B.C. Reg. 60/2019 , deposited March 29, 2019, under the CIVIL RESOLUTION TRIBUNAL ACT [section 93] and the INSURANCE (VEHICLE) ACT [section 45]. Order in Council 136/2019, approved and ordered March 29, 2019.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that

(

a) the Insurance (Vehicle) Regulation, B.C. Reg. 447/83, is amended as set out

in the attached Appendix 1,

(

b) effective March 31, 2019, B.C. Reg. 234/2018, is amended as set out in the

attached Appendix 2,

(

c) effective March 31, 2019, the Minor Injury Regulation, B.C. Reg. 234/2018,

is amended as set out in the attached Appendix 3, and

(

d) effective April 1, 2019, the Accident Claims Regulation, B.C. Reg. 233/2018,

is amended as set out in the attached Appendix 4.

Appendix 1

Section 78 of the Insurance (Vehicle) Regulation, B.C. Reg. 447/83, is amended

in the definition of "rehabilitation" by striking out " of his injuries, " and substituting " of the injured person’s injuries, " and by striking out " by him " and substituting " by the injured person ".

Section 88 (2) (c) (ii) is amended by striking out " using the same standards and criteria applied under the Long Term Care Program

of the Continuing Care Division of the ministry of the minister responsible for the

administration of the Continuing Care Act ; " and substituting " based on the level of care provided by Home Community Care services under the Continuing Care Act ; ".

3 The following

section is added:

Requirement for receipts

88.01

(1) If an accident occurs for which benefits are provided under

section 88, the insured

must provide to the corporation a receipt for the expenses incurred that will be compensated

as benefits under that

section no later than 60 days from the date that those expenses

are incurred.

(2) The corporation is not liable to an insured who, without reasonable excuse,

fails to comply with this section.

Section 97 is amended

(

a) in subsection (1) by striking out " Where " and substituting " If " and by striking out " shall " and substituting " must ", and

(

b) in subsection (1) (

c) by striking out " furnish " and substituting " provide ".

Section 98 (1) is amended by striking out " furnish " and substituting " provide ".

6 The following

section is added:

Transitional – receipts

104.21

Section 88.01 applies in respect of an accident that occurs on or after April 1, 2019.

Appendix 2

Section 1 (

e) of Appendix 2 of B.C. Reg. 234/2018 is repealed.

Section 12 (

b) of Appendix 2 of B.C. Reg. 234/2018, as it enacts

section 88 (1) (

c) of the Insurance (Vehicle) Regulation, is amended by repealing paragraph (

c) and substituting

the following:

(

c) dental, hospital, ambulance and professional nursing services, speech therapy,

medication, prostheses and orthoses.

Section 12 (

c) of Appendix 2 of B.C. Reg. 234/2018, as it enacts

section 88 (1.01)

of the Insurance (Vehicle) Regulation, is amended by striking out " a treatment of a health care service " and substituting " a treatment ".

Section 20 of Appendix 2 of B.C. Reg. 234/2018, as it enacts

section 104.1 of

the Insurance (Vehicle) Regulation, is amended

(

a) by striking out " under a certificate issued before April 1, 2019 " wherever it appears and substituting " in respect of an accident that occurred before April 1, 2019 ", and

(

b) by striking out " under a certificate issued on or after April 1, 2019 " wherever it appears and substituting " in respect of an accident that occurs on or after April 1, 2019 ".

Section 20 of Appendix 2 of B.C. Reg. 234/2018, as it enacts

section 104.2 of

the Insurance (Vehicle) Regulation, is amended by striking out " under a certificate that is valid on April 1, 2019 regardless of the date of issue

of the certificate or " and substituting " for expenses incurred on or after April 1, 2019 regardless of ".

Appendix 3

Section 8 of the Minor Injury Regulation, B.C. Reg. 234/2018, is amended

(

a) by repealing subsection (1) (

c) and substituting the following:

(

c) of what the physician’s specialty is, if applicable, , and

(

b) in subsection (3) by adding the following paragraph:

(b.1) the class of licence of the physician; .

Section 9 (2) (

b) by striking out " issued by the college to the registered care advisor, " and substituting " of the registered care advisor, ".

Appendix 4

Section 3 (

b) of the Accident Claims Regulation, B.C. Reg. 233/2018, is amended

by adding the following subparagraph:

(

v) any information required by the tribunal.
