EXECUTIVE GOVERNMENT ADMINISTRATION CONSEQUENTIAL 2 B I L L No. 130

An Act to make consequential amendments to certain Acts resulting from the enactment of The Executive Government Administration Act (Assented to ) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

Short title 1 This Act may be cited as The Executive Government Administration Consequential Amendments Act, 2013. S.S. 1998, c.A-5.2 amended 2(1) The Adoption Act, 1998 is amended in the manner set forth in this section.

(2) Section 2 is amended: (

a) in the English version: (

i) by repealing the definition of “department”; and (ii) by adding the following definition in alphabetical order: “‘ministry’ means the ministry over which the minister presides; (« ministère »)”; and (

b) in the French version in the definition of « ministère » by striking out “(“department”)” and substituting “(“ministry”)”.

(3) Section 29.5 of the English version is amended in the portion preceding clause (

a) by striking out “department” and substituting “ministry”.

(4) Subsection 29.6(12) of the English version is amended by striking out “department” and substituting “ministry”.

(5) Section 36 of the English version is amended by striking out “department” wherever it appears and in each case substituting “ ministry”.

(6) Section 39 of the English version is amended by striking out “department” and substituting “ministry”. S.S. 1996, c.C-37.3,

section 266 amended 3 Paragraph 266(2)(a)(i)(

B) of The Co-operatives Act, 1996 is amended by striking out “ The Department of Health Act ” and substituting “ The Health Administration Act”.

Titre abrégé 1 Loi de 2013 portant modifications corrélatives à la loi intitulée The Executive Government Administration Act . Modification du ch. A-5.2 des L.S. 1998 2(1) La Loi de 1998 sur l’adoption est modifiée de la manière énoncée au présent article.

(2) L’article 2 est modifié :

a) dans la version anglaise : (

i) par abrogation de la définition de « department »; (ii) par insertion de la définition suivante dans l’ordre alphabétique : « “ministry” means the ministry over which the minister presides; (« ministère ») »;

b) dans la version française, à la définition de « ministère », par suppression de « (“department”) » et son remplacement par « (“ministry”) ».

(3) L’article 29.5 de la version anglaise est modifié dans le passage qui précède l’alinéa a) par suppression de « department » et son remplacement par « ministry ».

(4) Le paragraphe 29.6(12) de la version anglaise est modifié par suppression de « department » et son remplacement par « ministry ».

(5) L’article 36 de la version anglaise est modifié par suppression de « department » chaque fois qu’il y apparaît et son remplacement chaque fois par « ministry ».

(6) L’article 39 de la version anglaise est modifié par suppression de « department » et son remplacement par « ministry ». Modification de l’article 266 du ch. C-37.3 des L.S. 1996 3 La division 266(2)a)(i)(

B) de la Loi de 1996 sur les coopératives est modifiée par suppression de « la loi intitulée The Department of Health Act » et son remplacement par « la loi intitulée The Health Administration Act ».

EXECUTIVE GOVERNMENT ADMINISTRATION CONSEQUENTIAL 4 S.S. 2006, c.E-11.2,

section 42 amended 4 Subsection 42(1) of The Evidence Act is amended by striking out “Provincial Secretary” and substituting “keeper of the Great Seal”. S.S. 1995, c.I-11.2 amended 5(1) The

Interpretation Act, 1995 is amended in the manner set forth in this section.

(2) Section 23 is amended: (

a) in subsection (2) of the English version in the portion preceding clause (

a) by striking out “department” and substituting “ministry”; and (

b) by repealing subsection (3) and substituting the following: “

(3) In this section, ‘ministry’ means a ministry as defined in The Executive Government Administration Act ”.

(3) The definition of “Executive Council” in subsection 27(1) is amended by striking out “The Government Organization Act ” and substituting “The Executive Government Administration Act ”. S.S. 2007, c.L-11.3 amended 6(1) The Legislative Assembly and Executive Council Act, 2007 is amended in the manner set forth in this section.

(2) The

long title is amended by striking out “and the Executive Council of Saskatchewan”.

(3) Section 1 is repealed and the following substituted: “Short title 1 This Act may be cited as The Legislative Assembly Act, 2007 ”. (4) Subsection 12(2) of the English version is amended by striking out “department” and substituting “ministry”.

(5) Section 14 is amended: (

a) in clause (b): (

i) by striking out “ or” after subclause (xii) of the English version; (ii) in subclause (xiii) by adding “ , marriage commissioner ” after “notary public”; (iii) by adding “ or” after subclause (xiii) of the English version; and (iv) by adding the following subclause after subclause (xiii): “(xiv) a chairperson, vice-chairperson, director or member of a Crown corporation”; and (

b) by repealing clause (c).

Loi sur la preuve est modifié par suppression de « secrétaire provincial » et son remplacement par « gardien du grand sceau ». Modification du ch. I-11.2 des L.S. 1995 5(1) La Loi d’interprétation de 1995 est modifiée de la manière énoncée au présent article.

(2) L’article 23 est modifié :

a) au paragraphe (2) de la version anglaise, dans le passage qui précède l’alinéa a), par suppression de « department » et son remplacement par « ministry »;

b) par abrogation du paragraphe (3) et son remplacement par ce qui suit : «

(3) Au présent article, “ministère” désigne un ministry au sens défini dans la loi intitulée The Executive Government Administration Act ».

(3) La définition de « conseil exécutif » au paragraphe 27(1) est modifiée par suppression de « The Government Organization Act » et son remplacement par « The Executive Government Administration Act ». Modification du ch. L-11.3 des L.S. 2007 6(1) La Loi de 2007 sur l’Assemblée législative et le Conseil exécutif est modifiée de la manière énoncée au présent article.

(2) Le

titre intégral est modifié par suppression de « et le Conseil exécutif de la Saskatchewan ».

(3) L’article 1 est abrogé et remplacé par ce qui suit : «

Titre abrégé 1 Loi de 2007 sur l’Assemblée législative ».

(4) Le paragraphe 12(2) de la version anglaise est modifié par suppression de « department » et son remplacement par « ministry ».

(5) L’article 14 est modifié :

a) à l’alinéa b) : (

i) par suppression de « or » après le sous-alinéa (xii) de la version anglaise, (ii) au sous-alinéa (xiii), par insertion de « , commissaire aux mariages » après « notaire », (iii) par adjonction de « or » après le sous-alinéa (xiii) de la version anglaise, (iv) par adjonction de ce qui suit après le sous-alinéa (xiii) : « (xiv) président, vice-président, administrateur ou membre d’une société d’État »;

b) par abrogation de l’alinéa c).

EXECUTIVE GOVERNMENT ADMINISTRATION CONSEQUENTIAL 6 (6) Subsection 65(2) is repealed and the following substituted: “

(2) Subject to subsections (3) and (4), the Lieutenant Governor in Council may appoint a review committee to review and make a report respecting the amount of a salary, indemnity or allowance: (

a) provided for in this Part; and (

b) for the President of the Executive Council and ministers of the Crown ”. (7) Subsection 66(3) is repealed and the following substituted: “

(3) On and after the day a directive issued by the board pursuant to subsection (1) becomes effective, a member is to be paid the salary, indemnity or allowance set out in the directive: (

a) in the amounts and the manner prescribed in the directive; (

b) as adjusted, from time to time, in accordance with the manner prescribed in the directive; and (

c) subject to the terms and conditions prescribed in the directive ”.

(8) Section 73 of the English version is amended: (

a) in clause (

a) by striking out “ department ” and substituting “ministry”; and (

b) in clause (

b) by striking out “ department” and substituting “ministry”. (9) Subsection 80(4) is amended by striking out “ The Tabling of Documents Act, 1991 ” and substituting “

Section 13 of The Executive Government Administration Act”.

(10) Section 81 of the English version is repealed and the following substituted: “Legislative Library as official depository 81(1) In this section, ‘government publication’ means a publication, pamphlet or circular that: (

a) is issued for general or limited public distribution by a ministry, board, commission or agency of the Government of Saskatchewan or a Crown corporation; and (

b) is published by or pursuant to the authority of a ministry, board, commission or agency of the Government of Saskatchewan or a Crown corporation.

(2) The Legislative Library is the official library for the deposit of government publications.

(3) Every ministry, board, commission and agency of the Government of Saskatchewan and every Crown corporation shall deposit with the Legislative Library eight complimentary copies of every government publication that: (

a) is released in any form, including print and electronic, for general or limited public distribution either for free or for sale; and (

b) is issued by them or pursuant to their authority in collaboration with a commercial publisher.

(6) Le paragraphe 65(2) est abrogé et remplacé par ce qui suit : «

(2) Sous réserve des paragraphes (3) et (4), le lieutenant-gouverneur en conseil peut nommer un comité de révision chargé de réviser et d’établir un rapport portant sur le montant des traitements, indemnités et allocations :

a) prévus dans la présente partie;

b) destinés au président du Conseil exécutif et aux ministres de la Couronne ».

(7) Le paragraphe 66(3) est abrogé et remplacé par ce qui suit : «

(3) Le jour de l’entrée en vigueur d’une directive du bureau donnée en vertu du paragraphe (1), et par la suite, un député doit recevoir le traitement, l’indemnité ou l’allocation fixé dans la directive :

a) selon le montant et de la manière indiqués dans la directive;

b) rajusté, au besoin, en conformité avec la manière établie dans la directive;

c) sous réserve des modalités et des conditions prévues dans la directive ».

(8) L’article 73 de la version anglaise est modifié :

a) à l’alinéa a), par suppression de « department » et son remplacement par « ministry »;

b) à l’alinéa b), par suppression de « department » et son remplacement par « ministry ».

(9) Le paragraphe 80(4) est modifié par suppression de « La loi intitulée The Tabling of Documents Act, 1991 » et son remplacement par « L’article 13 de la loi intitulée The Executive Government Administration Act ».

(10) L’article 81 de la version anglaise est abrogé et remplacé par ce qui suit : « Legislative Library as official depository 81(1) In this section, “government publication” means a publication, pamphlet or circular that: (
