EXPLANATORY NOTES

This Bill would amend the following Acts

by adding a provision allowing appointed members to continue in office upon the

expiry of their terms until they are reappointed or replaced:

Health Research Ethics Authority Act ;

Medical Care Insurance Act, 1999 ; and

Mental Health Care and Treatment Act.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

HEALTH RESEARCH ETHICS

AUTHORITY ACT

as amended

Section 3 of the Health Research Ethics Authority Act is amended by adding

immediately after subsection (5) the following:

(5.1) Where the term of a director expires, he or

she continues to be a director until reappointed or replaced.

MEDICAL CARE INSURANCE ACT, 1999

SNL1999 cM-5.1

as amended

Section 15 of the Medical Care Insurance Act, 1999 is amended by adding immediately

after subsection (8) the following:

(8.1) Where the term of a member of the panel expires,

he or she continues to be a member until reappointed or replaced.

MENTAL HEALTH CARE AND

TREATMENT ACT

Section 58 of the Mental Health Care and Treatment Act is amended by adding

immediately after subsection (1) the following:

(1.1) Where the term of a member expires, he or she

continues to be a member until reappointed or replaced.
