B.C. Reg. 60/2010 , deposited March 4, 2010, pursuant to the POLICE (MISCONDUCT, COMPLAINTS, INVESTIGATIONS, DISCIPLINE AND PROCEEDINGS) AMENDMENT ACT, 2009 [Section 12] and the POLICE ACT [Section 184]. Order in Council 121/2010, approved and ordered March 3, 2010.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, effective March 31, 2010,

(

a) sections 2 to 11 of the Police (Misconduct, Complaints, Investigations, Discipline and Proceedings) Amendment Act, 2009 , S.B.C. 2009, c. 28, are brought into force,

(

b) the Code of Professional Conduct Regulation, B.C. Reg. 205/98, is repealed,

(

c) the Enforcement Officer Discipline and Code of Conduct Regulation, B.C. Reg. 228/2002, is repealed,

(

d) the Police Act Forms Regulation, B.C. Reg. 202/98, is repealed and the Police Act (Part 11) Forms Regulation set out in the attached

Schedule A is made,

(

e) the Organized Crime Agency of British Columbia Complaints and Operations Regulation, B.C. Reg. 229/2002, is amended as set out in the attached

Schedule B,

(

f) the South Coast British Columbia Transportation Authority Police Service Operations Regulation, B.C Reg. 484/2004, is amended as set out in the attached

Schedule C, and

(

g) the Stl'atl'imx Tribal Police Service Operations Regulation, B.C. Reg. 385/99, is amended as set out in the attached

Schedule D.

Interpretation

1 In this regulation, "Act" means the Police Act .

TAKE NOTICE:

If you are aggrieved by the disposition of your case, you May file with the police complaint commissioner a written request for a public hearing or review on the record before a Provincial Court judge. The police complaint commissioner must receive the request within 20 business days after you receive the discipline authority's report of the discipline proceeding under

section 133 (1) (

a) of the Police Act . Unless a public hearing or review on the record is arranged by the police complaint commissioner, the findings and reasons set out in Form 3 and the determination as to appropriate disciplinary or corrective measures set out in this Form 4 in respect of the matter are final and conclusive and not open to question or review by a court on any ground.

Schedule B

1 Sections 2 and 4 of the Organized Crime Agency of British Columbia Complaints and Operations Regulation, B.C. Reg. 229/2002, is amended by striking out "

Part 9 " wherever it appears and substituting "

Part 11 ".

2 Sections 3 and 5 are repealed.

Schedule C

Section 4 of the South Coast British Columbia Transportation Authority Police Service Operations Regulation, B.C. Reg. 484/2004, is amended

(

a) in subsection (1) by striking out "

Part 9 of the Police Act [Complaint Procedure] " and substituting "

Part 11 of the Police Act ",

(

b) by repealing subsection (2) and substituting the following:

(2) Paragraph (b) (

i) of the definition of "discipline authority" in

section 76 (1) of the Police Act does not apply to the SCBCTAPS and the following is substituted:

(

i) the board of the SCBCTAPS or a panel of one or more members of that board designated by the board for that purpose, .

(

c) by repealing subsection (3),

(

d) in subsection (4) by striking out "

Part 9 of the Police Act " and substituting "

Part 11 of the Police Act ",

(

e) by repealing subsection (4.1) and substituting the following:

(4.1) In applying

Part 11 of the Police Act for the purposes of this section,

(a) "reassign" and "transfer" mean attach conditions to the appointment of,

(b) "dismissal" and "reduction in rank" mean revocation of appointment,

(

c) any reference in that Part, other than in sections 158 and 179 of that Act, to "suspend" means suspend the appointment of, and

(

d) the references in

section 110 (5) to (8) of that Act to "the board" are deemed to be references to "the designated constable's employer ". ,

(

f) by adding the following subsection:

(5.1) Paragraphs (

a) to (

c) of

section 126 (1) of the Police Act do not apply and the following are substituted:

(

a) revoke the designated constable's appointment;

(

c) suspend the designated constable's appointment. , and

(

g) in subsection (6) by striking out "

section 65.3 " and substituting "

section 128 ".

Section 5 is repealed.

Schedule D

Section 5 of the Stl'atl'imx Tribal Police Service Operations Regulation, B.C. Reg. 385/99, is repealed.

Section 7 of the Stl'atl'imx Tribal Police Service Operations Regulation, B.C. Reg. 385/99, is amended

(

a) by striking out "

Part 9 " wherever it appears and substituting "

Part 11 ",

(

b) by striking out " , the Complaint Procedure, ",

(

c) by adding " and " at the end of paragraph (

c) and striking out " and " at the end of paragraph (d), and

(

d) by repealing paragraph (e).
