OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice and Attorney General dated February 24, 2009, and pursuant to Sections 3 and 4 of
Chapter 252 of the Revised Statutes of Nova Scotia, 1989, the Legal Aid Act, is pleased to: (
a) reappoint James L. Chipman, Q.C. of Bedford, Halifax Regional Municipality, as a director of the Nova Scotia Legal Aid Commission for a term of office of three years commencing March 30, 2009; (
b) reappoint Donald G. Harding, Q.C. of Shelburne, Shelburne County, as a director and Chair of the Nova Scotia Legal Aid Commission for a term of three years commencing March 30, 2009; (
c) reappoint Patrick J. Murray, Q.C. of Sydney, Cape Breton Regional Municipality, as a director of the Nova Scotia Legal Aid Commission for a term of office of three years commencing April 28, 2009; (
d) provide that the remuneration of James L. Chipman, Q.C. and Patrick Murray, Q.C. as directors shall be at the rate of $150 for each day of meetings of the Commission or a committee of it, to a maximum of $600 for each fiscal year; (
e) provide that the remuneration of Donald G. Harding, Q.C. as Chair shall be at the rate of $300 for each day of meetings of the Commission or a committee of it; (
f) direct that the reasonable expenses incurred by Donald G. Harding, Q.C., James L. Chipman, Q.C. and Patrick J. Murray, Q.C. in performing their duties associated with the Nova Scotia Legal Aid Commission be paid in accordance with the established guidelines approved for civil servants; and (
g) order that the Province shall defend, negotiate or settle claims or charges made against Donald G. Harding, Q.C., James L. Chipman, Q.C. and Patrick J. Murray, Q.C. and indemnify them from personal liability, provided that the Province is satisfied that the claim arises out of their activities in relation to their appointments and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
