B.C. Reg. 184/2015 , deposited October 2, 2015, under the LIQUOR CONTROL AND LICENSING ACT [section 84]. Order in Council 576/2015, approved and ordered October 2, 2015.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended as set out in the attached Schedule.

Schedule

1 Sections 18.3, 18.3 (a), 18.4, 18.5 (2), (2) (

a) and (

b) and (3) and 18.6 (1), (2) and (2) (

a) and items 36.2 and 45.2 of

Schedule 4 of the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, are amended by striking out “ farmers’ market ” wherever it appears and substituting “ market ”.

Section 18.3 is amended

(

a) in paragraph (

a) by striking out “ who make, bake, grow or raise the products they sell at that market ” and substituting “ who sell at the market artisanal goods of their own making or agricultural goods they produce, grow or raise themselves ”,

(

b) by repealing paragraphs (

b) to (

d) and substituting the following:

(

b) the market is

(

i) managed or carried on by an organization incorporated under the Business Corporations Act , Society Act ,

Canada Business Corporations Act or Canada Not-for-profit Corporations Act ,

(ii) managed or carried on by a municipality or regional district in that municipality or regional district, or

(iii) carried on at Granville Island in Vancouver Harbour and managed or carried on by the Canada Mortgage and Housing Corporation;

(

c) the market includes at least 6 vendors that do not sell or serve liquor;

(

d) the market operates

(

i) on a weekly basis, for up to 3 days per week, or

(ii) on an annual basis, for up to 35 consecutive days per year.

Section 18.5 is amended

(

a) by repealing subsection (1) and substituting the following:

(1) In this section, “registration information” means the registration number shown on the certificate of incorporation of a society, company or corporation. ,

(

b) in subsection (2) (

a) by striking out “ the registration information ” and substituting “ in the case of an organization referred to in

section 18.3 (b) (i), the registration information ” , and

(

c) in subsection (2) by adding the following paragraph:

(a.1) the name of the person that manages or carries on the market that is proposed to be the subject of the authorization; .
