An Act to Amend the Liquor Control Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 40.2 of the Liquor Control Act,

chapter L-10 of the Revised Statutes, 1973, is amended (

a) by adding after subsection (1) the following: 40.2(1.1) Notwithstanding any other provision of this Act, the Corporation may appoint upon such terms and conditions as the Corporation considers appropriate a wine-maker who holds a subsisting winery licence issued under this Act and who manufactures 100,000 litres of wine or less per year as an agent of the Corporation to sell, on behalf of the Corporation for consumption in a resi- dence, wine manufactured by the wine-maker if such wine is sold in unopened packages at a farmer’s market ap- proved by the Corporation. (

b) by adding after subsection (2) the following: 40.2(2.1) The provisions of this Act and the regulations relating to the sale of liquor by the Corporation and to a liquor store established by the Corporation for the sale of liquor apply mutatis mutandis to a wine-maker appointed as an agent of the Corporation under subsection (1.1) and PROJET DE LOI 63 Loi modifiant la

a) par l’adjonction, après le paragraphe (1), de ce qui suit : 40.2(1.1) Nonobstant toute autre disposition de la pré- sente loi, la Société peut nommer aux conditions jugées appropriées par elle un fabricant de vin titulaire d’une li- cence de fabricant de vin non périmée délivrée en vertu de la présente loi et qui fabrique 100 000 litres de vin au plus par année à

titre de représentant de la Société pour vendre, au nom de la Société pour consommation dans une rési- dence, du vin fabriqué par le fabricant de vin si ce vin est vendu dans des emballages non ouverts à un marché des fermiers approuvé par la Société.

b) par l’adjonction, après le paragraphe (2), de ce qui suit : 40.2(2.1) Les dispositions de la présente loi et des règle- ments relatives à la vente de boissons alcooliques par la Société et à un magasin de la Société établi par la Société pour la vente des boissons alcooliques s’appliquent muta- tis mutandis à un fabriquant de vin nommé à

c) in subsection (3) by striking out “under subsec- tion (1)” and substituting “under subsection (1) or (1.1), as the case may be,”; (

Section 1 (

c) The existing provision is as follows: 40.2(3) A brewer, a wine-maker or a distiller appointed as an agent of the Corporation under subsection (1) shall in the returns referred to in subsections 114(1) and 115(1) differentiate between the amount of the sales of beer, wine or liquor as an agent of the Corporation and the amount of the sales of beer, wine or liquor to the Corporation. (

d) The existing provision is as follows: 40.2(4) Subsection 141(1) does not apply to a brewer, a wine-maker or a distiller appointed as an agent of the Corporation under subsection (1). NOTES EXPLICATIVES
