An Act to Amend the Residential Property Tax Relief Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 6.1 of the Residential Property Tax Relief Act,

chapter R-10 of the Revised Statutes, 1973, is amended by (

a) repealing subsection (1) and substituting the fol- lowing: 6.1(1) Upon application to the Administrator, a person in whose name real property is assessed shall be allowed an amount determined in accordance with subsection (5) as an allowance to be applied against any tax arrears and penalties payable under the Real Property Tax Act and against taxes owing in respect of the real property for the year or any succeeding year if the person qualifies for a credit under

section in respect of that real property and the total taxable income of (

a) the person, and (

b) the person’s spouse or the individual with whom the person cohabits as husband and wife, if any, PROJET DE LOI Loi modifiant la

chapitre R-10 des Lois révi- sées de 1973, est modifié par ce qui suit : (

a) l’abrogation du paragraphe (1) et son remplace- ment par : 6.1(1) À la suite d’une demande à l’administrateur, doit être alloué à une personne au nom de laquelle des biens réels sont évalués, un montant fixé conformément au pa- ragraphe (5) à

titre d’allocation à imputer sur tout arriéré d’impôts et pénalités payables en vertu de la

Loi sur l’im- pôt foncier et sur les impôts exigibles relatifs à ces biens réels pour l’année ou toute année suivante si la per- sonne est habilitée à avoir un crédit en vertu de l’article quant à ces biens réels et si le revenu imposable total de

a) la personne, et

b) de son conjoint ou du particulier avec lequel la personne cohabite en tant que mari et femme, le cas échéant, 2 Projet de loi Loi modifiant la

b) adding after subsection (4) the following: 6.1(5) The amount of an allowance in respect of real property is (

a) the total amount of the taxes in respect of the por- tion of that real property used as a residence which are imposed in the year in which the application for the al- lowance is made and which are due and payable in that year, or (

b) two hundred and twenty five-dollars, whichever is lesser. 6.1(6) For the purposes of subsection (1), “taxable in- come” means taxable income as defined in the Income Tax Act (Canada). 6.1(7) For the purposes of subsection (1), the amount of total taxable income is twenty five thousand dollars or as prescribed by regulation. 2

Section of the Act is amended by (

a) repealing paragraph (

b) and substituting the fol- lowing: (

b) respecting the amount of an allowance only if the amount is greater than what is prescribed by subsection 6.1(5); (

b) repealing paragraph (

c) and substituting the fol- lowing: (

c) prescribing an amount for the purposes of subsec- tion 6.1(7) but only if the amount is greater than twenty five thousand dollars; (

c) repealing paragraph (c.2). Commencement This Act shall be deemed to have come into force on January 1, 2006. n’a pas dépassé un montant prescrit au paragraphe (7) au cours de l’année civile précédente.

b) deux cents vingt-cinq dollars, selon le montant qui est le moindre. 6.1(6) Aux fins du paragraphe (1), « revenu imposable » désigne un revenu imposable selon la définition qu’en donne la Loi de l’impôt sur le revenu (Canada). 6.1(7) Aux fins du paragraphe (1), le montant du revenu imposable total s’élève à vingt cinq mille dollars ou du montant prescrit par règlement. 2 L’article est modifié par ce qui suit :

a) l’abrogation de l’alinéa b) et son remplacement par :

b) concernant le montant d’une allocation seulement si le montant est plus élevé que ce qui est prescrit au pa- ragraphe 6.1(5);

b) l’abrogation de l’alinéa c) et son remplacement par :

c) prescrivant un montant aux fins du paragraphe 6.1(7) seulement si le montant est plus élevé que vingt cinq mille dollars;

c) l’abrogation du paragraphe c.2). Entrée en vigueur La présente loi est réputée être entrée en vigueur le er janvier 2006.
