On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the following regulations are amended as set out in the attached Schedule:

(

a) the Appeals Regulation, B.C. Reg. 24/2008;

(

b) the Conseil Scolaire Francophone de la Colombie-Britannique Regulation, B.C. Reg. 213/99;

(

c) the Francophone Education Authorities Regulation, B.C. Reg. 212/99;

(

d) the School Regulation, B.C. Reg. 265/89.

Schedule

Appeals Regulation

Section 1 of the Appeals Regulation, B.C. Reg. 24/2008, is amended

(

a) by repealing the

definitions of "Special Needs Students Order" and "student with special needs" , and

(

b) by adding the following

definitions:

"student with disabilities or diverse abilities" means a student who has

(

a) a disability of an intellectual, physical, sensory, emotional or behavioural nature,

(

b) a learning disability, or

(

c) exceptional gifts or talents;

"Students with Disabilities or Diverse Abilities Order" means Ministerial Order 150/89.

Section 2 (2) is amended

(

a) by repealing paragraph (

d) and substituting the following:

(

d) requires the student, as a disciplinary measure, to complete all or part of an educational program by online learning, despite the fact that all or part of the educational program and space and facilities for the student are available in a school, other than an online learning school, in the board’s school district, ,

(

b) in paragraph (e) (

i) by striking out " student with special needs " and substituting " student with disabilities or diverse abilities ", and

(

c) by repealing paragraph (f) (

i) and substituting the following:

(

i) under the Students with Disabilities or Diverse Abilities Order, to offer to consult with a parent of a student with disabilities or diverse abilities regarding the placement of the student in an educational program; .

Conseil Scolaire Francophone de la Colombie-Britannique Regulation

Schedule A of the Conseil Scolaire Francophone de la Colombie-Britannique Regulation, B.C. Reg. 213/99, is amended

(

a) by repealing paragraphs (

a) and (

d) under the heading " Northern B.C. (Nord de la C.-B.) " and substituting the following:

(

a) School District No. 27 (Cariboo-Chilcotin)

(

d) School District No. 50 (Haida Gwaii) , and

(

b) by repealing paragraphs (

a) and (

d) under the heading " Vancouver Island North (Nord de l’île de Vancouver) " and substituting the following:

(

a) School District No. 47 (qathet)

(

d) School District No. 70 (Pacific Rim) .

Francophone Education Authorities Regulation

Schedule A of the Francophone Education Authorities Regulation, B.C. Reg. 212/99, is amended by striking out " Je suis un parent immigrant au sens ou l’entend le School Act , " and substituting " Je suis un parent immigrant au sens où l’entend le School Act , ".

Schedule B is amended by striking out " conseil scolaire francophone de la colombie-britannique " wherever it appears and substituting " Conseil Scolaire Francophone de la Colombie-Britannique ".

Schedule C is amended

(

a) by striking out " conseil scolaire francophone de la colombie-britannique " in both places and substituting " Conseil Scolaire Francophone de la Colombie-Britannique ", and

(

b) by striking out " je m’acquitterai fidèlment de mes fonctions " and substituting " je m’acquitterai fidèlement de mes fonctions ".

Section 1 of

Schedule D is amended

(

a) by repealing paragraph (r), and

(

b) by adding the following paragraph:

(v.1) Students with Disabilities or Diverse Abilities Order, M150/89; .

School Regulation

Section 1 (2) of the School Regulation, B.C. Reg. 265/89, is amended

(

a) in paragraph (

c) of the definition of "educational resource materials" by striking out " computers used for distributed learning " and substituting " computers used for online learning ", and

(

b) by adding the following definition:

"students with disabilities or diverse abilities" means students who have

(

a) disabilities of an intellectual, physical, sensory, emotional or behavioural nature,

(

b) learning disabilities, or

(

c) exceptional gifts or talents.

Section 3 (3) (b), (4) and (5) is amended by striking out " through distributed learning " and substituting " through online learning ".

Section 4 (1) (h.1) is amended by striking out " students with special needs " and substituting " students with disabilities or diverse abilities ".

Section 5 is amended

(

a) in subsection (6) (b.1) by striking out " students with special needs " and substituting " students with disabilities or diverse abilities ",

(

b) in subsection (7.1) by striking out " distributed learning " in both places and substituting " online learning ",

(

c) in subsections (10), (10.1) (

a) and (b), (12) and (13) by striking out " a distributed learning school " and substituting " an online learning school ", and

(

d) in subsections (10.1) (

b) and (13) by striking out " by means of distributed learning " and substituting " by means of online learning ".

Section 15 is amended by striking out " the School Act " and substituting " the Act ".

Section 16 (1) and (2) is amended by striking out " For the purposes of

section 82 of the School Act " and substituting " For the purposes of

section 82 of the Act ".
