Section 43.1 of the Pension Benefits Act,

chapter P-5.1 of the Acts of New Brunswick, 1987, is amended L’article 43.1 de la

Loi sur les prestations de pen- sion,

chapitre P-5.1 des Lois du Nouveau-Brunswick de 1987, est modifié (

a) by repealing subsection (5) and substituting the following:

a) par l’abrogation du paragraphe (5) et son rem- placement par ce qui suit : 43.1(5) If the member or former member has a spouse or a common-law partner at the date of death, a designa- tion under subsection (4) has no effect unless the spouse or common-law partner waives any entitlement he or she may have to a payment under this

section in a form pro- vided by the Superintendent. 43.1(5) Lorsque le participant ou l’ancien participant a un conjoint ou conjoint de fait à la date du décès, la dési- gnation prévue au paragraphe (4) est dépourvue d’effet sauf si le conjoint ou le conjoint de fait renonce, au moyen de la formule que fournit le surintendant, à tout paiement auquel il aurait pu avoir droit au

titre du pré- sent article. (

b) by adding after subsection (5) the following:

b) par l’adjonction de ce qui suit après le paragra- phe (5) : 43.1(5.1) A waiver under subsection (5) is not valid unless delivered to the administrator of the pension plan before the date of death of the member or former mem- ber. 43.1(5.1) La renonciation prévue au paragraphe (5) n’est valide que si elle est remise à l’administrateur du régime de pension avant la date de décès du participant ou de l’ancien participant. 43.1(5.2) A waiver under subsection (5) may be re- voked by the member and the member’s spouse or common-law partner or by the former member and the 43.1(5.2) Le participant et son conjoint ou conjoint de fait ou l’ancien participant et son conjoint ou conjoint de fait peuvent révoquer la renonciation prévue au paragra- 1 former member’s spouse or common-law partner in a form provided by the Superintendent. phe (5) au moyen de la formule que fournit le surinten- dant. 43.1(5.3) A revocation under subsection (5.2) is not valid unless delivered to the administrator of the pension plan before the date of death of the member or former member. 43.1(5.3) La révocation prévue au paragraphe (5.2) n’est valide que si elle est remise à l’administrateur du régime de pension avant la date de décès du participant ou de l’ancien participant.
