Citation

1 These regulations may be cited as the Shubenacadie Wildlife Park Regulations .

Purpose

2 The purpose of these regulations is to provide for conservation of biodiversity, nature

education and the safety of visitors in the Shubenacadie Wildlife Park.

Definitions

3 In these regulations,

“Act” means the Wildlife Act ;

“Director” means the Director of Wildlife, as defined in the Act;

“park attendant” means a conservation officer appointed under the Act or the

Forests Act or a person employed at the Wildlife Park;

“picnic area” means an area in the Wildlife Park shown as being a picnic area on

signs posted by the Department;

“vehicle” includes an off-highway vehicle under the Off-highway Vehicles Act ;

“Wildlife Park” means the Shubenacadie Wildlife Park.

Firearm and bow prohibitions

(1) Except as provided in subsection (3), a person must not possess or discharge a

firearm or bow in or into the Wildlife Park at any time.

(2) A person visiting the Wildlife Park may leave a firearm or bow, or both, in a

vehicle if the firearm or bow is stored and locked in accordance with the Act.

(3) Subsection (1) does not apply to a person employed by the Department of Natural

Resources in the course of carrying out their duties as an employee.

Conditions of admission

(1) A person must not enter, use or remain in the Wildlife Park unless the applicable

fee, if any, has been paid by or on behalf of that person.

(2) A person must show proof of payment of the applicable fee, if any, if requested by

a park attendant.

(3) A person must show personal identification if requested by a park attendant.

No entry during closed hours

6 A person must not enter or remain in the Wildlife Park outside the regular posted hours

of operation except as authorized by the Director or a park attendant.

Restricted activities

7 A person must not do any of the following while in the Wildlife Park without the written

authorization of the Director or a park attendant:

(

a) cut, damage or remove any plant, shrub, flower or tree;

(

b) remove any artifact or object of natural curiosity or interest;

(

c) display a sign or advertisement;

(

d) solicit, sell or offer for sale any article, service or thing, carry on any

business or use any area for pecuniary gain;

(

e) remove, damage or deface any real or personal property belonging to or

claimed by the Crown or other persons;

(

f) molest, harass, disturb, annoy or torment any animals, whether in captivity

or not;

(

g) consume alcoholic beverages, except in the picnic area;

(

h) fail to comply with a sign, notice, map or other device governing or

controlling the conduct of a person, vehicle, vessel or domestic animal.

Domestic animals

(1) A person who owns or is in control of a domestic animal must not permit it to be

in the Wildlife Park unless the animal is on a leash no more than 6 feet long that is

hand-held or securely tied and restricts the animal from running loose.

(2) A person who owns or is in control of a domestic animal must not permit it to be

in an area of the Wildlife Park where captive wildlife is displayed or maintained.

Fires

(1) Except as provided in subsection (5), a person must not have a fire in the Wildlife

Park other than in a fireplace or grill provided for that purpose or in an area

designated by a park attendant.

(2) A person must not possess or ignite fireworks in the Wildlife Park.

(3) A person must completely extinguish any fire in the Wildlife Park before leaving

the area in which the fire was burning.

(4) A person must not drop or discard a burning match or an ignited cigar, cigarette or

other burning substance in the Wildlife Park.

(5) Subsection (1) does not apply to a person employed by the Department of Natural

Resources in the course of carrying out their duties as an employee.

Sports and other activities

(1) Except as provided in subsection (2), no sport, community event or other activity

organized outside of the Wildlife Park is permitted in the Wildlife Park.

(2) The Director or a park attendant may authorize a sport, community event or other

activity organized outside of the Wildlife Park to take place in the Wildlife Park

and may impose in writing any conditions the Director or park attendant

determines appropriate.

Hunting, trapping and angling

(1) Except as provided in subsections (2) and (3), a person must not do any of the

following in the Wildlife Park:

(

a) take, hunt, kill, or pursue or attempt to take, hunt, kill or pursue wildlife,

including the egg of any wildlife;

(

b) possess or use any trap, snare or poison;

(

c) possess any wildlife or the carcass or any part of any wildlife, including the

egg of any wildlife.

(2) Subsection (1) does not apply to a person who fishes in compliance with the

Fishing Regulations made under the Act and who is fishing in the area in the

Wildlife Park known as St. Andrew’s Marsh.

(3) The Director may, in writing, authorize a person to enter the Wildlife Park at any

time, including Sunday, to take, hunt, kill or capture any wildlife for the purposes

Director deems appropriate.

No unauthorized alteration of wildlife habitats

(1) A person must not alter a wildlife habitat in the Wildlife Park, or any live or dead

vegetation or structures in the wildlife habitat that provide food or cover for

wildlife, without the written authorization of the Director or a park attendant.

(2) A person found guilty of contravening subsection (1) may, in addition to any fine,

be required to restore or create wildlife habitat, including vegetation or structures

that provide food or cover for wildlife, as compensation for any alteration of

wildlife habitat.

Vehicles

13 A person must not operate a vehicle in the Wildlife Park, except on a road or other place

designated by sign for vehicle use, without the written authorization of the Director or a

park attendant.

Parking of vehicles

14 A person must not park a vehicle in a position or place in the Wildlife Park that prevents

or is likely to prevent free and convenient movement of other vehicles or park in any

area in the Wildlife Park where parking is prohibited by sign or verbal directions of a

park attendant, without the authorization of a park attendant.

Traffic directions

(1) A park attendant may restrict entry to the Wildlife Park and give directions

required to direct traffic and persons in the Wildlife Park if the park attendant

considers it necessary for any of the following reasons:

(

a) to ensure orderly movement of traffic;

(

b) to prevent injury or damage to persons or property;

(

c) to permit proper action in an emergency;

(

d) to prevent unnecessary or excessive noise or disturbance.

(2) A person must comply with the directions of a park attendant under subsection (1),

despite any posted signs to the contrary.

Directions to leave park

(1) A person must leave the Wildlife Park immediately if directed to do so by a park

attendant.

(2) A person directed to leave the Wildlife Park must not return for at least 72 hours

except as authorized by a park attendant.
