EXPLANATORY NOTE NOTE EXPLICATIVE Under The Manitoba Public Insurance Corporation Act , a person whose main occupation is providing care, without being paid, for a child or an infirm adult receives a weekly indemnity if he or she is injured in an accident. Actuellement, sous le régime de la

Under this Bill, if such a person dies because of a n accident, the amount of that weekly indemnity goes to the person's spouse or common-law partner or the legal guardian of the child, or if the care was being pro vided to an infirm adult, to that adult.

section 132: 2 Il est a jouté, après l'article 132, ce qui suit : If accident is fatal 132.1(1) In the case of a victim who dies as a result of the accident, the amount that would have been payable under

section 132 to the victim had he or sh e survived is payable to the following: (

a) if the victim was providing care to a child under 16 years of age, either (

i) to the victim's spouse or common-law partner, if the victim had a spouse or common-law partner on the day of the accident, or (ii) to the child's legal guardian, if the child has a legal guardian; (

Duration 132.1(2) The corporation shall terminate an indemnity (

a) under clause (1)(a), when the child cared for reaches 16 years of age; and (

b) under clause (1)(b), at the time when the deceased victim would reasonably have, but for the accident, ceased to provide care similar to the care he or she provided before the accident. Période d'indemnisation 132.1(2) La Société cesse de verser l'indemnité :
