a) a minimum of one person who shall be nomi- nated by the Minister of Environment and Local Gov- ernment from among the land use and planning em- ployees of that department;

Vacancy Vacance 4(1) If a vacancy occurs on the Board, the Lieutenant- Governor in Council may appoint a person to fill the va- cancy for the balance of the term of the chair, vice-chair or other member of the Board replaced. 4(1)

Practice and procedure of the Board Pratique et procédure de la Commission 8(1) Subject to this Act and the regulations, the Board may make rules governing the practice and procedure of the Board for hearings permitted or required under this Act and for the conduct of meetings. 8(1)

Sous réserve de la présente loi et des règlements, la Commission peut, par règle, régir sa pratique et sa procédure relativement aux audiences que permet ou qu’exige la présente loi ainsi que pour la tenue de ses ré- unions. 8(2) The Regulations Act does not apply to the rules made under subsection (1). 8(2) La

Decisions Décisions 9(1) After hearing an appeal, the Board shall render a decision in writing along with the reasons for its deci- sion. 9(1) À la suite de l’instruction de l’appel, la Commis- sion rend sa décision par écrit avec les motifs à l’appui. 9(2) A decision of the Board shall be made by a ma- jority vote of the members present, and, in the event of a tie vote, the person presiding at the hearing shall cast the deciding vote. 9(2) Les décisions de la Commission sont prises à la majorité des voix des membres présents, et, en cas d’égalité, la personne qui préside l’audience a voix pré- pondérante. 9(3) The person presiding at the hearing shall sign all decisions issued by the Board under subsection (1). 9(3) La personne qui préside l’audience signe toutes les décisions que rend la Commission en vertu du para- graphe (1). 9(4) The chair shall send a copy of the decision of the Board by mail to all parties involved in the appeal and to the Minister. 9(4) Le président envoie par courrier ordinaire une co- pie de la décision à toutes les parties à l’appel ainsi qu’au ministre. 9(5) Within 30 days of the date that a copy of a deci- sion is mailed under subsection (4), a person who is sub- ject to the decision may appeal the decision to a judge of The Court of Queen’s Bench of New Brunswick in ac- cordance with the Rules of Court. 9(5) Dans les trente jours de la date d’envoi de la co- pie de la décision en application du paragraphe (4), toute personne que touche cette décision peut en interjeter ap- pel à un juge à la Cour du Banc de la Reine du Nouveau- Brunswick en conformité avec les Règles de procédure.
