Section 1 of the Accountability and Continuous Im‐ provement Act,

chapter 27 of the Acts of New Bruns ‐ wick, 2013, is amended 1 L’article 1 de la

a) by repealing the definition “annual plan”;

Section 5 of the Act is repealed and the following is substituted: 6 L’article 5 de la Loi est abrogé et remplacé par ce qui suit : Preparation of annual report Préparation du rapport annuel 5(1) Each Crown entity shall prepare an annual report on its preceding fiscal year. 5(1) Chaque entité de la Couronne prépare annuelle ‐ ment un rapport concernant son exercice financier précé ‐ dent. 5(2) An annual report for a Crown entity that is a de ‐ partment or a Category 1 Crown body shall include 5(2) S’agissant d’une entité de la Couronne qui est soit un ministère, soit un organisme de la Couronne de caté ‐ gorie 1, le rapport annuel renferme : (

a) if the Crown entity is required to prepare an aud‐ ited financial statement, the audited financial state ‐ ment,

b) a comparison of the actual results to the pro ‐ jected results set out in the business plan, and if there is a variance between the results for the fiscal year, an explanation of the variance,

c) a statement indicating that the Minister of the Crown or the chair of the Crown entity, as the case may be, is accountable for the preparation of the an ‐ nual report and for achieving the specific goals and objectives of the report, and

a) information relating to the activities undertaken by the Crown entity during the fiscal year in carrying out its mandate, and

Filing of annual report Dépôt du rapport annuel 5.1(1) The approved annual report of a Crown entity that is a department or a Category 1 Crown body shall be filed with the Clerk of the Legislative Assembly on or before a date prescribed by regulation. 5.1(1) S’agissant d’une entité de la Couronne qui est soit un ministère, soit un organisme de la Couronne de catégorie 1, le rapport annuel approuvé est déposé auprès du greffier de l’Assemblée législative au plus tard à la date prescrite par règlement. 5.1(2) Despite subsection (1), Executive Council may grant an extension of the time to file an annual report for no more than six months. 5.1(2) Par dérogation au paragraphe (1), le Conseil exécutif peut proroger, d’au plus six mois, le délai im ‐ parti pour déposer le rapport annuel.

Publication of annual report Affichage du rapport annuel 5.2(1) A Crown entity that is a department or a Cate ‐ gory 1 Crown body shall make the approved annual re ‐ port public by publishing it online as soon as possible af‐ ter it is filed with the Clerk of the Legislative Assembly. 5.2(1) L’entité de la Couronne qui est soit un minis ‐ tère, soit un organisme de la Couronne de catégo ‐ rie 1 rend public son rapport annuel approuvé en l’affichant en ligne dès que possible après son dépôt au ‐ près du greffier de l’Assemblée législative. 5.2(2) A Crown entity that is a Category 2 Crown body shall make the approved annual report public by publishing it online within six months after the end of its fiscal year. 5.2(2) L’entité de la Couronne qui est un organisme de la Couronne de catégorie 2 rend public son rapport an ‐ nuel approuvé en l’affichant en ligne dans les six mois qui suivent la fin de son exercice. 5.2(3) Despite subsection (2), the responsible minister may grant an extension of the time to publish an annual report by a Category 2 Crown body for no more than six months. 5.2(3) Par dérogation au paragraphe (2), le ministre responsable peut proroger, d’au plus six mois, le délai imparti pour afficher le rapport annuel d’un organisme de la Couronne de catégorie 2. 8 Subsection 6(2) of the Act is repealed and the fol ‐ lowing is substituted: 8 Le paragraphe 6(2) de la Loi est abrogé et remplacé par ce qui suit : 6(2) A memorandum of understanding shall be re ‐ viewed and extended, amended or replaced three years after the date on which it was developed and every three years after that date. 6(2) Le protocole d’entente est révisé et reconduit, modifié ou remplacé trois ans après la date à laquelle il a été élaboré, puis aux trois ans par la suite. 9

section shall be deemed to satisfy the requirements of

section 3 of the Accountability and Continuous Improvement Act as amended by
