B.C. Reg. 156/2008 , deposited June 25, 2008, pursuant to the MINISTRY OF LANDS, PARKS AND HOUSING ACT [Section 11 (1)]. Order in Council 432/2008, approved and ordered June 25, 2008.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the British Columbia Housing Management Commission Regulation, B.C. Reg. 490/79, is amended as set out in the attached Appendix.

Appendix

1 The third paragraph in the

preamble before

section 1 of the British Columbia Housing Management Commission Regulation, B.C. Reg. 490/79, is amended

(

a) by striking out "the Minister of Municipal Affairs and Housing to authorize" and substituting "the minister responsible for sections 5 (c), 8.1 and 10 of the Ministry of Lands, Parks and Housing Act to authorize the", and

(

b) by striking out "the Minister of Municipal Affairs and Housing considers" and substituting "the minister responsible for sections 5 (c), 8.1 and 10 of the Ministry of Lands, Parks and Housing Act considers".

Section 1 is amended by repealing the definition of "minister" and substituting the following:

"minister" means the minister responsible for sections 5 (c), 8.1 and 10 of the Ministry of Lands, Parks and Housing Act ; .

Section 2 (3) is amended by striking out "chairman" and substituting "chair".

Section 3 is amended

(

a) in paragraph (

d) by adding "and operations" at the end, and

(

b) by repealing paragraphs (f.1) and (f.2) and substituting the following:

(f.1) borrow from Her Majesty the Queen in Right of the Province represented by the Minister of Finance on the terms agreed to by the commission and that minister,

(f.2) make loans and grants to societies, public housing corporations or housing co-operatives incorporated under the laws of British Columbia or of Canada for the purpose of facilitating projects to build or to repair housing intended for sale or rent to low and moderate income households, .

Section 4 is amended

(

a) in subsection (5) by striking out "The chairman shall be the convenor" and substituting "The chair shall be the convener", and

(

b) in subsection (6)

(

i) by striking out "chairman" in both places and substituting "chair",

(ii) by striking out "vice-chairman" and substituting "vice-chair", and

(iii) by striking out "chairman's" and substituting "chair's".

Section 5 is amended by striking out "general manager" wherever it appears and substituting "chief executive officer".

Section 6 is amended by striking out "in the City of Vancouver," and substituting "located".

Section 7 is amended

(

a) in subsection (3) by striking out "December" and substituting "March",

(

b) by repealing subsection (4), and

(

c) in subsection (5) by striking out "chairman" and substituting "chair".

Section 9 (1) is amended by striking out "under

section 9.1 or other" and substituting "under

section 3 (f.1) or any other".

Section 9.1 is repealed.

Section 11 is amended by striking out "Sections 32, 33, 100 and 119 to 124 of the Company Act " and substituting "Sections 31, 142 (3), 143 to 145, 147 to 153 and 193 of the Business Corporations Act ".
