I, Adrian Dix, Minister of Health, order that, effective September 1, 2020,

(

a) the Midwives Regulation, B.C. Reg. 281/2008, is amended as set out in the

attached

Schedule 1,

(

b) the Nurses (Licensed Practical) Regulation, B.C. Reg. 224/2015, is amended

as set out in the attached

Schedule 2,

(

c) the Nurses (Registered) and Nurse Practitioners Regulation, B.C. Reg. 284/2008,

is amended as set out in the attached

Schedule 3, and

(

d) the Nurses (Registered Psychiatric) Regulation, B.C. Reg. 227/2015, is amended

as set out in the attached

Schedule 4.

Schedule 1

Section 1 of the Midwives Regulation, B.C. Reg. 281/2008, is amended

(

a) by repealing the

definitions of "aboriginal" and "aboriginal midwifery" and substituting the following:

"Indigenous" means relating to the aboriginal peoples of Canada within the meaning of

section 35

of the Constitution Act, 1982 ;

"Indigenous midwifery" means

(

a) traditional Indigenous midwifery practices including the use and administration

of traditional herbs and medicines and other cultural and spiritual practices,

(

b) contemporary Indigenous midwifery practices which are based on, or originate

in, traditional Indigenous midwifery practices, or

(

c) a combination of traditional and contemporary Indigenous midwifery practices; ,

(

b) in the definition of "midwifery" by striking out " post-partum " and substituting " postpartum ",

(

c) in paragraph (

a) of the definition of "midwifery" by striking out " women, newborns and infants, including the carrying out of " and substituting " patients, newborns and infants, including carrying out ",

(

d) in paragraph (

b) of the definition of "midwifery" by striking out " women, including provision of " and substituting " persons, including providing ",

(

e) in paragraphs (

c) and (

d) of the definition of "midwifery" by striking out " women " in both places and substituting " patients ",

(

f) in the definition of "midwifery diagnosis" by striking out " a woman's mental or physical condition, or that of her newborn " and substituting " a patient's mental or physical condition, or that of the patient's newborn ", and

(

g) by adding the following

definitions:

"patient" means a person who

(

a) is pregnant,

(

b) is in labour or is delivering a child, or

(

c) is in the postpartum period;

"registrant" means a registrant who is authorized under the bylaws to practise midwifery; .

Section 2 is repealed and the following substituted:

College name

2 The name of the college responsible for carrying out the objects of the Act in respect

of midwifery is "British Columbia College of Nurses and Midwives".

Section 4 (2) is repealed and the following substituted:

(2) A registrant who is Indigenous may practise Indigenous midwifery.

4 The following

section is added:

Provisional registrant classes

4.1 The college is authorized to establish, under

section 19 (1) (

i) of the Act, a class

of provisional registrants for the purposes of

section 20 (4.3) of the Act.

Section 5 is amended

(

a) in subsection (1) (

c) and (

e) by striking out " post-partum " and substituting " postpartum ",

(

b) in subsection (1) (g) (iii) by striking out " a woman during labour or the post-partum period " and substituting " a patient during labour or the postpartum period ",

(

c) in subsection (1) (g) (iv) (

A) by striking out " women " and substituting " patients ", and

(

d) in subsection (2) by striking out " aboriginal " and substituting " Indigenous " in both places.

Section 6 is amended

(

a) in subsection (1) by striking out " post-partum " and substituting " postpartum ", and

(

b) in subsection (6) by striking out " a woman or her newborn, as the case may be, during pregnancy, labour, delivery

or the post-partum period " and substituting " a patient or the patient's newborn, as the case may be, during pregnancy, labour,

delivery or the postpartum period ".

7 The table in

Schedule A is amended

(

a) in Column 2 opposite " Anti-virals " in Column 1 by striking out " post-partum " and substituting " postpartum ", and

(

b) in Column 2 opposite " Immune globulins " in Column 1 by striking out " woman " and substituting " patient ".

Schedule 2

Section 2 of the Nurses (Licensed Practical) Regulation, B.C. Reg. 224/2015,

is amended by striking out " Nursing Professionals " and substituting " Nurses and Midwives ".

2 The following

section is added:

Restricted activities limited to registrants

8 Only a registrant may provide a service that includes the performance of an activity

set out in

section 6 (1) or 7 (1).

Schedule 3

Reg. 284/2008, is amended by striking out " Nursing Professionals " and substituting " Nurses and Midwives ".

2 The following

section is added:

9.1 Only a registrant may provide a service that includes the performance of an activity

set out in

section 6 (1), 7 (1), 8 (1) or 9 (1).

Schedule 4

Section 2 of the Nurses (Registered Psychiatric) Regulation, B.C. Reg. 227/2015,

is amended by striking out " Nursing Professionals " and substituting " Nurses and Midwives ".

2 The following

section is added:
