subsection (1) by repealing the portion preceding paragraph (

a) and substituting the following: 15(1) A person planning a hydro-electric power project, a control dam, a river diversion, a drainage diversion or any other project or structure that alters a watercourse or a wetland or diverts all or part of a watercourse or the water flowing in a watercourse or a wetland shall, before undertaking or proceeding with the project, (

b) by repealing subsection (2) and substitut- ing the following: 15(2) The owner of a project or structure referred to in subsection (1) or any other structure that lies within or crosses all or part of a watercourse or wet-

a) au paragraphe (1), par la suppression du passage qui précède l’alinéa a) et son remplace- ment par ce qui suit : 15(1) Une personne qui projette un aménagement hydro-électrique, un barrage régulateur, le détour- nement d’une rivière, le détournement de l’écoule- ment des eaux de drainage ou tout autre projet ou construction qui modifie un cours d’eau ou une terre humide ou détourne tout ou

partie d’un cours d’eau ou de l’écoulement des eaux d’un cours d’eau ou d’une terre humide doit, avant d’entreprendre ou d’entamer le projet,

b) par l’abrogation du paragraphe (2) et son remplacement par ce qui suit : 15(2) Le propriétaire d’un projet ou d’une cons- truction visé au paragraphe (1) ou de toute autre structure qui se trouve dans un cours d’eau ou dans

Section 40 of the Act is amended (

a) in paragraph (a.1) by striking out “para- graph (d)” and substituting “paragraph (

e) or (h)”; (

b) by repealing paragraph (

o) and substitut- ing the following: (

o) regulating, controlling, prohibiting, direct- ing or providing for river diversions, drainage di- versions or alterations or diversions of all or part of a watercourse or wetland or the water flowing in a watercourse or wetland; (

c) in paragraph (

q) by striking out “a water- course” and substituting “a watercourse or wet- land”. Consequential amendments 6

Section 15 of

An Act to Amend the Clean Water Act,

chapter 26 of the Acts of New Brunswick, 2002, is repealed and the following is substituted: 15

Section 15 of the Act is amended by adding after subsection (3) the following: 15(4) Where a watercourse or wetland alteration or the work associated with it is not commenced, made or carried out in compliance with this Act, the regulations, the terms and conditions imposed on any permit that may have been issued for the alter- ation or any order, direction or demand of the Min- ister, the Minister may order the person to whom the permit is issued, or if no permit is issued, the person commencing, making or carrying out the alteration une terre humide ou une

o) réglementant, contrôlant, interdisant, ordon- nant ou prévoyant le détournement d’une rivière ou l’écoulement d’eaux de drainage ou toute mo- dification ou tout détournement de tout ou

partie d’un cours d’eau ou d’une terre humide ou de l’écoulement des eaux d’un cours d’eau ou d’une terre humide;

c) à l’alinéa q), par la suppression de « cours d’eau » et son remplacement par « cours d’eau ou une terre humide ». Modifications corrélatives 6 L’article 15 de la Loi modifiant la

chapitre 26 des Lois du Nouveau-Brunswick de 2002, est abrogé et rem- placé par ce qui suit : 15 L’article 15 de la Loi est modifié par l’adjonc- tion, après le paragraphe (3), de ce qui suit : 15(4) Lorsque la modification d’un cours d’eau ou d’une terre humide ou les travaux y afférents ne sont pas entrepris, effectués ou exécutés en confor- mité avec la présente loi, les règlements, les moda- lités et les conditions imposées au permis ou les ar- rêtés, directives ou prescriptions du Ministre, celui- ci peut ordonner au titulaire du permis, ou si aucun permis n’a été délivré, à la personne qui entreprend, effectue ou exécute la modification

a) to cease and desist from further work of commencing, making or carrying out the alter- ation, (

b) to remove the alteration and any building, structure, works and chattels used to commence, make or carry out the alteration, (

c) to do or cause to be done such things as are considered necessary by the Minister to make the alteration conform to this Act, the regulations, the terms and conditions imposed on any permit that may have been issued and any order, direc- tion or demand of the Minister, or (

d) to do or cause to be done such things as are considered necessary by the Minister to render the alteration in good repair. 15(5) Notwithstanding subsection 4(8), if the Minister is satisfied that it is in the public interest that (

a) a watercourse or wetland alteration, or (

b) a structure or thing that lies within or crosses a watercourse or wetland, be removed from the watercourse or wetland and the owner cannot, in the Minister’s opinion, be as- certained, the Minister may order the removal of the alteration, structure or thing at the expense of the Province.

a) les éléments de modification d’un cours d’eau ou d’une terre humide, ou

b) une construction ou une chose qui se trouve dans un cours d’eau ou dans une terre humide ou qui les traverse, et s’il est d’avis que l’identité du propriétaire ne peut être établie, il peut ordonner qu’ils soient enle- vés aux frais de la province.
